"We don't know yet to what degree alcohol was a factor in the incident," Morse said.

At one point, Gardner and one of the men from the other pair were fighting and went to the ground, where they continued to grapple and Gardner pulled out a 0.38-caliber Ruger pistol, according to Mendocino County District Attorney's Office spokesman Mike Geniella.

"Gardner says he pulled his weapon in self-defense," Geniella said.

Gardner fired the gun once, hitting the other man -- whose identity wasn't released -- in his upper body, according to Morse.

Trayvon Martin's father, Tracy Martin, was in the state capital fighting for the repeal of Florida's "stand your ground" law, WFTV is reporting.

He also took part in a panel Thursday titled "Stand Your Ground Law: Where Do We Go From Here?" with state Rep. Alan Williams, D-Tallahasee, state attorney Willie Meggs and public defender Nancy Daniels.

Martin called for a repeal while other panelists suggested changes in the verbiage of the law, the news organization said.

“…that would have prevented the acquittal of Mr. Zimmerman in the killing of Mr. Trayvon Martin, like defining what an overt act is, the person would have to brandish a weapon, be charging toward another person, be physically engaged in acts of violence before one wanted to use deadly force, as well as further definition of aggressor,” said Bullard.

An explicit definition of who qualifies as an aggressor is a sticking point with Bullard, who says that’s a major difference between the bill he sponsored and a similar bipartisan proposal that recently passed its first Senate Committee.

ON BACKGROUND CHECKS: They are supported by nearly 90 percent of Americans, gun owners and non-gun owners — just as vast majorities of Americans accept our constitutional right to own guns for self-defense, hunting, shooting or collecting. Although Congress has refused to act, 17 states and the District of Columbia have implemented laws to ensure that gun buyers undergo background checks. And in those places, local leaders are stepping up and creating innovative models for background checks that serve both gun owners and public safety.

U.S. Senators Mike Enzi and John Barrasso, both R-Wyo., are continuing the fight against the controversial United Nations (U.N.) arms trade treaty that Secretary of State John Kerry signed in late September despite strong bipartisan opposition. They joined 48 other senators in sending a letter to President Obama expressing regret at the Administration’s decision to sign the treaty and stated their commitment to opposing ratification. The United States is not bound by any treaty until the Senate ratifies it with a two-thirds vote.

The gun parts manufacturer Magpul Industries made headlines six months ago when it threatened to leave Colorado in protest of its new gun laws, but is still in its same location in Boulder County.

And many of its customers and supporters aren’t too happy about it.

“Hmmm. I hope I am wrong, but I’m starting to feel dumb for buying a bunch of your stuff to support your company during your move and beyond,” Arizona customer Michael Franklin wrote on the company’s Facebook page last week. “What happened to the principles you were passionate about?”

The question is constantly asked: Why do you want to carry a gun?

1. “Why do you carry a gun?”

Kathy Jackson said it best on her website (www.corneredcat.com): “I carry a gun because I can’t carry a policeman.”

2. “But aren’t you worried that if more people carry guns, more arguments will escalate into people being shot and killed?”

No. Responsible gun owners are too practical to worry about things that don’t happen.

But Carlos Reed said that he poses no threat, and that he has walked along Baxter Boulevard at night with his rifle a dozen times and never had a problem. The 27-year-old Iraq War veteran and college law enforcement student said police don’t like him asserting his Second Amendment rights and have cost him a semester’s worth of school by keeping him locked up for 14 days on a false charge.

No one was home, so Mr. Carlson fired a warning shot to alert neighbors that he needed assistance. He did so again at another vacant house, Mr. Ostrer said.

What happened next is unclear. Mr. Ostrer said that Mr. Acosta-Sanchez had engaged in an “aggressive act” and that in response, Mr. Carlson fired his gun at his captive’s arm. The shot did not disable him, and according to Mr. Ostrer, Mr. Acosta-Sanchez “continued to act aggressively.” Mr. Carlson fired again, hitting him in the head.

“We believe the evidence shows this was a tragic and justified shooting,” Mr. Ostrer said.

IL: Illinois Law Would Heavily Restrict Possession of Firearms Outside Home

In a bid to fight against criminal and gang possession of firearms on the street, Illinois state rep. Mike Zalewski (D-21st Dist.) is set to propose legislation that essentially labels all firearm possession outside the home illegal.

This measure—HB 2265—does not differentiate between possession by law-abiding citizens and possession by criminals or gang members. And the NRA warns that this creates a situation where a law-abiding citizen who has a gun in his or her car for self-defense—but no concealed carry permit or Firearm Owner Identification Card (FOID)—could “face serious penalties for an innocuous mistake.”

Gary Spencer was waiting in his truck in the parking lot of a bank, as his wife deposited a check, when he spotted two men just outside the bank struggling over a money bag.

One of the men had waited while the other withdrew $5,000 from the bank, and was now using a stun gun to incapacitate his victim and steal the money. Spencer, who along with his wife, are Right-to-Carry permit holders, drew a .380 pistol from his wife’s purse, ran to the site of the attack and confronted the robber. Upon seeing Spencer’s gun, the criminal fled without the cash.

But gun owners stuck together. We fought back against this unprecedented attack on our Second Amendment rights. Gun owners answered the NRA’s weekly calls to action by flooding the state legislature and the Governor’s office with e-mails, letters, and phone calls. The NRA’s full-time California lobbyist and its support team of attorneys and experts worked diligently behind the scenes and at legislative hearings to do everything in their power to stop each of these bills. When the dust settled, much to the dismay of the anti-gun lobby, together gun owners had defeated the overwhelming majority of bills that were introduced.

A group of people taking their message to the streets for a peaceful walk, but instead of holding signs, they'll be holding their guns.

It's the first Open Carry Walk in central Arkansas, and it's being held in Bryant on Saturday.

Arkansas Carry organized this march, and they're not calling it a protest. They're walking to celebrate and show support for their Second Amendment right.

"My own kids will be there with my wife, and my wife will open carry, so this is a family event," said Nicholas Stehle, Arkansas Carry chairman.

Put it all together, and a total of 61 senators either have pledged to oppose the ATT or have publicly expressed skepticism about it. If it ever reaches the Senate, the ATT is more likely to be opposed by 67 senators than to find a two-thirds majority willing to support it.

It’s not hard to see why.

The ATT nominally requires signatory nations to act to regulate their import and export of conventional weapons and related activities. But all nations already have the unquestioned right to control such activities.

Today’s Washington Post is running an op-ed bylined by former Congresswoman Gabrielle Giffords and New York Attorney General Eric T. Schneiderman that pushes a new gun show background check scheme by referring to five high-profile mass shootings that had absolutely no connection to gun shows.

It is a text book example of gun control bait-and-switch that has become a mainstay of the gun prohibition strategy over the past several years. The opinion piece cites specifically the mass shootings at Virginia Tech, Aurora, Colo., Newtown, the Washington Navy Yard and in Tucson, the latter which left Giffords severely wounded and several others dead.
