Constitutional Dead Letters

... "The United States Constitution, by contrast, is thought to be in good standing. Yet there are numerous provisions of the U.S. Constitution that are never enforced. These provisions, analogous to 'dead letters' in the U.S. Postal System, are either totally ignored by federal judges or given such a narrow construction that they might as well not exist. As columnist and curmudgeon Joseph Sobran has written, the Supreme Court has, in essence, exercised a 'line-item veto' over the document, totally ignoring provisions that interfere with the justices' national vision or social objectives." ...

Might we ask why our wonderful leaders continue to advance citizen disarmament, that is, putting the rest of us who don't menace, don't rob, don't pull guns on people for gain, at the mercy of the young Mr. Brown's of the world?" ...

"ACORN, the publicly funded national organization linked to voter fraud in several states is now actively interfering with the exercise of firearm civil rights in New Jersey, and the Second Amendment Foundation is calling for an immediate federal investigation."

"One example of ACORN's gun control activism is when its officials intervened in an unsuccessful attempt to defend Jersey City, New Jersey's local gun control ordinance, which was struck down December 13, 2006 in New Jersey state court as a violation of state law pre-empting stronger local gun ordinances." ...

"The ISRA is recommending that all law-abiding Americans celebrate their 2nd Amendment rights by purchasing a firearm or two this weekend. This recommendation comes as firearm dealers across the nation are reporting record jumps in sales of rifles, pistols and shotguns. Likewise, the FBI reports that requests for gun-buyer background checks are coming in at a frenzied pace."

"This plus-up in gun purchases is being attributed to President-elect Obama's demonstrated hostility toward firearm owners and well-founded fears that his administration will implement Chicago-style gun controls across the United States." ...

"This week's legal development focuses on the interaction of Heller and the challenges to Proposition 8. I would argue that supporters of gun rights have a vested interest in seeing a successful challenge to the same sex marriage ban because of the 'prospectivity issue' which arises in firearms law contexts when the issue of 'grandfathering' comes up which also raises 'just compensation' issues." ...

... "It seems most gun owners choices at the checkout counter tend to feed the ego instead of the need of practical usage. We as Americans want the biggest and best available, we must have the most prodigious of everything, no matter the cost, even when the job could have been done just as well with another efficient tool purchased at much lower cost. Forget about impressing your buddies at the range with the brand or cost of your arsenal, instead work on your skills and out shoot them at every range and speed." ...

"According to an article on CNN.com, gun sales have risen dramatically since Obama was elected president. The article stated that the FBI has received more than 374,000 requests for background checks on gun purchasers, which is a 49 percent increase over last year."

"Within the increase in gun sales, more specific trends have materialized. More specifically, certain models are being sold out, such as the AR-15 rifle ... The article states these assault weapons are being bought rapidly because some fear Obama will place new restrictions on them, or even take them off the market. ... Right here, in pdf. Author raises the point that the present test for self defense (did the defender reasonably believe he was in danger or lethal danger?) misses much of true self defense. I.e., when the defender is attacked by surprise and reacts by reflex, not really having a belief about anything. Courts generally treat that as self defense anyway, but the author suggests we ought to modify the doctrine to fit. He also notes that German law is more liberal toward self-defense; a person under criminal attack is not required to use only a reasonable amount of force, but rather is allowed to use force unless it is grossly disproportionate to the attack.

As nightfall does not come all at once, neither does oppression. In both instances, there is a twilight.
