Neighborhood security cameras bore out Michael Ian Downs claim of self-defense in the Sunday shooting death of Oscar Trujillo, 28, officials said. Downs became a free man on Wednesday.
Charges against Downs,30, including an open count of murder, were dismissed Wednesday according to Ninth Judicial District Attorney Quentin Ray.
"The night of the shooting, law enforcement interviewed people and we believed we had the grounds to charge Downs," Ray said. |

Charges against a 37-year-old man who shot an intruder who had entered his St. Louis, MO home have been declined, with the shooting determined to be self-defense and covered by the “castle doctrine.”
The shooting occurred at approximately 4:20 PM. Responding officers arrived to find a man, shot multiple times, not breathing. He was transported to a hospital, where he succumbed to his injuries.
In an interesting twist, a 31-year-old woman, who had been at home with the homeowner, was arrested as an accomplice in the robbery. |

Today, January 4th, the Nebraska Legislature begins the 2023 legislative session. As in 2022, the Legislature can expect to see both pro and anti-gun bills introduced this year. Constitutional Carry is currently in 25 states. This year, Nebraska has the chance to be the 26th state. Senator Tom Brewer is leading the way and introducing a bill that recognizes the constitutional right of law-abiding citizens to carry a firearm for self-defense without first obtaining government permission. |

An Upstate man hospitalized after he was shot by a woman inside a moving vehicle has been arrested, officials said Wednesday.
Shale Remien, with the Anderson County Sheriff's Office, said John Stephen Boyd is charged with first-degree domestic violence after the shooting on Tuesday afternoon on Fire Tower Road in Piedmont.
Detectives said Boyd was driving with a woman and physically and verbally assaulted her inside the moving vehicle. |

Georgia’s gun laws will get another look when the legislature convenes starting next week.
Though gun rights have ruled in the legislature – some want to see whether those rights can get pushed back just a little in the name of public parks and moneymaking events.
State law explicitly allows legal gun owners to carry guns on government park land if they want, which drove gun rights activists to successfully challenge a ban on guns at the Georgia Botanical Garden, a city-owned Piedmont Park.
In November, Zoo Atlanta, located at the city’s Grant Park, bent its rules to allow firearms on site after another threat of legal action. |

As astute gun owners know, the Centers for Disease Control and Prevention (CDC) has been engaged in gun control politics for decades. “Reliability” refers to how consistently a system, product, or handgun, for example, performs the way it is supposed to function over repeated trials without failure. It is the quality of being dependable and trustworthy and instills confidence in using it again and again. In this author’s opinion, reliability is the most important criterion for selecting and using a handgun for self-defense and personal protection. This is a significant statement to make, but I believe it. Another thing I believe and have sadly discovered is that all machines fail or underperform at some point in time. |

HB 5855:
Bans the sale and possession of semi-automatic, centerfire, magazine-fed rifles. This includes all AR/AK pattern rifles and pistols. HB 5855 also includes a provision requiring the registration of existing banned rifles.
Bans magazines that can hold more than 10 rounds of ammunition.
Bans adults aged 18 to 20 years old from obtaining a state Firearm Owners Identification (FOID) card.
Bans .50 BMG rifles and ammunition.
Expands the duration of the state's “red flag” firearm restraining order by increasing it from 6 to 12 months.
Severely restricts hunting for anyone under the age of 21.

Right now, gun advocates are asking SCOTUS to block most of New York’s Concealed Carry Improvement Act—which the state legislature passed in the wake of Bruen—on the court’s infamous shadow docket. The New York law repealed the state’s now-invalid limits on concealed carry, replacing them with more rigorous screenings for permit applicants plus a list of “sensitive places” where guns remained banned. A conservative judge promptly halted the statute, gutting the screening for permits while legalizing concealed carry in hospitals, parks, zoos, movie theaters, protests, and more. But a federal appeals court reinstated the law, leading its opponents to beg the Supreme Court for emergency relief. |

If proven, it seems a curious relationship for a bank that presumes to be the “woke” moral arbiter for its customers’ right to keep and bear arms. |

• Proceed with Biden’s pistol ban agenda and the ATF’s illegal gun registry
• Over $700 million in funds to encourage states to pass Red Flag Laws
• Funds to encourage VA medical centers to confiscate Firearms owned by veterans
• Money for the department of education to push their so-called “safe storage gun laws” on parents

What I found disgusting, though, was the celebratory reactions from people who hit the laughing emoji or heart emoji or posted “atta-boy” type comments on the report about the tow truck driver. This is not a cause for celebration. The guy who was shot did a bad thing; he may have even been a bad person. I know absolutely nothing about him other than what I read in four paragraphs.
But he’s dead and there may be some good people who are hurting because of it. The tow truck driver may be among those people. What happened was not something that lets the average person just go about their normal day. It’s traumatic. |

Montgomery County last week defended in federal court the constitutionality of its new law prohibiting gun possession within 100 yards of a park, religious institution or other enumerated “place of public assembly,” calling the ban similar to 19th century gun restrictions in areas where people gathered and necessary to reduce gun violence in the 21st.
The county’s U.S. District Court filing came in response to Maryland Shall Issue’s request that a federal judge temporarily block enforcement of the law pending a full hearing on its constitutionality. |

A federal court has blocked New York from enforcing a ban on the concealed carrying of firearms at houses of worship, ruling Thursday that the state law likely discriminated against religious New Yorkers and may have violated the First Amendment.
The state’s Democratic governor, Kathy Hochul, signed the legislation (S.51001/A.41001) in July, restricting concealed carry in “sensitive locations,” including houses of worship. Hochul signed the bill days after the U.S. Supreme Court struck down a New York restriction on concealed carry licenses. |

New changes to Firearm Owners' Identification (FOID) cards.
As of Jan. 1., the Illinois State Police will automatically renew a person’s FOID card.
This new change went into effect just a few days ago.
Now, with a full set of fingerprints, it will be easier for people to get their FOID cards renewed. |

Lawmakers are heading to Springfield to vote on a gun reform bill, the Protect Illinois Communities Act.
“It could make criminals out of law-abiding gun owners. This isn’t going to stop the folks that are buying guns illegally, it’s not going to stop them causing mass destruction in their community,” Tony McCombie said.
The proposed bill will essentially put a stop to the manufacturing and possession of assault rifles like AR-15′s, and high capacity magazines. While some believe this bill to be an infringement on the Second Amendment, others believe this bill will save lives. |

Effective January 1, Alabama is a constitutional carry state. The bill received Gov. Kay Ivey’s approval in March and activates in the new year. It allows law-abiding Alabamians to conceal-carry a handgun without a concealed carry permit.
While some law enforcement agencies in the state expressed concerns about the new bill, Lawrence County’s finest supported the change.
“I think in our area, and in the South in general, you have more law enforcement that support it,” said Moulton Police Chief Craig Knight. “I’ve always supported it. I’m a firm believer in our Constitution. I think our Second Amendment should give you all the right that you need to carry a firearm.” |

Where’s the danger? Those who carry a weapon in public are constantly asking this question. We’re always in what Jeff Cooper popularized as Condition Yellow. No threat has been recognized, but we’re actively alert for anything that might come up. Once a potential threat has been identified, we move to Condition Orange and begin planning for an attack. We evaluate the threat, the availability of cover and concealment, look for other threats and evaluate the overall environment in case we need to use lethal force. |
