New York Contress Critters, Attorney General Holder Move Against Second Amendment

"Senator Gillibrand and Representative McCarthy have introduced the Gun Trafficking Prevention Act of 2009. Ostensibly designed to prosecute gun traffickers, the bill would also deny the Second Amendment to anybody on the so-called terror watch list. The legislation is supported by New York City Mayor Michael Bloomberg, New Yorkers Against Gun Violence, and the Brady Campaign."

"The number of unique names on the U.S. terror watch list totals 400,000, newly released FBI data reveals. The Washington Post reported that during a 12-month period ending in March of this year, 1,600 people were nominated daily by the U.S. intelligence community to be put on the list due to 'reasonable suspicion.'" ...

"Mayor Michael Bloomberg and his 'Mayors Against Illegal Guns' (or, considering the number of members facing legal difficulties, perhaps 'Illegal Mayors Against Guns' would be more accurate) are redoubling their efforts to close the so-called 'terror gap loophole.' That's the term used by gun banners who would like to give the Attorney General the power to block gun sales to 'suspected terrorists.' They've even started a new website:" ...

"My concern over this killing, and the killings of other individuals with firearms used for hunting and recreation, is that we are reaching a tipping point. In the last week alone five people have been killed in the Metro area with guns. At some point in the near future a collective 'enough is enough' is going to take over the debate over firearm possession. Hunters like myself will feel pulled to protect our right to bear arms ..." ...

"From Texas Attorney General's Office - Texas Attorney General Greg Abbott today (Monday) took legal action to protect Texans’ Second Amendment right to keep and bear arms. In a brief filed with the U.S. Supreme Court and authored by Attorney General Abbott, 38 state attorneys general explain that law-abiding Americans have a fundamental right to bear arms – and that local governments cannot simply disregard that right and impose an outright ban on handgun possession." ...

FULL TEXT BELOW:

U.S. Sen. Jon Tester is part of a group of lawmakers signing a brief supporting a gun rights case before the U.S. Supreme Court.

The court is considering whether the Second Amendment's right to keep and bear arms applies to state and local laws restricting guns. The case arose from a handgun ban in Chicago.

Gun advocates want the court to strike down such local laws.

Tester says 55 other senators, including 17 other Democrats, have signed onto a brief in support of gun rights he put together with Republican Kay Bailey Hutchison of Texas

... "Over many decades, people have argued whether the Second Amendment is an individual right or a collective right – meaning limited to people in organized government military or law-enforcement groups."

"In June 2008, the U.S. Supreme Court ruled in District of Columbia v. Heller that the Second Amendment is an individual right and struck down the Washington, D.C., ban on handguns. Suddenly, the same people who, for years, had insisted the Second Amendment was universally a collective right changed their tune – taking the position that the Second Amendment only applies for 'federal enclaves' such as the District of Columbia and does not apply to the 50 states." ...

"Did Attorney General Eric Holder recently 'spill the beans' on the Obama administration's desires to implement some kind of national gun registration scheme?"

"Holder, a perennial anti-gunner who was involved with the Clinton administration’s anti-gun schemes, testified before the Senate Judiciary Committee on Nov. 18 and a transcript of his remarks that were not part of his prepared statement is revealing. It is so revealing, in fact, that the Law Enforcement Alliance of America issued a press statement that Holder had revealed 'a stunningly broad and aggressive anti-gun agenda.'"

And Smith Lake and the Bankhead National Forest are no strangers to echoing gunshots from hunters, target shooters and occasional drunken white boys blasting holes in federal, state and local signage. Automatic weapons fire, on the other hand, is a bit rarer and would have drawn the notice of curious passersby -- not that there were many of those in Charlie Quintard's neck of the woods -- even in the peaceful days before the Battle of Sipsey Street and the disappearance of the first four ATF agents right afterward." ...

"A judge on Friday blocked a Tennessee law that allowed people to bring handguns into restaurants and bars."

"The law that took effect in July allowed handgun owners with permits to pack their pistols in places serving alcohol, providing the establishments made more than half their profits from food."

"Nashville Judge Claudia Bonnyman said the law was 'fraught with ambiguity' and ruled in favor of a suit brought by restaurant owners who argued gun owners would not be able to determine if an establishment met the criteria."

"'We will have vigilantes shooting up bars all over,' said Randy Rayburn, the owner of three upscale cafes, who led opponents of the law." ...

"The news of a pending push by Obama to ban many semi-automatic rifles was sparked by comments from newly-minted Attorney General Eric Holder, who told reporters that 'As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons.' Gun Owners of America have been raging against the Senate health care bill for all sorts of imagined threats to the Second Amendment, and now the White House has taken notice."

"What exactly are their concerns? Well, for instance, 'Special 'wellness and prevention' programs ... would allow the government to offer lower premiums to employers who bribe their employees to live healthier lifestyles -- and nothing within the bill would prohibit rabidly anti-gun HHS Secretary Kathleen Sebelius from decreeing that 'no guns' is somehow healthier.'" ...

"Last week, the body of Chicago school board president Michael Scott was found in the Chicago River with a single bullet wound in his head. The big story was that this powerful, well-connected public official had, according to the county medical examiner, committed suicide. The less-noticed story was that he did it with an illegal weapon."
