Supreme Court sidesteps politically charged gun rights case

"The Supreme Court disappointed gun owner groups Monday, refusing to consider whether the Constitution guarantees people a personal right to own a gun."

"The court has never said if the right to 'keep and bear arms' applies to individuals."

"Although the Bush administration has endorsed individual gun-ownership rights, it did not encourage the justices to resolve the issue in this case involving a challenge of California laws banning high-powered weapons."

"Many other groups wanted the court to take the politically charged case, including the National Rife Association, the Pink Pistols, a group of gay and lesbian gun owners; the Second Amendment Sisters; Doctors for Sensible Gun Laws; and Jews for the Preservation of Firearms Ownership."

-------
Curious as to why an administration that asserts itself to be a friend of gun owners and a friend of the Second Amendment would keep silent on this critical issue.

There was no explanation and no reason why the Supreme Court would deny a hearing to a case that had as much merit as Silveira. A simple "DENIED" tells us in what regard these so-called "justices" hold the Second Amendment to the US Constitution.

Take a look at some of the other cases SCOTUS will be hearing. It should tell you where their judicial priorities lie.

"The U.S. Supreme Court's refusal Monday to consider whether the Constitution guarantees Americans a personal right to own a gun upholds the status quo of gun control."

"The case, a failed challenge to California's assault weapons ban, has stoked the long-running debate whether gun ownership in the United States is an individual or collective right."

"By leaving intact the California law, the justices declined to review a San Francisco appeals court decision that said individuals have no right to bear arms under the Second Amendment. Instead, the appeals panel said individuals had a right to weapons for the purpose of maintaining effective state militias." ...

" 'As a practical matter, this California case changed nothing,' said Chuck Michel, an attorney with the California Pistol and Rifle Association. 'We assume that, sooner or later, the United States Supreme Court will acknowledge the Second Amendment creates an individual right. What we need to be careful about is where the line needs to be drawn on government regulation: Somewhere between semiautomatic weapons shipped to your door and a complete ban.' "

" 'The action of the United States Supreme Court today in denying review of the Ninth Circuit's ruling in Silveira v. Lockyer repudiates the extremist gun lobby and others who view the Second Amendment as a weapon against reasonable gun laws,' said Dennis Henigan, Director of the Brady Center's Legal Action Project. 'It remains true that never in our nation's history has a federal court struck down a gun law on Second Amendment grounds.' "

The business of gun manufacturing, like any other enterprise, is to produce and sell products. What happens as a result of those sales is not their responsibility, so long as the sales are legal.

"Following that argument, manufacturers of automobiles, knives and even hammers would be held liable for murders caused by their products."

"The real liability here lies in the hands of the gun collector who is alleged to have sold the gun to Furrow, an ex-convict prohibited from purchasing weapons." ...

-------
No, the real liability here lies with Furrow. A law-abiding citizen engaging in a voluntary transaction with another should not be held liable for the illegal actions of said other.

"A fugitive behind bars and a little girl in the hospital. Their images represent the highs and lows experienced by many this week, and though their circumstances were night and day, both are connected by the choice to store a gun in the car."

"Gun-rights advocates aren't the only people who believe that individuals should be free to own guns. Even gun-control advocates usually specify that they aren't trying to ban all guns."

"But most activists on both sides of the gun issue say there must be limits on gun ownership."

"Why?"

"So that guns don't fall into the 'wrong' hands."

"But if a law could keep dangerous weapons out of the hands of dangerous people, there would be virtually no violent crime at all. Just pass a law specifying that bad people can't own guns and the problem of gun violence is solved."

"Unfortunately, things don't work out that way in the real world."

"The Roper Center for Public Opinion Research asked Americans whether they agreed or disagreed with the following statement:

"Companies that make guns should be held financially liable if judges or juries find that their products were used to commit a crime."

"The response was overwhelming—78% disagreed, while only 18% agreed. Unlike many other issues we face, the notion that these grievous lawsuits against the industry are wrong generally makes sense to most Americans, including some people who may support other items on the gun ban lobby's agenda." ...

"The dogs attempted to jump in the bed of the truck and nearly made it when Baker started yelling, screaming so loudly that neighbors a quarter-mile away heard the shouts. He hollered for his mother to call 911 and for his 16-year-old son, Cody, to grab a gun."

"Cody shot at the dogs with a 12-gauge shotgun, blinding one, knocking one down and disorienting the third."

"The distraction was enough for Baker to jump down, grab his truck keys from the driveway and climb into the cab of the pickup. He drove it close enough to the house to scurry inside, he said."

"The Mesa City Council is expected to approve guidelines today for selling seized firearms, a move paving the way for the weapons to be auctioned to licensed gun dealers." ...

"In April, the council voted 6-1 to reinstate gun auctions. The move reversed a 1998 city policy requiring all firearms confiscated by police to be destroyed unless they could be used for law enforcement, donated to museums, or returned to the owners if the guns were stolen. Before 1998, police auctioned seized firearms to gun dealers." ...

"The system is unusual. While it is used by state agencies and run by state employees on state-owned computers, it is technically owned by a private nonprofit group -- the Minnesota Chiefs of Police Association. Some people who have been targeted because of the database say it has allowed their privacy to be invaded."

Houston police want to question a man they say took the law into his own hands, and shot a burglar in southeast Houston Saturday morning.

It happened around 4am at the Belvedere Apartments on Elrod near Garland. Investigators say a resident at the complex saw the man breaking into his car and shot him.

The suspect was able to climb into another car where an accomplice was waiting, but half a mile down the road they crashed.

The accomplice fled the scene, as did the man who shot the suspect. Now police are looking for both, and say the shooter may not face charges.

"They may feel they did something wrong, but there's certain elements in the state law that cover protection of property and life during nighttime hours and we just want to talk to him," said HPD’s Rick Moreno.

"Smith walked away with no prosecution; Davis walked away with no job."

State police are giving out free gun locks this holiday season. The gun locks are being given to people who can't afford to buy them on their own. The idea is to prevent gun accidents with children.

"I think that we can all think of some type of incident where a child has been playing with a weapon they found, whether inside their home, or a friend's home, or maybe they find it somewhere it's not supposed to be and they play with it," said Capt. Francis Cootz, NYS Police.

The locks are available in limited supply at state police barracks. "Project Childsafe" is a national program with grant money from the Department of Justice.
