"Folks,"

"For those of us who have been in this for a while, the present situation of the ATF -- an agency riven with dissension, about to have their congenital dysfunction and lawlessness exposed to the world (and, worse for them, Congress) -- has a familiarity that is disconcerting."

"The last time ATF was in this position, they raided a religious commune in Texas to 'retrieve their reputation.'"

"So, as much as I thoroughly enjoy watching the cannibalism currently going on within the agency, it is important to remember that cannibals have been known to eat outside the tribe as well as within." ...

Safer Streets 2010: Do we have a real right to 'bear arms'?

"In a word, Yes."

"The idea was straightforward. 130 years before a national guard was even contemplated, and several generations before an organized police force emerged, the militia was the force which protected every farm and family. The beauty of the militia then and now was and is that the person who had the most to lose, the farmer and private land owner, had at hand a weapon which was battery ready. This was because there simply was no one else. Today, there is also no one else." ...

The NRA Wins Its Argument Time on McDonald

"All those nervous about the radical and expansive arguments to incorporate the Second Amendment on states and localities through the long-moribund Privileges or Immunities Clause of the 14th Amendment that Alan Gura will be making before the Supreme Court in the upcoming McDonald v. Chicago case can relax a little."

"The NRA, who wants to argue a more traditional 'incorporation through the due process clause of the 14th Amendment' argument will get a chunk of the oral argument time, although it is not their case." ...

NRA Cares More about NRA Than Gun Rights, Liberty, Professional Courtesy

Supreme Court granted the NRA's motion for divided argument in McDonald v. Chicago. What this means is that Alan Gura’s 30 minutes of argument time on behalf of Chicagoland gun owners just became 20, with 10 going to former Solicitor General Paul Clement, whom the NRA hired at the last minute to pursue this motion and argument. ..."

"The NRA's motion was premised on the idea that Alan had not fully presented the substantive due process argument for selective incorporation of the Second Amendment ... This is a highly unusual argument and is a facial slap at Alan's abilities as an advocate. Sadly, it's also typical of how the NRA has behaved throughout this case and before that during the Heller litigation ..." ...

Do gun free zones attract terrorists? - Part II

"Yesterday we took a look at the effect gun free zones can have on the target selection process by terrorists, whether foreign or domestic. Since the goal of such an attack is to cause as much death and destruction as possible, it is logical that a location where civilians are prohibited from owning firearms would be a more attractive target. Examples of terrorist attacks and shooting sprees halted by armed citizens, whether law enforcement or otherwise, support this hypothesis." ...

"More than 300 Washington gun owners descended on the John A. Cherberg Building in Olympia Tuesday morning for a hearing on SB 6396, the so-called 'assault weapons' ban legislation sponsored by Senate Judiciary Chairman Adam Kline."

"Opponents of the bill vastly outnumbered its supporters, and for many in the audience who had traveled several hours to reach the capitol, it was disappointing that Kline allowed only 30 minutes for the hearing, and only a handful of speakers – evenly divided between pro and con – were allowed to speak. The crowd spilled out into the hallway, and at least a couple of auxiliary hearing rooms were jammed." ...

SHOT Show, Day Five

"The SHOT Show – 4 days for attendees, 5 days for media, who get in a day early to debrief gun engineers and test some of the new firearms on various ranges in the host city – is over, and no one who attended is complaining. On the shuttle bus back to the hotels, almost everyone spoke of exhaustion. The 'miles of aisles' of concrete floors are not conducive to the physical comfort of graying gun guys and gals. It ended today, Friday, an hour and a half earlier than the rest of the week. When they dimmed the lights to signal that 4 PM had tolled, a cheer went up through the vast convention center." ...

IN: Don't dictate to companies what to do about guns

"We have been generally supportive of most legislation spelling out gun rights, whether it's the simple right to own a gun or something a little more advanced such as the ability to carry a concealed weapon or the need to let people defend themselves and their homes through 'castle laws.' The Second Amendment is just as important as any of the other components of the Bill of Rights."

"But the General Assembly is considering a proposal, being pushed by the National Rifle Association, that ought to give even the staunchest gun-rights proponents pause. It would prohibit companies from banning guns in people's locked cars at work." ...

"It was just a few years ago that Buckeye Firearms Association, along with support from the NRA, led the effort to obtain the ability for concealed handgun license holders to carry concealed while hunting. Working with the law enforcement side of the Division of Wildlife and with a major effort at the spring open house events by Buckeye Firearms supporters and volunteers, we were able to accomplish the goal without additional legislation."

"A recent story from Ohio Outdoor News, entitled 'Rabbit hunters stumble onto massive marijuana grow,' provides yet another example of why this right is so important." ...

"Sen. Adam Kline's quest to ban so-called assault pistols and rifles ran into a human wall of opposition this morning during a hearing in his committee, despite the heart-felt concerns of a woman whose son was killed by a teen who used such a gun."

"Gun-rights activists were outraged, packing the Senate Judiciary Committee hearing on Senate Bill 6396 (by a show of hands nine in 10 people opposed the bill). Some laughed in derision when the bill sponsor, Democratic Sen. Adam Kline of Seattle, said an assault gun has 'characteristics that make it more lethal than your ordinary deer rifle.'" ...

"Recently introduced bills in the Ohio House of Representatives and Senate could threaten the future of deer hunting in Ohio."

"The measures, House Bill 410, sponsored by Representative Mark D. Okey (D- Carrollton), and Senate Bill 225, sponsored by Senator Mark Wagoner (R- Toledo), move oversight and regulation of captive deer breeders and deer hunting facilities from the Ohio Division of Wildlife and place them under the control of the Ohio Department of Agriculture. A move that is not only unnecessary but could prove to be devastating to Ohio's deer herd." ...

"The Indiana state senate, in a commanding, 41-9 vote, decided Monday to protect employees' right to store firearms in their locked vehicles. The bill, SB 25, would prevent empoyers (with a few exceptions) from prohibiting workers from keeping firearms locked in their vehicles parked on company parking lots."
"The bill's sponsor, Sen. Johnny Nugent, R-Lawrenceburg, told his colleagues on the Senate floor that people should be able to keep legally permitted firearms in their vehicles so they can go hunting before or after work, or defend themselves if needed on the way to or from their jobs. It would not prevent employers from banning guns inside the workplace." ...

"Lawmakers in the Indiana House passed a bill today to protect the privacy of gun owners who have concealed weapon permits."

"The bill, written by Rep. Peggy Welch, D-Bloomington, forbids state police from releasing the names, home addresses and other identifying information about permit holders. Current law allows public access to that information."

"'I do not know that this bill is as much First Amendment versus Second Amendment as it is privacy versus public access,' Welch said. 'People feel pretty strongly that this is personal information,' she said." ...

... "The litany: Drugs, alleged prostitution, a fallen lawyer, murder threats, jailhouse snitches and one huge legal ethics question."

"It's all playing out in, of all places, Omaha, Nebraska. The backstory: About three weeks ago, the Omaha World-Herald reported a riveting story involving an Omaha lawyer down on his luck who ultimately agreed to wear a wire for the U.S. attorney’s office in Nebraska. The lawyer, Terry Haddock, then taped incriminating statements made a local inmate, the alleged ringleader of a huge marijuana conspiracy."

"You read that right. A lawyer agreed to wear a wire and record statements made by an inmate. Defense lawyers are now, not surprisingly, moving to suppress the evidence." ...

"Most people would think that three large men supposedly trained to deal with emergencies could find some way other than gunplay to deal with the 'threat' posed by a 62-year-old man armed with a baseball bat. The lethal police shooting of Peoria, Arizona resident Richard Allen Dodds last night (January 25) suggests otherwise." ...

"... What would likely happen if three ordinary citizens shot and killed a sexagenarian who threatened them with a baseball bat? Would the police ... shrug their shoulders and let the matter drop? Would the local prosecutor accept the self-defense claim without protest?"

"Two recent cases underscore the fact that the use of disproportionate lethal force is considered the special privilege of the punitive caste." ...

"A retired Minneapolis Park Police captain already accused of sexually abusing a boy, is now charged with possessing child pornography."

"At a bail hearing Monday, prosecutors added a count of possession of pornographic work involving a child to two counts of criminal sexual conduct against William Jacobs, 66, of Deephaven."

"Jacobs was initially charged last week after a 15-year-old boy accused him of sexual assault."

"The complaint said the abuse lasted for three years and escalated to sex." ...

"The notice posted in the window of the Peet's Coffee & Tea seemed out of place. It was from the Peet's corporate office letting the public know about a policy that prohibits customers from carrying firearms. A closer look, however, uncovered a bigger issue and a movement. There are pro-gun groups encouraging Americans to come out of the closet and exercise your right to carry a firearm."

"Open Carry Dot Org is becoming a force in this drive; it's even influencing lawmaking all over the country. 'An armed society is a polite society' says Walter Stanley, an Open Carry advocate. But Stanley and a group of his believers walked into a Peet's in San Ramon with guns strapped to their hips. ..." ...

"Three men have been indicted in Georgia for allegedly trying to steal $3 million from gun maker Glock."

"The indictment handed down by an Atlanta-area grand jury Friday says the three men conspired from 2000 until early last year to steal the money."

"Jeffery Pombert, James Harper III and Jerry Chapman are charged with theft by taking and violation of a state racketeering law."

"The indictment says Harper worked as an outside legal counsel for Austrian-based Glock's U.S. headquarters in Smyrna, near Atlanta. It said the men transferred funds and assets from Glock to personal bank accounts they had set up."

"Harper and Pombert have been released from Cobb County jail on bond. Chapman was still in jail Tuesday." ...
