"The gun control debate is heating up in America and at the center of this debate is the Second Amendment. Last year, Attorney General John Ashcroft caused a stir when his Justice Department issued a memorandum supporting the constitutional right of individuals to bear arms. Since then, several criminal defendants have challenged their weapons convictions on constitutional grounds."

"We simply have to get over the notion that we can prevent violence by controlling weapons. We are destined to live in a world with an endless variety of arms that are inexpensive and concealable. This trend, as undesirable as it may be, is unavoidable.

With weapons becoming powerful and difficult to detect, the phrase "guns don't kill, people kill" is going to become the only realistic principle for security." ...

"In Los Angeles last year, cars were seen bearing illuminated signs that read “F--- you, this is still Mexico.” Not just a few cars. Thousands. This is but one sign of the hostility towards the United States that is growing among Mexicans living in this country."

"As the number of Mexicans living in the U.S. has ballooned (growing from 2 million to 23 million over the past thirty years), so have the feelings of anti-Americanism among them. While the many Mexicans living in the U.S. are still law-abiding and loyal, there are disturbing signs that anti-Americanism is on the increase. "Mr. Ashcroft's act in interpreting the Second Amendment to square with the NRA position and then instructing federal prosecutors to take the Texas decision as their guide in handling gun cases has put him in a contradictory posture.

As the nation's chief law-enforcement officer committed to cracking down on criminals, his policy shift opened the door for criminal defendants to use the broader interpretation of individual gun ownership in combating gun control laws under which they may be charged.

But Mr. Ashcroft now will have to decide whether to hold to his position in light of the California decision or cave in, to the ire of his NRA friends and supporters."

As the nation's chief law enforcement officer, Ashcroft must uphold and defend the Constitution - the entire Constitution, not just parts that please Mr. Whitcover, the VPC and the Brady Center.
