"The District of Columbia's gun ban has claimed another victim, and this time a veteran newsman has died, all because criminals know citizens in the nation's capitol cannot fight back ..."

"'Our hearts and prayers go out to the family of veteran New York Times reporter and editor David E. Rosenbaum, who died Sunday from injuries he suffered during a brutal robbery Friday night near his home in northwest Washington, D.C.,' said CCRKBA Chairman Alan M. Gottlieb ... 'We cannot know whether Mr. Rosenbaum would ever have kept a gun for personal protection, but we do know that every law-abiding citizen now living in the District can't. And we also know that for years, criminals have taken advantage of this environment of public disarmament ...'"

"'You'll get it, don't worry. You need to learn how to shoot this,' my mother said, patting my head. 'You never know how you might need it someday.'"

"She was right. I did learn how to shoot, and I did need a gun someday ... several somedays. And I came to respect the way a gun could save my life."

"I also came to hate guns for the ways they have just as easily, just as coldly, unthinkingly, devastated life around me and come close to ending my own life time and again." ...

"Judge Samuel A. Alito's judicial views pose serious dangers to the safety of our communities, our families, and our children, as evidenced by his troubling dissent in U.S. v. Rybar, 103 F.3d 273 (3rd Cir. 1996). For this reason, the Brady Center to Prevent Gun Violence announced its opposition to Judge Alito's nomination to the United States Supreme Court last month. (It is the first time in its history that the Brady Center has opposed a Supreme Court nomination.)"

"In the Rybar case, Judge Alito concluded that the federal machine gun ban is an unconstitutional exercise of Congressional power under the Commerce Clause. Alito attempted to erect arbitrary hurdles to Congressional efforts to reduce the availability of machine guns to the criminal element. ..." ...

KABA Note: In the Rybar ruling Judge Alito applied the then current Supreme Court precedent regarding the commerce clause.

"The Control Arms Campaign, an organisation fighting arms proliferation has called on UN member states to govern the sale of weapons which have led to bloody conflicts across the world. This comes ahead of a UN meeting this week to prepare the ground for a conference on small arms controls in June. Control Arms Campaign argues that existing arms controls are powerless to protect innocent civilians. There is no international agreement governing the transfer of arms."

"'In 2006, the world has a choice. Either it continues to ignore the massive human cost of arms proliferation or it finally acts to control the arms trade,' says Colin Roche, Advocacy Executive of Oxfam Ireland." ...

"Since its adoption in 2001, an international action plan to counter illegal gun trafficking had caused unprecedented government activity in the fight against the scourge, but the weapons continued to cause human misery, destabilize States and squelch development, the top United Nations disarmament official said today as he opened a planning meeting for a review of progress on the issue."

"'The problem is a long-term one,' Nobuyasu Abe, the Under-Secretary-General for Disarmament Affairs, said at the start of the preparatory session for the Review Conference to Eradicate the Illicit Trade in Small Arms and Light Weapons, which will be held in New York from 26 June to 7 July 2006." ...

... "Christou is facing a criminal charge of first-degree aggravated assault after shooting an intruder who was breaking into the Funky Buddha at 4 a.m."

"Though particulars in this case could still come to light, Christou's situation sparks a couple of questions about the limited scope of Colorado's 'make my day' law."

"In 1985, Colorado passed the Homeowners Protection Act, which provided legal protection to homeowners and residents who felt that a person was threatening them. It allows homeowners, in essence, to shoot intruders."

"For some strange reason, the law does not specifically extend this fundamental right of self-defense to business owners. And that's not the only problem inherent in the law." ...

"A move is afoot in the state Legislature to make it easier for people to shoot an attacker, even though Alaska's self-defense law is already quite liberal." ...

"State Reps. John Coghill Jr. and Carl Gatto think these standards for self-defense are too restrictive. They have pre-filed separate but identical bills to drastically expand the 'castle' rule. If a potential attacker confronts you anywhere you have a legal right to be, you don't even have to think about safely retreating. For good measure, their bills also virtually eliminate the retreat rule in any other self-defense situation. Unless you know 'to a certainty' you can retreat safely, you are free to fire away in self-defense." ...

"California's senior senator just repeated all the left's cliches about Alito, in the hearing today: pro-machine gun opinions, Roe as a synonym for abortion and privacy rights, Alito must mirror O'Connor, affirmative action, reapportionment ('one man, one vote'), and the 'fifth vote.' Of course, it is virtually impossible that Alito could make any difference at all on Roe, since there are now at most only three other anti-Roe votes on the Court."

"Now of course the left is using Bush's defense of the country as a cudgel against any expansive views of executive power the nominee may hold. These are of course affirmations of elected authority (which Feinstein raised as well, though on behalf of dubiously expansive readings of the commerce clause)." ...

"'Your dissent argued that Congress lacked the authority to ban the possession and transfer of machine guns based essentially on a technicality that congressional findings from previous statutes were not explicitly incorporated in the legislation.' [Note: Actually, Judge Alito said only that Congress could not ban mere possession of firearms, not transfer.]"

It's a bad situation that could have turned out a lot worse: a prisoner at the Brunswick County jail had a gun.

Not only did he have the gun but it was loaded.

Sheriff Ron Hewitt says the man could have hidden the gun in his baggy clothes. The sheriff says the man was never in with the general jail population; rather he was in a holding cell.

Sheriff Hewitt says the man was given a sandwich and tried to hide the gun between the bread. He then threw the sandwich away and that's when officers found the gun.

Sheriff Hewitt says this is just human error. He says this needs to serve as a wake up call for officers to remember just how dangerous their job is.

 QUOTES TO REMEMBER
Thanks to the government’s past record, it is unfortunately very predictable that, in spite of the severe penalties mandated, tens of thousands of people will not comply at all (with Bill C-68). A new class of criminal will be created among harmless citizens whose previous lawbreaking may have resulted in nothing more than parking tickets. — Lee Morrison, Canadian Mounted Police
