MI: Open carry at DeVos Place at issue after appellate ruling

A state Court of Appeals panel said DeVos Place, including DeVos Performance Hall, could possibly ban firearms at the venue.

The attorney for gun-rights advocates said the ruling didn't necessarily mean open carry won't be allowed at the venues.

Kent County Circuit Judge Joseph Rossi earlier determined that the Grand Rapids-Kent County Convention/Arena Authority's weapons policy was unenforceable because it was contrary to state law.

The authority, known as CAA, oversees DeVos Place, the performance hall and Van Andel Arena.

ST. LOUIS – Three St. Louis police officers were indicted Thursday for allegedly beating an undercover colleague during a 2017 protest and, along with a fourth officer, conspiring to cover up the crime.

The U.S. Department of Justice announced the indictments of Officers Dustin Boone, Randy Hays, Christopher Myers and Bailey Colletta. All four are suspended without pay, the city said. The indictment follows an FBI investigation requested last year by St. Louis police.

This case of the week involves a Montana man who reportedly shot his hunting partner just as they returned from a hunt to their cars in a K-Mart parking lot, according to this ABC Fox news report.

The shooter is said to be an NRA Instructor in handgun and rifle. The victim was struck in the chest by a rifle round and died a short time later at a local hospital.

A 2013 road-rage incident that led to the death of one driver -- and three trials for the man who shot him -- resulted in a conviction that was overturned Thursday by the Arkansas Supreme Court, which sent the case back to circuit court.

In a 4-3 decision, the Supreme Court ruled that jurors in Chris Schnarr's third trial, in which he was convicted of manslaughter, were improperly barred from hearing instructions regarding Schnarr's arguments that he was justified in shooting Arista Lee "A.J." Aldridge Jr. during a confrontation in downtown Little Rock.

The National Rifle Association and its longtime insurance business partner are settling a rancorous months-long legal dispute over the fate of the troubled Carry Guard self-defense insurance program, court records show.

The NRA and insurance broker Lockton Affinity filed a joint motion on November 15 asking a federal judge in the Eastern District of Virginia to dismiss a breach-of-contract lawsuit and countersuit, which the judge accepted the next day.

The terms of the settlement are not public. In an emailed statement, the NRA said it and Lockton had filed for dismissal of the suit “while they use their best efforts to prepare a definitive settlement agreement.”

The fatal officer-involved shooting of Diante “Butchie” Yarber has been deemed justified.

The San Bernardino County District Attorney’s office released their review of the incident Thursday, saying the use-of-force by the Barstow Police Department against Yarber was a “proper exercise in self-defense.”

The DA’s review features accounts from over ten witnesses, including two of the three passengers inside the black Ford Mustang Yarber drove during the shooting. It also features details from video footage of the incident, but no footage was released.

State lawmakers have overridden a quarter of Gov. John Kasich’s 48 vetoes, and they could do more in the next two weeks. Kasich has said he’d also veto the so-called Stand Your Ground self-defense bill and the six-week abortion ban called the Heartbeat Bill that recently passed the House.

Leavenworth County will not file charges against a 74-year-old woman who shot and killed a man as he broke into her home.

The district attorney says it’s clear the shooting was self defense.

The 74-year-old woman is recovering from a heart attack she suffered right after Saturday night’s ordeal.

The family of the suspect says drugs are to blame.

Alabama law says a person is justified in using deadly physical force to defend themselves against someone if they did not provoke the attack and they believe the person is about to use unlawful deadly physical force. They are also justified in using force if they started the encounter but effectively communicated their intent to withdraw, and the other person continues or threatens to continue the use of unlawful physical force.

Sizemore said Bell started the altercation by bringing Franklin to the breezeway and pulling a gun on him, but while Bell's gun misfired, Franklin was able to pull out his weapon and fatally shoot Bell.

In Bradford’s case, Noah it said looked like “he was a good guy with a gun” who stepped in to save the day. However, “if the good guy with the gun happens to be a Black guy with a gun, they don’t get any of the benefits.”

The comic that Black folks “have no business” bearing arms unless they want to end up dead, adding, “if you’re a Black person in America, gun rights aren’t for you.”

Noah’s comments rubbed some people the wrong way and sparked a torrent of hate from online critics.

Local gun store owners have expressed their concerns with the new law passing.

Diana Pinto, owner of Pinto’s Gun Shop in Renton, said she was surprised it passed, but at the same time not surprised.

“We were all hoping that other gun owners would get out and vote against it and that could hopefully reach the people who were on the fence and explain to them that it was more than raising age, because I think that’s what a lot of people thought. It’s more than that. So yeah… surprised, but not surprised,” Pinto said.

I’m not trying to dig deeply here into the squabble involving Hopewell Registrar Yolanda Stokes and that city’s Republican Party chairman, Brandon Howard. Suffice it to say they have a beef.

I have no issue with Howard expressing his displeasure over what he says is Stokes’ failure to turn over information he says he’s legally entitled to. No problem with him protesting outside her office, wielding a sign that calls Stokes a liar and accuses her of overstepping her bounds.

What I do have a problem with is the handgun he was carrying during his protest in front of the voter registrar’s office on the Saturday before Election Day, the last day of absentee voting.

Those opposing Initiative 1639 based on the Constitution are selective in their demands. Somehow it is against the Second Amendment to deny long guns to people under the legal drinking age, but it is perfectly acceptable to deny such people access to hand guns. For that matter, they want all legal adults to have access to semiautomatic rifles but they do not demand allowing everyone access to fully automatic rifles or bazookas.

When will the NRA act consistently and begin campaigns to allow free sale of hand guns to people younger than 21?

The Violence Prevention Research Program (VPRP) at UC Davis and the Johns Hopkins Bloomberg School of Public Health conducted a study about the impact California's gun control laws have had on homicide and suicide rates over the last 10 years.

Wait for it...

Researchers found that the Golden State's gun control laws had absolutely no impact. And, even more surprising, the study's lead researcher found that the National Instant Criminal Background Check System (NICS) is severely flawed.

Remember how Shopify thought, “Wow, if we want to help the Left accomplish their mission of banning guns, all we have to do is not let people post firearm-related items on our site. After all, we’re the greatest thing since sliced bread and no one would ever think of competing with us. So we’ll effectively stop the sale of guns.”

Well, guess what, Shopify? You’re not the unconquerable behemoth you thought you were. Gearfire and AmmoReady have come to the aid of law-abiding gun owners in terms of providing them with an outlet to do exactly what you used to do. How’s that for evidence that your sanctimonious plans have failed miserably? So much for banning the online sale of guns.

Democrats were skeptical that this hardliner on illegal immigration and the Second Amendment would back down on these and other divisive issues. Republicans who watched him engineer a government shutdown months into his first term wondered how long Cruz will keep his most aggressive instincts dormant, especially in the new era of divided government.
