Alaska Court: Judge Erred in Taking Away Gun Permit

The Alaska Court of Appeals ruled that District Court Judge Natalie Finn erred in taking away Timothy Wagner's permit until his mental illness was "either cured or improved."

In its decision, the court cited changes to state law in 1998 to eliminate mental illness as a factor that the Department of Public Safety can consider when processing concealed handgun permits.

Thanks to the 1993 Brady Law, which requires a background check before buying a firearm from a licensed dealer, outlaws don't patronize gun retailers as much as they once did. However, they have stepped up reliance on kith and kin to obtain firearms.

"What this shows is that making it harder for stores to sell guns does nothing to deter criminals from getting weapons," says University of Texas criminologist Jeffrey Wendell.

GOA ALERTS -- About the restaurant ban on CCW holders, Scott said, "It runs counter to common sense that law abiding citizens sitting in the local Applebee's having a quiet diner with their family are the problem. The restaurant ban fixes nothing. It is based on the false presumption that CCW holders threaten the public. A review of the State Police files makes the point better than anything else: there is not one single case of a Virginia CCW holder using a firearm in an illegal manner."

President Bush signed an order Tuesday that would allow for the trial of people accused of terrorism by a special military commission instead of civilian courts.

The article goes on to say, "It is easier to protect the sources and methods of investigators in military proceedings..."

Shortly after the trial, Creazzo debated buying a gun. She said she was conflicted because friends told her criminals could take a gun away and use it on her.

But too many people today have no respect for God or the law and she concluded she needed the gun for protection, she said.

"The one thing that went through my mind was to protect my family," she said. "When I returned fire, he ducked for cover. I'd say more than anything, I was lucky."

A national program based in Wisconsin, organizes women-only weekend sessions in an effort to create a comfortable, non-competitive atmosphere in which women can learn outdoor skills without fear of being intimidated or dismissed by men.

About 20,000 women took part in sessions throughout the country last year... "Instead of seeing who can catch the biggest fish, or who can shoot the most clay targets, it's a cooperative effort to get everyone up to speed," Lueck said.

The right to counsel is not some arcane bit of legal accretion. It's in the Constitution: "In all prosecutions, the accused shall enjoy the right ... to have the assistance of counsel for his defense."

The Bush administration disagrees, and with surging popularity rates believes it can do just about anything it wants to combat terrorism... White House aides facing inconvenient questions from pesky reporters have been known to smirk and reply: "The public gets it."
