MD: SAF Sues in Maryland Over Handgun Permit Denial

"The Second Amendment Foundation and a Baltimore County, MD man today sued Maryland authorities in federal court because the man's handgun permit renewal was turned down on the grounds that he could not demonstrate 'a reasonable precaution against apprehended danger.'"

"The lawsuit was filed in U.S. District Court for the District of Maryland."

"Joining SAF in the lawsuit is Raymond Woollard, who was originally issued a carry permit after a man broke into his home during a family gathering in 2002. Woollard's permit was renewed in 2005, after the man was released from prison. That man now lives about three miles from Woollard. ..." ...

... "'Laws that empower bureaucrats to deny the exercise of a fundamental civil right because they cannot show good cause to exercise that right can't possibly stand up under constitutional scrutiny,' said SAF Executive Vice President Alan M. "Since freedom of the press is the foundation that American news outlets are built on, we all know that the First Amendment is sacrosanct to this country’s journalists. However, there are a few situations that test the limits of this freedom, and one of these situations has been in the news recently. Though it traditionally falls under the protections of the First Amendment, photography occupies that ambivalent space where cameras can be wielded by both journalists and private citizens with potentially harmful intent. It’s the latter group that leads to conflict between law enforcement officials and camera-toting individuals and frames the debate over security and freedom of the press in the incongruous terms of the Second Amendment." ...

What took CeaseFire so long to exploit L. Sammamish shooting?

"Eleven days is an awfully long time for the gun prohibition lobby to wait before it exploits a crime, which is what happened with Wednesday's publication of an Op-Ed piece in the Seattle Times by Washington CeaseFire's Ralph Fascitelli that calls for new gun laws in reaction to the July 17 shootout at Lake Sammamish State Park that left two men dead."

"As this column accurately predicted here, the CeaseFire president has now called for a ban on firearms in state parks (one way to erode this state's preemption law and clamp down on legal concealed carry). He is also asking the Legislature to 'make it more difficult for people to get concealed-weapons permits or to openly carry loaded weapons.'" ...

"H.R. 2296, the [BATFE] Reform and Firearms Modernization Act, represents NRA-ILA's latest effort to pass legislation that will make it easier for lawful gun owners and dealers to comply with federal law and regulations, while ensuring that those who break the law are punished accordingly." ...

"H.R. 2296 would allow fines or license suspensions for less serious violations, while still allowing license revocation for the kind of serious violations that would block an investigation or put guns in the hands of criminals. This prevents the all-too-common situations where BATFE has punished licensees for insignificant technical violations-such as improper use of abbreviations, or filing records in the wrong order." ...

HuffPo Ed: Open Carry Is A Threat, Not A Promise

"Kate Shilling, Coalition Director of the Violence Prevention Coalition of Greater LA, reckons banning open carry wouldn't violate Californians' Constitutional rights. 'Forbidding open carry does not limit your right to own or carry a gun,' Ms. Shilling writes in the Huffington Post. 'It merely regulates the way in which you carry your gun when in a public place ...' And it’s OK to ban open carry because 'When someone not in uniform carries a gun in public, they are in effect saying 'I could kill you, if I chose.' Which in turn poses an immediate threat to my own freedom of speech, freedom of action, freedom to congregate and freedom to be in public spaces. ...' Shilling then proceeds to tie herself in rhetorical knots . . ." ...

The Marines have a different IFAK, and you can find both in surplus stores, off-base pawn shops and on-line military gear stores."

... "First and foremost, prohibiting 'open carry' is not about whether you can carry a gun, but how you carry your gun. Let me repeat that, because opponents want to make this a Second Amendment issue, when the Second Amendment has nothing to do with it. "In the past two weeks, I have explained how the Supreme Court arrived at the decision that we have a right to have handguns in our homes. ... The Court used 'substantive due process' to find that a right to self-defense exists and that banning the possession of a handgun in the home is too restrictive. Substantive due process centers on the Fourteenth Amendment’s 'due process' clause ... However, the Court had another legal avenue available and possibly more readily logical, but had the Court utilized this argument 137 years of Supreme Court precedent would have been overturned. The Court could have dusted off the Privileges or Immunities Clause."
