"District Judge Reggie B. Walton last night dismissed a National Rifle Association (NRA)-backed lawsuit challenging the constitutionality on Second Amendment grounds of Washington, DC's ban on the sale and possession of handguns. Judge Walton's 68-page ruling in Seegars v. Ashcroft upholds the ban, which was adopted by the City Council in 1976."

"In his opinion, Judge Walton, who was appointed to the federal bench by President George W. Bush, wrote: '[T]he Court must conclude that the Second Amendment does not confer an individual right to possess firearms. Rather, the Amendment's objective is to ensure the vitality of state militias.' " ...

"The constitutional right to bear arms doesn't apply to the District of Columbia's residents, a federal judge ruled yesterday in rejecting the claim of several city residents who contended that a 1976 city law banning the possession of guns left them unfairly vulnerable."

"U.S. District Judge Reggie B. Walton said he dismissed the lawsuit, led by taxicab commissioner and activist Sandra Seegars, after determining that the District was a 'uniquely designed governmental entity' and that the founders were not considering the city when they wrote the Constitution's Second Amendment allowing state militias to take up arms against the federal government."

-------
If Washington DC is in America, US law applies to the citizens of that city. US law happens to be the Constitution.

Maybe this tyrannical dolt should have been tested on the definition of "militia" before he's allowed on the federal bench.

WASHINGTON ó "A federal judge on Wednesday upheld the District of Columbia's gun control law that prohibits ownership of handguns, rejecting a legal challenge by a group of citizens backed by the National Rifle Association (search)."

"U.S. District Judge Reggie B. Walton [a G.W. Bush appointtee] dismissed the lawsuit in which the plaintiffs argued that the 28-year-old law violated their Second Amendment (search) right to own guns. The D.C. law prohibits ownership or possession of handguns and requires that others, such as shotguns, be kept unloaded, disassembled or equipped with trigger locks."

"Walton ruled that the Second Amendment is not a broad-based right of gun ownership." ...

FULL TEXT BELOW:

TUCSON - The leader of a citizens' border patrol group was found guilty of two misdemeanors for carrying a firearm while on national forest property.

U.S. District Court Magistrate Judge Nancy Fiora ruled Wednesday that Chris Simcox was guilty of knowingly entering the Coronado National Memorial with a weapon and giving false information to a law enforcement official.

Simcox was arrested in January 2003 amid allegations that he walked onto the property while carrying a firearm.

Simcox is founder of Civil Homeland Defense, a Tucson-based citizens border patrol group.

Simcox, who said he's not guilty because he was in an area that was not marked by any sign, will appeal the ruling.

Sentencing on the misdemeanors, which carry penalties ranging from probation to eight months behind bars, is scheduled for March 23.

"The incident, which might otherwise have faded from memory after one or two news cycles, has brought the ordinance into sharp focus, both among outraged gun rights groups across the nation and those who say the ban has helped make Wilmette safer." ...

"Carpenter said he ...hopes to seize the opportunity to remind people about the ordinance and the best ways to handle themselves during a break-in."

-------
According to this hoplophobic ignoramus, the best way to handle yourself during a break-in is to cower in a corner while invaders ransack your home and threaten your family, hoping and praying that the criminals won't beat, rape or kill you and your family while you wait for the police.

"Wilmette resident Jim Szczepanik, 51, was one of many gun-rights advocates who argued no homeowner should be punished for defending his family."

" 'My Plan A is to call 911 and keep the family upstairs,' he said, according to the Chicago paper. 'But my Plan B is to have a loaded firearm and put a bullet in the intruder.'

"Another resident, Ralf Seiffe, called it 'a matter of freedom.' " ...

"The right to self-defense is the right that all creatures on this Earth have, including Wilmette... What they do is they make the citizens in these villages and towns fair game."

"Why would inhabitants of two large urban areas outlaw handguns, the best home-defense firearms? It can't be for tactical reasons." ...

"No, in both cases the laws banning handgun ownership are rooted in prejudice. In New York that prejudice took the form of the Sullivan Law of 1911, originally directed against southern-European immigrants. Wilmette's gun-ban ordinance was enacted in 1989 after a deranged woman shot several children in a local school. The townspeople apparently believe handguns are the tools of criminals or the mentally unbalanced, evil instruments that right-thinking people have no need for."

"The ink is barely dry on the Supreme Court's devastating decision in McConnell v. FEC -- the so-called campaign finance case that GOA was involved in. That decision severely restricted broadcast communications, thus making it more difficult for GOA to hold legislators accountable on Second Amendment issues."

"Now, the IRS is already leaping forward to expand the Court's ruling to include GOA newsletters, e-mail alerts, and other Second Amendment communications."

"Put out for comment on December 23, 2003 -- when, presumably, no one would notice -- proposed IRS Revenue Ruling 2004-6 creates a broad new set of ambiguous standards which groups like GOA must follow in order to avoid losing all or part of their tax-exempt status."

"Under the proposed Revenue Ruling, the IRS would create a vague 'balancing test' to determine whether GOA communications would be 'permitted' by the government."

"If the communication occurred close to an election, mentioned an officeholder who was running for reelection, and was targeted to put pressure on congressmen through constituents in each representative's district, all of these factors would push toward outlawing the communication."

-------
We knew it was only a matter of time before the government started using this nefarious legislation to limit gun rights. Now, if the petty tyrants want to foist some other odious legislation upon an unsuspecting populace, they can just ensure they do it close to election time.

This solution is simply for enough people to stop using money, and start becoming more self-sufficient. The government can't take what you ain't got, and you get to keep more of the fruits of your labor. The key to this solution is for enough people to refuse to participate in the Oligarchy."

"The net result of concealed-carry is that some innocent person will be smoked by someone because of fear, mistaken intent or whatever reason at some point. It's a lock. You can call, e-mail and scream all you want, but in every single concealed-carry community in this country, it's happened."

-------
And how many lives have been saved by someone carrying concealed weapon? Would you disarm innocent people and prevent them from defending their lives or the lives of their loved ones?

A recent study reveals that the vast majority of criminals avoid victims who MAY be armed. Concealed carry saves lives.
