A former Eastchester police officer has been indicted in the shooting death of a New Yorker.

A Westchester County grand jury charged former officer James Pileggi with second degree murder on Wednesday. The jury says Pileggi recklessly caused the death of his friend, Andre Everett.

On November 3rd, Pileggi was showing off a laser handgun to the 27-year-old real estate agent when he shot Pileggi in the the throat.

If Pileggi is convicted, he will face 15 years in prison. He is currently free on $50,000 bond.

Pileggi's lawyer says the shooting was a tragic accident, but not a crime.
