MI: Public defenders wants CCW cases dismissed in Wayne County

One of the largest public defender offices in Wayne County today called for prosecutor Kym Worthy to drop all cases against those accused of carrying a concealed weapon.
“We shouldn’t let these kinds of cases, which do not make us any safer, clog up our legal system,” said Chanta Parker, managing director of Neighborhood Defender Services, or NDS, of Detroit.
As 7 Action News reported Monday, the number of people charged with just carrying a concealed weapon in Wayne County has exploded since the pandemic. NDS reports that 70% of its clients charged with the crime legally own their weapon and, citing internal statistics, said 97% are black.

Under state law, the crime of harassment involves striking a person with an intent to harass, annoy or alarm. By a 6-1 decision, the justices indicated there was evidence to suggest that Thomas Pearson hit Timothy O'Kelly only to alarm him into backing down, which could qualify as self-defense.
"So, can a person intend to alarm someone in self-defense? At first blush, the concept seems implausible, if not downright nonsensical," wrote Justice Maria E. Berkenkotter for the court's majority. "However, upon closer examination, we cannot conclude that the two concepts are always, in every circumstance, mutually exclusive." |

The two vehicles pulled over into a parking lot. The man in the Prius confronted Kuczwanski but then got back into his car to wait for the police to arrive. What happened or what was said during this confrontation isn’t known at this point.
According to sources, Kuczwanski then rammed his BMW into the Prius’ driver door and started pushing the car sideways. He then shot at the Prius, which is when the Prius driver drew his own firearm and fired back. Kuczwanski was hit and killed by the gunfire. |

A Missouri prosecutor said Wednesday that he will not charge a white man for killing a Black neighbor, agreeing with the finding of a coroner's inquest that the shooting was justifiable self-defense.
Crawford County Prosecuting Attorney David S. Smith also provided a statement offering a lengthy explanation of the events that led to the shooting death of Justin King on Nov. 3. King, 28, was killed by a neighbor in a trailer park in Bourbon, Missouri, a town of 1,600 residents about 75 miles (120 kilometers) southwest of St. Louis. |

Americans legally bought more than 18.5 million firearms in 2021, down just slightly from 2020’s unprecedented surge in gun sales but still the second-highest year for sales on record.
The available data seems to confirm that millions of these sales were to first-time gun owners, and that the gun-owning community is becoming increasingly diverse demographically.

A bill recently passed in the 87th Texas legislative session, HB No. 1069, will allow first responders in Texas to carry a handgun while on duty. The bill provides details on requirements including training, $1 million liability insurance and approved storage devices for responders and agencies.
HB No. 1069 was signed into law and became effective on Sept. 1, 2021. The bill was authored by Cody Harris (R), who serves in the Texas House of Representatives. The bill pertains to “first responders,” defined as a public safety employee whose duties include responding rapidly to an emergency. This applies to fire protection personnel and EMS personnel. The term does not include volunteer emergency services personnel or peace officers. |

Multiple attempts to change a new gun law have failed, but now there’s another push from dozens of Missouri police chiefs.
Two groups that represent nearly 60 Missouri police chiefs want to make changes to the Second Amendment Preservation Act. The bill blocks local law enforcement from implementing federal gun laws. Law enforcement agencies have been raising concerns since the law was introduced last year.
“I understand what the purpose of the statute is. We just need clarification and try to fix some things in the language,” said Blue Springs Police Chief Bob Muenz, president of Missouri Police Chiefs Association. |

As an example of gun control legislation he opposes, Carra mentioned a recently introduced package, House Bills 5628 and 5629, which would prohibit the sale of magazines that can contain more than 10 rounds. Anyone already in possession of such a magazine would not be allowed to keep it until it is reported to local law enforcement. The bills have been referred to the House Committee on Military, Veterans and Homeland Security. |

State Rep. Sean Roberts, R-Hominy, has announced Tuesday he intends to file a resolution that would send a constitutional amendment to a vote of the people. Roberts said the language is in need of an update.
“It is imperative that we reinforce the right to bear arms outlined in our constitution in order to protect that right from state court rulings that have tried to weaken it,” Roberts said statement. The resolution Roberts proposes would prohibit registration or “special taxation” on acquiring or transferring ownership of firearms, ammunition or components of firearms. |

Indiana offers its citizens a lifetime handgun carry license. Until June of 2021, the application fee for a lifetime handgun license was $125. However, on July 1, 2021, the application fee was eliminated, and Indiana citizens may now obtain a lifetime handgun license free of charge.
Recently, the Indiana legislature has taken another step in its efforts to increase access to self-defense with House Bill 1077. HB 1077 would repeal the handgun licensing requirements and allow law-abiding citizens, 18 years and older, to carry a handgun without a license. HB 1077 passed in the House of Representatives on Jan. 11 with a 63-29 vote and now heads to the Senate for deliberation. |

Will Fite, legislative director of Hoosier Gun Rights, said he met with Sen. Liz Brown, R-Fort Wayne, the chairwoman of the Senate Judiciary Committee on Monday. Brown had declined to hold a hearing on last year's constitutional carry bill, preventing it from being considered by the Senate. But this year, she has authored her own constitutional carry bill, along with Sen. Jim Tomes, R-Wadesville, and Sen. Blake Doriot, R-Goshen.
“I can tell you that she was not overly friendly toward this issue,” said Fite, who went described Brown as seeming “openly hostile” to constitutional carry legislation during Monday's meeting.

With the council’s unanimous approval after little discussion, this East Contra Costa County city’s new ordinance will require gun owners to keep their firearms in a locked container when not in use or in their control, or disable them with a safety device.
“What this provides is for a safe storage ordinance for the city, which would require a storage of firearms by individuals who have them present in the home,” City Attorney Thomas Smith said at Tuesday’s council meeting. “It does not apply to individuals who would be carrying them with a carrying permit.” |

House Bill 1077 allows any law-abiding adult who is legally eligible to obtain a carry permit, to carry a handgun without first having to obtain government permission. This ensures that citizens have their right to self-defense without government red tape or delays. It does not affect previously issued carry permits, and allows citizens who still wish to obtain a permit in order to carry in other states recognizing Indiana permits, to do so. |

Personalized smart guns, which can be fired only by verified users, may become available to Americans after more than two decades of questions about reliability and concerns about potential government regulation.
This kind of gun has been promised for years and it has the potential for a big industry shakeup, particularly in the states with tighter gun laws that might only support smart guns.
