NY: Middleburgh Mayor Sues for Taser-Carry Rights

Middleburgh Mayor Matthew Avitabile has filed a lawsuit in United states District Court arguing that he has the right to carry a taser. If he wins-and Schoharie County Attorney Mike West is doubtful he will-Mr. Avitabile said it doesn't mean he'll start carrying a taser on the streets of Middleburgh. But it doesn't mean he won't be carrying one either.

A panel of judges heard arguments Tuesday in a court case involving Mayor Andrew Gillum and other members of the city commission who voted against repealing a pair of local gun ordinances. The case may have larger implications surrounding what’s known as home rule.

Roy Innis, a polarizing civil rights icon who famously tussled with the Rev. Al Sharpton and a white supremacist on TV talk shows, has died. He was 82. Innis died Sunday at a New York City hospital. The cause was complications from Parkinson’s disease, according to the Washington Post.
Innis led the Congress of Racial Equality for more than four decades — espousing a conservatism that was reviled by left-leaning activists. ...
Innis decried affirmative action and loudly opposed busing as a strategy to combat segregation in schools.
A National Rifle Association board member, he also drew the condemnation of other black activists by arguing that gun control was “meant to deprive you of your freedom.”

Massachusetts had the lowest gun death rate in the country in 2015, newly released federal data shows, and advocacy groups on Tuesday attributed the state’s ranking to its tough firearm laws. There were 213 gun deaths in the state in 2015, for a rate of 3.13 per 100,000 residents, according to the US Centers for Disease Control and Prevention’s National Center for Injury Prevention and Control.

Two shooting deaths in 2016 -- both involving residents shooting at home invaders -- have been ruled as self-defense, the Henrico Police Department said Tuesday. In one case, police say that 19-year-old Taivon Maquell Fox was armed with a baseball bat when he began to assault a female resident at the Three Chopt West apartment complex on Oct. 30. A second suspect went upstairs in the apartment, "presumably to search for items to steal," police said.

A stabbing led to the arrest of a Broken Arrow man Tuesday after police said a woman told them she stabbed her ex-boyfriend. Broken Arrow Police said the woman told them she stabbed her ex-boyfriend, Donald Yandell, in self-defense after he tried to attack her in the home they share in the 300 block of West Quantico Street.

It began with a conversation at Tejon Ranch. For those of you who haven't had the pleasure of hunting the Tejon, it's a 270,000 acre ranch about an hour north of downtown Los Angeles that hosts seasonal hunts of elk, mule deer, turkey and various fur bearers along with year-round pig hunting. A few years back, under pressure from various state and special interest groups, the ranch agreed that all future hunts would be "lead free." That presented no problem for rifle hunters, as there were several manufacturers who loaded ammo with Barnes's excellent all copper bullets. But for the guides who venture into heavy brush after wounded pigs with handguns, it was a different story.

Utah's leading newspaper is urging Gov. Gary Herbert to kill any attempt to "eviscerate" the state's concealed carry law by ending a key requirement needed to obtain a permit. "As the governor argued in 2013, there seems to be no concrete example of how the long-standing law that requires a minimal level of training for anyone to legally carry a concealed firearm inconveniencies, much less criminalizes, any person's right to carry a weapon in self-defense," The Salt Lake Tribune said in an editorial published Tuesday.

A trio of firearms bills have been filed in the Iowa Legislature, igniting what Republicans hope will be wide-ranging debate over expanding Second Amendment rights in the state. Among those is a proposed amendment to the state constitution protecting Iowans' right to "acquire, keep, possess, transport, carry, transfer and use" firearms to "defend life and liberty and for all other legitimate purposes." It also would prohibit mandatory licensing, registration or special taxation of those actions.

Hagan's Motor Pool of Rochester is inviting people to start the new year with a bang. The car dealership is offering customers a free Glock 19 handgun with a purchase of most of its vehicles. Owner Mike Hagan hopes to give away 15 handguns by the end of the month. He said the Glock 19 promotion began on Jan. 2. It comes after a successful initiative last summer, when the dealership was offering a free AR-15 rifle with the purchase of certain vehicles.

A hotly contested legislative session in 2015 led to two controversial gun laws: One that allows for the open carry of handguns and another that permits the concealed carry of handguns on Texas college campuses. Now, one lawmaker is looking toward the upcoming legislative session with the hope to pass a bill that would give all Texans the right to openly carry a firearm — with or without a permit.

Had Esteban Santiago been in Connecticut, Indiana or California two months ago when he spoke incoherently to FBI agents about a U.S. intelligence agency controlling his mind, local police might not have been so quick to give him back his gun. Police and families in those states have something missing in Alaska — a legal basis upon which to seek a court order to temporarily remove a gun from someone in crisis, who appears to pose a threat to himself and others.

A host of Democratic state lawmakers, and a coalition of gun-control groups, gathered at the state capitol Tuesday, pushing legislation they say may have stopped deadly shootings that have happened in Florida over the past year. Proposals filed for the 2017 legislative session would ban military-style assault weapons in the state, while strengthening background checks for those wishing to purchase guns.

The Kalamazoo Township Police are replacing their .40-caliber service pistols for 9-mm Semi-automatics, and getting a break on the price by trading in their current guns. The Kalamazoo Township Board approved the $9,700 deal this week.

The Ohio State Senate recently passed House Bill 48, authorizing “concealed carry in vulnerable areas.” According to the Ohio Legislature website, Bill 48 modifies the “prohibition against carrying a concealed handgun onto institutions of higher education, day-care facilities, aircraft, certain government facilities, public areas of airport terminals, and school safety zones.”

A state lawmaker is seeking an end to Tennessee's firearm silencer ban in the name of "hearing protection." Republican Rep. Tilman Goins of Morristown has filed legislation that would remove silencers from the list of weapons banned for having "no common lawful purpose." Others include machine guns, short-barreled shotguns, brass knuckles and explosive weapons.

After two mass shootings in the state, some Florida lawmakers want an all-out ban on assault rifles. Florida would join a small handful of states in the Northeast and California if it passed a ban. The legislation calls for banning assault-style automatic rifles. It also calls for gun buyers to face tougher background checks, and it would make it harder to sell a gun to someone else.

The Arizona Supreme Court needs more information from lawyers before it can decide whether a Tucson law requiring seized guns to be destroyed violates state law. The court met Tuesday to consider whether to take up a case filed by Attorney General Mark Brnovich that is the first use of a new state law withholding state funds from cities if they enact laws conflicting with state laws.
