The Ninth Circuit denied rehearing in our lawsuit challenging California's switchblade ban on Second Amendment grounds. While disappointing, the denial was not a surprise. However, the order denying rehearing was accompanied by two scathing dissents that take the Ninth to task over their lack of respect for the Second Amendment and U.S. Supreme Court precedence. Together, they are a win of sorts for going forward with this case.

On Friday, in a decision written by a Joe Biden nominee, the U.S. Court of Appeals for the 3rd Circuit ruled that New Jersey's ban on semi-automatic rifles that legislators describe as "assault firearms" violates the Second Amendment. The appeals court reached the same conclusion regarding New Jersey's ban on "large capacity magazines" (LCMs), currently defined as those capable of holding more than 10 rounds.

On the very same day Patrick Tate Adamiak arrived at the Western Tidewater Regional Jail in Suffolk, Virginia, two guards pepper-sprayed an inmate for little or no reason, rammed his head into a metal door, and then dragged him through the jail until his neck and hand were broken.
