"The National Rifle Association urged a state judge Thursday to overturn an ordinance voters overwhelmingly approved in November banning handgun possession and firearm sales."

"Chuck Michel, an attorney for the NRA and gun enthusiasts suing to repeal the law, said he was 'sympathetic with the victims of gun violence' but said lawful weapon owners 'are part of the solution, and not part of the problem.' "

"Without addressing the Second Amendment dispute over whether individuals have a right to bear arms, Michel said a local government cannot ban weapons because the California Legislature allows their sale and possession, and has almost exclusive authority to regulate them."

"These new measures would push the boundaries beyond the self-defense measures already on the books. ...The 'Stand Your Ground' laws would allow people to defend themselves with deadly force even in public places when they perceive a life-threatening situation for themselves or others, and they would not be held accountable in criminal or civil court even if bystanders are injured."

"Laws putting more judgment in an individual's hands stem from people's increased concern about crime in their communities. Proponents say it helps shift the debate from gun control to crime control, and that these laws are part of the rugged individualism of Americans."

"Let me give you a clue, Mr. Schwartz: you have NO right not to live in fear. Read through the entire Constitution and show me where you find that specific, clearly-delineated right."

"Now let me explain something about the concept of a right. A right is something that every human being has. It exists simultaneously and equally among all humans. It is only a true right if it belongs to every human being equally and imposes no obligation on anyone else to supply you with that right, provide tools to exercise that right or curtail that right to fit another's need. That is the explanation of a true right, and that is how the Founding fathers defined it based on their study of Blackstone, Bastiat and the like."

"Well, you’ve probably heard all the arguments about the Second Amendment’s being a civil right and so forth, or that in a time of War as we are in now, preparedness and wariness (armed) is advisable."

"And it’s worth noting that more and more states are loosening their latitude not about guns, but about how they are carried and how and when they are to be used. It's called the Standing Your Ground movement, and it imbues the doctrine with the concept of a presumption of innocence on the part of the defender. This is not new: it is something American all along and should be restored nationwide."
