Attorney General Bonta: Property Owners Should Not Be Forced to Allow Guns on Their Properties

California Attorney General Rob Bonta today, as part of a multistate coalition, joined an amicus brief in support of a New York law that would criminalize possession of a weapon on a person’s private property without the owner’s express consent. The brief, filed in the U.S. Court of Appeals for the Second Circuit in Christian v. Nigrelli urges reversal of a district court decision that would halt immediate enforcement of the law. The coalition of 16 attorneys general argue in the brief that New York’s restriction is one in a long line of government regulations designed to make gun possession and use safer for the public, and is a lawful exercise of states’ regulatory and police powers to enact such a law.

California lawmakers held an oversight hearing on Tuesday to figure out how to improve the state’s Armed and Prohibited Persons System, also known as APPS, which is a program that is supposed to keep guns out of the hands of potentially dangerous people. The program has faced criticism for using antiquated systems and having the workload outweigh the manpower.

A federal judge in New Jersey on Tuesday iced a new law celebrated by liberals that would allow the state to shut down, and likely bankrupt, the firearms industry if a single gun were misused in a crime.

U.S. District Court Judge Zahid Quraishi, a Biden appointee, said that he agreed with the gun industry that the New Jersey law was likely unconstitutional and granted the National Shooting Sports Foundation a preliminary injunction.

The gun-friendly Missouri House appears to be settling on one new firearm limit: restricting minors from possessing guns in public without adult supervision. The limit was included in wide-ranging crime legislation by Rep. Lane Roberts, R-Joplin, following a recommendation by a bipartisan working group appointed by House Speaker Dean Plocher, R-Des Peres.

The original Military Armament Corporation, or MAC, was located in Georgia where it had been jointly founded in the 1970s by Mitch WerBell of Vietnam SIONICS fame and Gordon Ingram, the father of the MAC-10. Ingram went on to found a second company using his own name in the title while WerBell, dubbed by some as "The Cold War's most mysterious man," passed in the early 1980s.

The National Shooting Sports Foundation (NSSF) secured a preliminary injunction Tuesday against New Jersey’s A1765, which was intended to create avenues by which public nuisance laws could be used to sue gun manufacturers.

The NSSF filed suit in light of the Protection of Lawful Commerce in Arms Act (PLCAA), which shields gun makers from frivolous lawsuits in situations where guns which were legally made and legally sold are later stolen (or otherwise acquired) and used in crimes.

The San Francisco Sheriff's Office approved a resident's application to carry a concealed weapon, marking the first such approval since the Supreme Court's landmark Second Amendment decision last summer. On Friday, the sheriff's office approved a resident's application to carry a concealed weapon, which is known as a CCW permit. That's due to a June Supreme Court decision against states with strict gun laws forcing residents to show a "good cause" for self-defense in order to obtain permits for hidden firearms.

Speer Ammunition recently landed a French Police 9 mm duty handgun ammunition contract for Speer 124-grain Gold Dot ammo. The duty handgun contract is for up to four years with an expected quantity of 20 million rounds. The Gold Dot ammunition will be fielded by more than 250,000 people from the French National Police, National Gendarmerie, Customs Police and the Penitentiary Administration.

Sen. John Kennedy, R-La., is set to take sharp action to counter the Biden administration's new rule that tightens regulations on pistol stabilizing braces, something he says is the president's latest "assault on the Second Amendment." The rule, called Factoring Criteria for Firearms with Attached Stabilizing Braces, took effect Tuesday after it was finalized by the Bureau of Alcohol, Firearms, Tobacco and Explosives (ATF) earlier this month. It will treat any firearms with stabilizing accessories as short-barreled rifles, which require a federal license to own under the National Firearms Act.

The state of Illinois lost an appeal on Tuesday after a lower court judge issued a restraining order on a newly enacted ban on some semiautomatic rifles as well as high-capacity magazines. Illinois Governor J.B. Pritzker signed the gun control law on Jan. 10, which bans the sale and distribution of assault weapons, high capacity magazines, and switches, which went into effect immediately after he approved it.
