McKenney told police that at this point, Herbert started walking towards him "with an angry look in his eyes," saying "shoot me, shoot me."
When Herbert was approximately 4 feet from him, McKenney said the "gun went off" because he was "fearful." He said he had "no intention of hurting anyone, and it was the last thing he wanted to do."
McKenney said that to his knowledge, Herbert was unarmed. However, he said that Herbert was younger, bigger, and "had a look in his eyes," so he worried about what would happen if Herbert got his gun away from him. |

There are multiple important elections happening in Georgia this year, and some conservative leaders outside the state are doing their part to help favored candidates.
Colton Moore posted on his social media platforms that Kyle Rittenhouse has endorsed him in the upcoming House race for Georgia's 14th district.
"I don't hand out endorsements lightly, but Colton Moore has earned mine 100%," Rittenhouse wrote. "This man is a fearless protector of the Second Amendment and the right to self-defense. While others talk, Colton fights, and he fights to win." |

Police swarmed a neighborhood in Sunrise where, investigators said, a man was shot and killed in what is being investigated as an act of self-defense.
Sunrise Police and Fire Rescue units were dispatched to the scene of a reported shooting at an apartment complex located along the 7600 block of Northwest 42nd Place, off University Drive, just after 8 p.m. on Wednesday.
Upon arrival, officers found the victim. He was pronounced dead at the scene.
Police said the shooting stemmed from an argument between two men during which one of them shot the other in what detectives are investigating as self-defense. Investigators added that the men are not domestically related. |

When Pretti was killed by federal agents in Minneapolis, videos and eyewitness accounts raised serious questions about whether his constitutional rights were protected. He was lawfully in possession of a firearm, never drew it, was disarmed by law enforcement, and then shot 10 times and killed.
What should have followed was clarity and courage from our leaders, both in defending civil disobedience and in defending the Second Amendment.
Ed.: We don't defend civil disobedience--we punish it. It is a crime. The merit in it is that you are willing to *peacefully* defy minor laws, and suffer the consequences, to make a point. |

What do gun rights have to do with Utah’s gerrymandering fight? If you ask Donald Trump Jr. and Ted Nugent, everything.
The two Republican celebrities cut ads on behalf of Hunter Nation, urging Utahns to sign the repeal petition before the Feb. 15 deadline. Both sit on the board of the Kansas-based pro-hunting group.
The ads warn that gun rights are on the chopping block unless Utahns overturn Prop. 4, the law that set up an independent redistricting commission.
“By signing to repeal Proposition 4, you will be defending our hunting heritage, our Second Amendment rights, and keeping outside interests from interfering in Utah,” the ad script reads.

As has been observed by Rory Little at SCOTUSblog, the party presentation principle is on the rise at the Supreme Court. The principle stands for the simple idea that the parties control their case – what claims they bring, what defenses they raise, what arguments they make, what evidence they present – and that these choices potentially limit how courts may decide the case. The party presentation principle presents a puzzle for courts in cases that involve matters of broader public interest, like gun rights. In this month’s column, I will introduce the principle and then explore its implications for Second Amendment litigation and beyond. |

New Jersey can continue limiting who can 3D-print their own guns after the Third Circuit ruled a prominent distributor of printable firearm files failed to sufficiently make its case.
In July 2018, the New Jersey attorney general sent a cease-and-desist letter to Defense Distributed — an online organization dedicated to sharing computer code used to 3D-print firearms — threatening legal action if the organization continued publishing “printable gun computer files for use by New Jersey residents.”

She said "preponderance of the evidence is the basic civil standard of proof. And it typically is defined as more likely than not." She said "clear and convincing" is the highest standard of proof typically reserved for cases where "there is a very significant right that is at issue," such as termination of parental rights, but even that is "very unusual."
In this case, she said, the lower court judge decided that a "Second Amendment gun right" rose to that level, but "as the Rhode Island Supreme Court made clear: that is not appropriate for a protection order for several reasons, one being that the gun right that is being taken away is only temporary ... The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) backtracked Tuesday after Gun Owners of America (GOA) posted screenshots on X of the denial of an application for items covered by the National Firearms Act of 1934 (NFA).
The reconciliation bill signed into law by President Donald Trump in July 2025 contained provisions that reduced the taxes on suppressors, short-barreled rifles, short-barreled shotguns and guns described as “any other weapon” to $0. According to screenshots posted on X by GOA from legal documents filed Monday, a member of the gun-rights group requested tax stamps for a suppressor and a short-barreled Winchester 1300 shotgun, leading ATF to respond on the social media site. |

Is it illegal to carry a gun to a demonstration against ICE? According to the Trump Administration, it is. According to a story in The New York Times on February 4, “Jeanine Pirro, the U.S. attorney for the District of Columbia, on Monday threatened jail time for anyone who enters the capital with a gun.
In remarks on Fox News that could deepen a growing rift between gun owners and the Trump administration, Ms. Pirro declared that if anyone brings ‘a gun into the District, you mark my words, you’re going to jail. I don’t care if you have a license in another district and I don’t care if you’re a law-abiding gun owner somewhere else. |

Once again, innocent lives have been lost in a country with the sort of strict firearm regulations the gun prohibition lobby and anti-gun politicians advocate for here in the United States, and the Citizens Committee for the Right to Keep and Bear Arms says the tragedy in Tumbler Ridge, B.C. proves how wrong they are.

A jury deliberated a little over an hour in Mahoning County Common Pleas Court before returning not guilty verdicts Wednesday on all three charges brought against Robyn E. Johnson, 29, of Boardman.
The verdict was reached Wednesday afternoon in the trial, which lasted almost three days. Johnson was facing charges of discharging a firearm on or near prohibited premises and two counts of felonious assault, all with gun specifications, for a 2023 incident in Youngstown.
Johnson was accused of firing a gun into a car containing the victim and a man, hitting the victim, Sheala Perkins, in the shoulder. |

A top-ranking Nebraska legislative committee unanimously advanced a bill Wednesday to prohibit most weapons and self-defense items in the Nebraska State Capitol beginning next year.
The Executive Board, which oversees day-to-day operations of the legislative branch, voted 9-0 to advance an amended version of Legislative Bill 1237 to the full Legislature. The bill, sponsored by each of the committee members, would specify prohibited weapons and substances without prior approval, including firearms, pepper spray, explosives and spray paint.

The Citizens Committee for the Right to Keep and Bear Arms is applauding lawmakers in the New Hampshire House for approving legislation allowing carry on college campuses by prohibiting colleges and universities from banning guns.
CCRKBA Chairman Alan Gottlieb took issue with opponents of the measure who have cited tragic campus shootings, such as the one at Brown University, as a good reason to prevent students or visitors from carrying defensive sidearms for their personal safety.
