A man who fatally shot a burglar coming in a window of his west Harris County home said the dead man may already have been shot at, possibly by another neighbor.
"There were bullet holes in my back fence," Damon Barone said Monday from his home in the 3400 block of Cascadia. |

The regular litany of gun deaths reported in the news jades our sense of outrage at these senseless killings. In Florida a professional football star is killed; in Omaha, Neb., seven people are killed in a shopping mall —including an Illinois State University graduate — and Sunday, four people are shot to death in two church facilities in Colorado. Incredibly, the church victimized had an armed security guard. An armed security guard at a church in the United States! |

Nearly two-thirds of Americans say they believe the Constitution guarantees each person the right to own a gun, according to a poll released Sunday.
In all, 65 percent said they thought the Constitution ensures that right, and 31 percent said it did not. The question had a sampling error of plus-or-minus 3 points.
Men and people living in rural areas were most likely to say the Constitution guarantees the right to own a gun.

For many of the patrons of the Knob Creek gun show, there is no correlation between their hobby and gun related crime (in fact they would assert that their hobby actually prevents crime), instead they are merely expressing what they believe is a guaranteed constitutional right. This spring the Supreme Court will take up this exact issue. It will be the most important legal debate on the subject in almost 70 years. The court will potentially decide on whether the 2nd amendment is interpreted as an individual right or a collective right. When they do, the precedent set will determine not only the fate of events like Knob Creek, but will fundamentally impact a culture that worships their weapons.

Republican presidential candidate Rudy Giuliani said that he would support the Second Amendment despite his imposition of a ban on semi-automatic handguns while mayor of New York City. “I used the gun laws aggressively in New York. I had to and it worked well,” Giuliani said in response to a question asked during a brief campaign stop at Goss International Monday. “As president of the United States of America, I would be honor bound to uphold the second amendment.” This was not the first time Giuliani had been confronted with his well-known stand on gun control. |

At a pretrial conference, U.S. District Judge David C. Bury said he won't bar testimony from Francisco Javier Dominguez Rivera's two brothers or the girlfriend of one brother, denying a motion from attorneys for Agent Nicholas Corbett.
The defense contends that the Mexican government influenced the three, saying a consular official was present to question the three before law enforcement officers did so after the Jan. 12 shooting between Bisbee and Douglas.
Ed.: Everyone has the right under international law to speak with their consulate prior to being questioned. Why is the defense trying to eliminate witnesses? Hopefully is is just a vigorous defense. |

An undercover deputy shot and wounded one of two would-be robbers who tried to hold him up at gunpoint Monday evening in a suburban West Palm Beach apartment complex, Palm Beach County sheriff's spokesman Pete Palenzuela said.
Alexander Germaine Horne, 18, was taken to Delray Medical Center with a leg wound and was released to investigators later, Palenzuela said. |

Incidents of gun violence in recent years have prompted cities and states to enact tougher gun laws, but Congress has approved no new national restrictions on guns. Those on both sides of the debate say that the power of the gun lobby and a lack of public outrage dampened any push for new national restrictions. "What's amazing to me is that with all the shootings from Columbine down to Westroads, there's been no national discussion about gun control," said Nebraska State Sen. Brad Ashford of Omaha. Ashford, chairman of the Legislature's Judiciary Committee, hopes to start a state conversation. He is proposing legislation that would require gun owners to report lost or stolen guns to police. |

BLACKSBURG, Va. - The Supreme Court recently agreed to rule on the specific meaning of the Second Amendment to the Constitution, which reads, 'A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.'
Many gun-control advocates claim that this grants a 'collective' right, giving the government the authority to regulate the militia, such as the National Guard, and does not grant an 'individual' right to gun ownership. The position that the Second Amendment only guarantees a collective right is wholly incorrect, especially when one examines the rest of the Bill of Rights. |

There is a war on our freedoms and this includes the right to bear arms. Over the years there has been a mass indoctrination to the evils of guns, which has resulted in the systematic psychological disarmament of the American people. With less armed law-abiding citizens and more gun-free zones, the result has been more helpless victims. It has also demonstrated that we cannot rely on government to protect us from criminals. Most crime we are facing will not be solved by further gun control legislation. |

A Londonderry firefighter shot and killed his wife in the driveway outside their home Sunday afternoon after she fired a shotgun at him and continued to confront him with the weapon in her hand, state prosecutors said yesterday.
Gary M. Dion, 37, called police shortly after shooting his wife, Karen, 38, in the driveway of the couple's 76 Mountain Road home about 2:30 p.m.

HOUSTON -- A controversial case involving a neighbor accused of shooting suspected burglars is being reviewed by the Harris County district attorney's office, KPRC Local 2 reported Monday.
The Pasadena Police Department turned over all its case files, consisting of about 50 pages, in preparation for review by a grand jury, which will decide if homeowner Joe Horn will face any charges. |

Prosecutors asked a judge Friday to dismiss a misdemeanor citation issued to a newspaper journalist after he began taking pictures at the scene of a fire in Maumelle.
State Trooper Tom Weindruch, 33, arrested Bill Lawson, 59, a reporter-photographer for Stephens Media, and detained him for about 30 minutes Monday night before citing him for obstructing governmental operations. Lawson filed a formal complaint with state police Thursday over the incident, accusing Weindruch of inappropriate and hostile behavior. |

A Minneapolis police SWAT team kicked in the wrong door yesterday during an early morning raid, prompting the man of the house to grab his gun and open fire on the officers who entered the house. ...his brother was trying to protect his wife and six children. No one from the family was hit during the exchange of gunfire. Vang hit two officers, but the Pioneer Press says they were protected by ballistic vests and helmets. ... Police haven't decided whether they'll try to charge Khang with a crime.

Nebraska law allows private businesses to prohibit concealed-carry at their business. The Westroads Mall had posted a sign prohibiting legal concealed-carry for self-defense. The stated purpose is to "create a safe working and shopping environment for employees and customers." Sadly, it provides the illusion of safety while virtually guaranteeing the opposite. Once they've disarmed you, these stores refuse to provide for your protection. No metal detectors, no searches to enforce their "no firearms" policy; most don't even have armed security personnel. Are we to believe that a murderer is going to stop when they see a "no guns allowed" sign? |

A 10-year old Ocala girl brought her lunch to school and a small kitchen knife to cut it. She now faces a felony charge after being arrested. The school and the sheriff's office disagree on the reason for the arrest.
School officials say the 5th grader was brown-bagging it. She brought a piece of steak for her lunch, but she also brought a steak knife. That's when deputies were called. ... "She did not use it inappropriately. She did not threaten anyone with it. She didn't pull it out and brandish it. Nothing of that nature," explained Marion County School Spokesman Kevin Christian. But a couple of teachers took the utensil and called the sheriff.

According to the Williamson County School System, self defense is no defense when it comes to getting suspended for fighting.

In a video, a 17-year-old student is seen grabbing Rachel Davis from behind. The video shows Davis turn and walk away. The video shows the other student follow... ... and confront her a second time. Again, Rachel Davis turned and walked away. The girl then followed her out of camera range. That is when the incident reportedly escalates. Davis said, “My daughter was struck in the face with either a back pack or a purse. She got a laceration on her jaw required a trip to the ER. |

This article looks back at the record, and year end is a good time to review it. It's hard imagining another as bad with a President defiling the law and once telling Republican colleagues the Constitution is "just a goddamned piece of paper."
He didn't just say it. He governs by it, gets away with it, and former Defense Department analyst Daniel Ellsberg, of Pentagon Papers fame, says "a coup has occurred (with another to come from) the next 9/11....that completes the first (that's) seen a steady assault on every fundamental (aspect) of our Constitution (to create) an executive government (to) rule by decree" no different from a police state. |
