No charges will be filed in the father-son shooting incident in Warren County on June 24.

“There was an altercation between family members. The shooter indicated he had obtained a weapon for purposes of self-defense, the shots he fired were warning shots, and were not fired intentionally to harm anyone. In a situation where people are acting quickly, the son was hit,” explained District Attorney Ricky Smith. “That was another factor, that the shooter did not intentionally mean to shoot anyone. Shots were fired in more of a warning pattern than anything. So all those factors led us to believe it should be remanded.”

Recently, Governor Jeff Landry of Louisiana signed House Bill 407 into law. This legislation repeals residency restrictions and broadens access to the right to bear arms in the state. The bill was a legislative response to Mate v. Westcott. In early 2024, Louisiana enacted its version of constitutional carry, allowing “law-abiding persons 18 years of age and not otherwise prohibited” to carry a handgun in public without a permit. However, the nature of the law and current federal regulations require Louisiana residents to apply for and obtain a carry license issued by the state to exercise their carry rights fully.

As "We the People" celebrate the birth of our nation on the Fourth of July, let us recall and also celebrate our July 6, 1775, "Declaration on the Causes and Necessity of Taking Up Arms." (Ed.: linked in article text.)

My last article focused on the First Amendment Establishment Clause: "Wartime Religious Symbols 'Don’t Offend the Constitution'."

As the first two of the original 12 articles were not ratified in 1791 along with the final 10 Articles, "Article the fourth" of the original Bill of Rights became the Second Amendment:

Patrick “Tate” Adamiak said Monday he was incredibly touched and extremely grateful for the petition drive and rally held Saturday just miles from his federal prison in New Jersey.

“I am ecstatic that people I don’t even know came together to support me,” Adamiak said Monday. “It means the world to me that people were rallying behind me and giving me a voice as to what happened to me. I spoke with the mayor, Daniel Francisco, who said he is out there fighting for me, which really made me feel good too.”

Last Friday, everyone rose up in arms when Elizabeth MacDonough, the Senate parliamentarian, yanked the Hearing Protection Act and the SHORT Act from the Big Beautiful Bill. MacDonough announced the proposed laws exceeded the limitations of the Byrd rule and couldn’t be included.

MacDonough said removal of suppressors, short-barreled rifles, short-barreled shotguns and AOWs was policy and would have to be passed by the usual channels, facing a Senate filibuster without the 60 votes needed to overcome it.

The Trump Administration has begun restructuring the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) with the help of Department of Justice employees, in an effort to dial back gun restrictions, according to NPR.

DOGE officials have been working with the ATF to modify approximately 50 regulations, including ensuring that a background check remains valid for 60 days rather than only 30, and allowing federally licensed firearm dealers to destroy records after 20 years, rather than retaining them indefinitely.

Benjamin Crump, a prominent civil rights attorney, highlights the disparities in self-defense laws affecting African Americans, specifically referencing the cases of Breonna Taylor and Ahmaud Arbery. He points out how Kenneth Walker, Taylor’s boyfriend, faced charges for firing a weapon during a botched police raid, while the alleged killers of Arbery were initially treated with leniency after pursuing and shooting him while he jogged unarmed.

A federal court in California has ruled that the state’s prohibition on nonresidents applying for concealed carry weapons (CCW) licenses violates the Second and Fourteenth Amendments of the U.S. Constitution. The decision, issued today by the United States District Court for the Southern District of California, grants summary judgment to the plaintiffs, paving the way for non-Californians to seek CCW permits within the state.

The case, Christopher J. Hoffman, et al. v. Rob Bonta, centered on a challenge to California Penal Code sections that impose a residency requirement for standard two-year CCW licenses and limit 90-day licenses to those with a principal place of business or employment within the jurisdiction.

A federal judge on Tuesday struck down California’s ban on non-residents carrying firearms. This ruling is a significant blow against the state’s effort to curb gun ownership.

The ruling is a result of a lawsuit filed by the Firearms Policy Coalition (FPC). The lawsuit contended that the ban was unconstitutional, and US District Court Judge Cathy Ann Bencivengo agreed.

California’s laws prohibited non-residents from applying for a concealed carry permit, meaning they could not lawfully carry firearms in the state.

A District Court judge ruled on Tuesday that California should allow non-residents to apply for concealed carry weapons (CCWs) licenses.

Cathy Ann Bencivengo, a U.S. District Court judge for the Southern District of California, issued an order which granted summary judgment after finding the state’s “provisions barring nonresidents from applying for CCW licenses violate the Constitution.” The plaintiffs in the case, who are not California residents, complained that they have been prohibited from carrying a firearm for self-defense when they visit the state, according to Bencivengo’s order.

A student at Eastern Maine Community College says an opinion paper on the Second Amendment she wrote for a class was met with pushback from a professor who wrote in an email, "you clearly do not care about people as much as you care about guns."

"Her response was very unprofessional and discriminatory," EMCC student Katherine Parker said. "If you cannot grade a student's paper because you are so offended by her topic, then I don't believe you should be teaching a college level class."

The right to keep and bear arms is a right protected by the Second Amendment. Yet, California law prohibits residents of other states from carrying firearms when visiting the state, either openly or concealed. Despite California having a concealed carry permit system in place, non-residents are prohibited from applying. This is clearly unconstitutional under binding Supreme Court precedent, the Firearms Policy Coalition wrote in April.

Tuesday afternoon, Federal District Court Judge Cathy Ann Bencivengo issued an order granting final summary judgment to Firearms Policy Coalition (FPC) and its co-plaintiffs, three individual members of the organization who reside outside of California, in Hoffman v. Bonta, FPC’s Second Amendment challenge to the State’s ban on firearm carry by non-residents.

“This important judgment means that people must maintain their Second Amendment right to keep and bear arms when they cross California’s border. Just as people are free to speak or worship in states they don’t reside in, this win makes clear they are likewise free to bear arms for lawful purposes throughout the United States,” explained FPC President Brandon Combs.

Ohio State Representative Tex Fischer has re-filed the Second Amendment Preservation Act, known as House Bill 382, seeking to restrict law enforcement cooperation with federal authorities regarding firearms regulations. The bill is rooted in the Tenth Amendment’s anti-commandeering doctrine, which the United States Supreme Court has interpreted to mean that the federal government cannot force states to enact or enforce federal laws. Of course, the bill is not without the usual leftist opposition, who make every argument they can muster to justify subversion of the Constitution while lobbying to levy further infringements upon American gun rights and those who exercise them.

Rep. Andrew Clyde of Georgia — a gun shop owner, election denier, and insurrection defender who rode to Congress on his opposition to covid-era public health measures — believes in freedom. Or one kind of freedom, anyway: the freedom to buy and sell guns and gun accessories of all kinds with the least regulation and taxation possible.

To that end, he persuaded his colleagues to include in their enormous budget bill a provision repealing part of the National Firearms Act, which requires those who purchase a silencer to pay a $200 tax and register their device with the Bureau of Alcohol, Tobacco, and Firearms (ATF).

A Kansas City woman who was shot while driving a city bus in 2020 filed a lawsuit this week against a Jackson County gun seller, alleging the business played a role in supplying the gun used in the shooting. DeBorah Luster filed the suit in Jackson County Circuit Court against CR Sales Firearms LLC on Tuesday. The suit claims the firearms dealer negligently sold guns to James Samuels, a former Kansas City Fire Department Captain who was sentenced to six years in prison in 2021 for trafficking dozens of guns.

Bills meant to reform and direct more money to the state’s criminal justice system had some major wins and some major losses during the 2025 Legislative Session. Much needed funding for public defense lawyers, new gun control measures and new civil liberties protections overcame budgetary challenges and some strong opposition, while efforts to ensure financial compensation for victims of crime, and those who say they’ve been wrongfully incarcerated, remain in limbo.
