A case on ‘ghost guns’ has gone to the U.S. Supreme Court. Ghost guns are homemade guns that are unserialized and therefore untraceable. Gun rights groups are challenging a regulation brought in under the Biden administration which says that companies selling separate components of a gun must follow the same rules as those who are selling traditional, fully constructed firearms. This includes carrying out background checks on buyers and adding serial numbers to the DIY kits.

“. . . because the trial court instructed the jury on self-defense, it would have been required to instruct the jury on second degree murder if defendant had requested such an instruction,” wrote Kathryn Zenoff with Judges Peter Cavanagh and Raylene Grischow concurring.

The ruling, handed down Tuesday, means Bakana will return to McLean County Circuit Court at some point soon and a new trial will be scheduled.

A Wapiti, Wyoming, man is trying to get the federal government’s machine gun ban overturned.

Jake DeWilde announced in a Friday court filing that he’s appealing to the 10th Circuit Court of Appeals, after U.S. District Court Judge Scott Skavdahl rejected his effort to have the nation’s ban on machine gun possession declared unconstitutional under the Second Amendment.

This was DeWilde’s second time suing the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in Wyoming’s federal courts system. He has represented himself without an attorney both times.

A federal district court has struck down part of a New York law that made it illegal to carry a firearm on private property without consent from the owner.

The ruling issued by the U.S. District Court John Sinatra Jr. effectively blocks the state from enforcing its concealed carry restrictions, saying it interferes "with the long-established Second Amendment rights of law-abiding citizens who seek to carry for self-defense on private property open to the public."

Ed.: Headline is incorrect; this is about licensed concealed carry. It is going to take a bit more work to get NY to do open carry. :-)

The owner of X and Tesla has decamped to the battleground to run a vast get-out-the-vote operation in support of Donald Trump.

And whoever wins Pennsylvania's 19 electoral college votes on November 5 will be in prime position to take the White House.

On Thursday night, Musk appealed directly to Pennsylvania voters.

In America, the struggle for voting rights has long been a fight for justice and inclusion, particularly for those who have served time in prison.

But there’s another fight that echoes the same sense of unfairness— the struggle for gun rights for felons who have completed their sentences but remain barred from owning firearms for self-defense, hunting, or even living in a household where guns are present.

The question is simple: Why is it that once someone has “paid their debt to society,” they can regain the right to vote [and pay taxes], but in most states, they still can’t own a gun?

A 24-year-old off-duty correctional deputy for the Cook County Sheriff’s Department shot at an armed robber after being confronted at gunpoint in Chicago’s West Loop early Sunday morning. The incident occurred around 1:45 a.m. on the 200 block of North Morgan Street, where the deputy was approached by an armed suspect who exited a Ford SUV and demanded the officer’s belongings.

In response, the officer drew his firearm and fired multiple shots in the direction of the assailant.

Across states, there is a wide range in the number of weapons produced. For example, Hawaii produced a mere 17 firearms in 2022, while New Hampshire managed to create 2.9 million guns, which is the greatest by far. Only four of the 50 states were responsible for manufacturing over 1 million guns. These include New Hampshire, Texas, Georgia, and Missouri.

There are 2.2 million firearms owned by 502 state entities in South Africa. Of these, an estimated 1,800 are being lost or stolen every year, entering the illicit market and finding their way into the hands of criminals.

Yet, the only state entity that reports some of its lost or stolen firearms is the police. SAPS, along with the South African National Defence Force (SANDF), own less than 30% of the total number of state-owned firearms.

In a tragic and legally complicated case out of central Arkansas, a father is now facing murder charges after discovering an older man with his missing 14-year-old daughter in a vehicle under allegedly illicit circumstances and shooting him. Aaron Spencer, 36, was arrested for the fatal shooting of 67-year-old Michael Fosler, a man who was already awaiting trial for allegedly sexually assaulting the young girl several months ago and was under a no-contact order.

An August 17 shooting in West Fargo, North Dakota, that resulted in the death of one man has been deemed self-defense by prosecutors.

According to a report at wdayradionow.com, 25-year-old Austin Strom was trying to gain access to Prairie Heights Church when he was confronted by 66-year-old Kent Hodges, who recorded the incident. The cellphone video ended when Strom attacked Hodges, according to authorities.

During a Univision town hall with undecided Latino voters that aired Wednesday night, an audience member asked Trump how he would explain his gun policy to “parents of the victims of school shootings.”

“We have a Second Amendment and a right to bear arms,” Trump said. “I’m very strongly an advocate of that. I think that if you ever tried to get rid of it, you wouldn’t be able to do it. You wouldn’t be able to take away the guns, because people need that for security, they need it for entertainment and for sport, and other things. But they also, in many cases, need it for protection.”

New Mexico Governor Michelle Lujan Grisham announced the end of an emergency public health order that banned the carrying of guns in public parks and playgrounds around the Albuquerque metropolitan area.
“I have decided to allow the public health order to expire, but our fight to protect New Mexico communities from the dangers posed by guns and illegal drugs will continue,” Lujan Grisham said.

In September 2023, Gov. Lujan Grisham issued an emergency public health order that effectively suspended the Second Amendment for American citizens who lived in the Albuquerque, New Mexico, area. She claimed that a “public health crisis” gave her the authority to suspend New Mexicans’ Second Amendment-protected rights.

Gun manufacturers and gun rights groups are set to argue in front of the U.S. Supreme Court that President Joe Biden overstepped his authority and the rule imposed on the owning and manufacturing of “ghost guns” should be tossed out.

Ghost guns are unserialized and privately-made firearms that law enforcement are increasingly finding at crime scenes, states the fact sheet from the White House fact sheet titled, “The Biden Administration Cracks Down on Ghost Guns, Ensures That ATF Has the Leadership it Needs to Enforce Our Gun Laws,” April 2022.
