NY: Judge Stays New York City's Suit Against Gun Industry

"A federal judge in Brooklyn on Monday stayed New York City's lawsuit against gun manufacturers as he prepares to consider whether recently passed legislation bars such claims."

"In a brief order, Eastern District Judge Jack B. Weinstein put the Nov. 28 trial on hold. On Nov. 21, he will have a hearing to consider the gun industry's motion to dismiss the suit, which alleges that the sales and marketing practices of gun makers allow criminals to obtain guns, creating a public nuisance."

"Monday's ruling came two days after the gun industry petitioned the 2nd U.S. Circuit Court of Appeals for a writ of mandamus directing Weinstein to vacate the trial date and stay the case. Weinstein had previously agreed to hear arguments on the newly enacted legislation, but did not decide until Monday to vacate the trial date and impose a stay."

"This past legislative session has been good for Blagojevich and his gun control allies. He vetoed two NRA-backed initiatives that would have destroyed the firearm purchase database and made it easier for some convicted criminals to own guns. He also vetoed a House bill that would have eliminated the waiting period for gun owners that trade firearms."

"It is amazing to me that some of these bills even passed through the state assembly in the first place. It just goes to show the clout the NRA has. I realize that most gun owners are law-abiding citizens who pose no threat to public, but guns are very dangerous and can cause catastrophic damage if handled irresponsibly. The state keeps track of all automobile owners, most of whom are law-abiding citizens, through a database. There's no reason why we should not have a similar system for gun owners."

-------
1 - The right to keep and bear arms is specifically mentioned in the Constitution. Your right to own a car or drive is not.

2 - Registration has not stopped accidents or vehicular homicides. It was never meant to do so. It was a way to track stolen vehicles.

"When is federal legislation that LOOKS like special protective legislation NOT a mere prop for a 'special interest'? When

"A. The industry being defended is the industry as a whole, not any particular company;

"B. The threat to that industry comes from numerous local governments set out to abuse the tort system;

"C. The issue at hand directly relates to one of the Amendments to the Constitution in the Bill of Rights; and

"D. The law is a good example of a rare Constitutionally PROPER use of the 'Commerce Clause.'"

"This has gotten me to thinking about Proposition H. Sure, it's currently being challenged by the National Rifle Association (Motto: Don't make us shoot you), but it doesn't mean that some GOOD things can't come from this measure."

"I'd like to offer some observations on Proposition H."

"Health Insurance costs are sure to go down. Working conditions will be much better - for criminals."

"It is finally easier to identify the criminals. They're the ones with the guns. The victims are the ones lying in the pool of blood."

"More good news. Most shootings will now be intentional."

"There are those who oppose the idea for various reasons, many of them quite logical. I happen to know several cops who cringe at the thought. But no police or prosecutors were invited to testify before the committee."

"...I don't want to get carried away and ask why the Legislature would possibly be interested in endangering the safety of drivers, their passengers and all the other unsuspecting people who share the highways by making it easier than ever for people to tote guns and rifles in their vehicles."

"Funny thing is, this is one of the reasons police, sheriffs and most other law enforcement agencies decided against endorsing the bill last year. ..."

The facility will become home to the Midland Gun Show April 22-23 and the Home and Garden Show March 3-5. "Outlandish comments from a representative of the national Brady Campaign to Prevent Gun Violence won't help gun-control issues in Illinois."

"Last summer, Gov. Rod Blagojevich vetoed three bills dealing with how guns may be transported, tracked and traded."

"There can be reasonable arguments on both sides of these issues, but the organization formed in the name of presidential aide Jim Brady ...had to enter with an outlandish statement: 'Those who oppose the veto of the governor are upholding crime. They are advocating for criminals and against victims,' said Jennifer Bishop. The comment was so ridiculous it would almost make one want to override the governor's vetoes without knowing the issues."
