The Idaho Legislature’s 2024 regular session is now one month old. Four pieces of legislation are in the works concerning firearms and gun rights.
The first is a draft by Senator Brian Lenney (R-Nampa) that would add “criminal immunity” to Idaho law, giving legal cover to a person who acts in self-defense. It is an element of what has become known as “stand your ground” law. This legislation has multiple co-sponsors which include: |

A woman whose son was killed in a mass shooting at a Nashville restaurant in 2018 announced her run for a Tennessee state legislative seat on Wednesday, saying she would push for gun control.
"I am running for the other parents whose children didn't come back home. For our children who deserve to be safe in schools, in stores, movie theaters, parks and restaurants," Shaundelle Brooks, a former parole officer who lives in the Nashville area, told supporters gathered near the state capitol. |

Gun Owners of America (GOA) and Gun Owners Foundation (GOF) have teamed up with Carl Higbie of News Max to sue New York State for refusing to issue gun permits to out-of-state residents and for refusing to recognize out-of-state gun licenses.
New York State law makes it virtually impossible for an out-of-state resident to possess a firearm within the Empire State. The law requires a permit for the mere possession of a gun. Under the law, only residents of the State can obtain a license. The New York law against the possession of firearms by people from outside the State is the strictest in the nation. The plaintiffs in the case claim that the New York law violates Americans’ right to keep arms and their right to bear those arms. |

The Aloha State’s highest court upheld a man’s gun-carry conviction on Wednesday after rejecting landmark decisions from the Supreme Court of the United States (SCOTUS).
Hawaii’s Supreme Court reversed a lower court decision that found charges leveled against Christopher Wilson for carrying a gun without a permit violated his rights. Instead, the court ruled its state constitution provides no gun-rights protections whatsoever. That’s despite it including a provision protecting the right of the people to keep and bear arms identical to the one in the federal Constitution. |

Last August, Florida's Collier County declared itself a "Bill of Rights sanctuary."
Sarasota County followed a few months later. The Marco Island City Council announced in January plans to be the first city to take that stand. A Hendry County commissioner wants to join the fight. The Volusia County Chair in 2021 tried to get support for the move there but it was voted down.
What does any of that mean? Mostly, it means that people there are unhappy with and distrustful of the federal government and want to be able to disregard federal rules they feel are unconstitutional or overreaching. |

Lawmakers in the Peachtree State on Tuesday gave an easy thumbs-up to a measure that would create an annual tax holiday for the sale of firearms and ammunition.
Georgia Senate Bill 344, which was introduced by state Sen. Jason Anavitarte (R) and co-sponsored by 20 fellow Republicans, passed on a party-line 30-23 roll call this week. The proposal, should it become law in its current form, would establish an annual five-day sales tax exemption on not only guns and ammo but also optics, safes, and some other shooting accessories.
"I’m a firm believer in the Second Amendment, so I would make the argument that less taxes are better on Second Amendment items," said Anavitarte. |

Governor Noem also signed two pro-Second Amendment bills into law. SB 39 prohibits a homeowners’ association from placing restrictions on firearms or firearm ammunition. And HB 1035 extends the period of renewal for an enhanced permit to carry a concealed pistol.
“South Dakota is a Second Amendment haven,” said Governor Noem. “These two bills strengthen our reputation as the most pro-Second Amendment state in the nation. I will always be proud to stand for the God-given right of every American to keep and bear arms.”

Federal Appeals Court Decision: A divided panel of the U.S. Court of Appeals for the Ninth Circuit stayed an injunction against the law, allowing it to remain in effect.
Judges Richard Clifton and Holly Thomas made the Ninth Circuit’s decision to stay the injunction, with a dissent from Judge Consuelo Callahan. U.S. District Judge Roger Benitez had earlier ruled the law unconstitutional, citing conflicts with the Second Amendment. |

That restriction, a federal judge in Montana noted last week, “covers almost the entirety of every urban location in the United States, including many places that have nothing to do with the closest school.”
U.S. District Judge Susan Watters nevertheless concluded that the federal Gun-Free School Zones Act is consistent with “the right of the people to keep and bear arms.” The decision shows that some federal judges are still bending over backward to uphold constitutionally dubious gun control laws, despite the Supreme Court’s recognition that the Second Amendment guarantees a right not only to keep firearms at home for self-defense but also to carry them in public for the same purpose.

A Civil Society Organisation, CSO, said that a bill seeking Nigerians to bear arms and weapons for self-defence is an invitation to anarchy and chaos, given the volatile nature of the society.

A Kansas bill would prohibit financial institutions operating in the state from using a credit card merchant category code that enables the tracking of firearm and ammunition purchases.
The House Financial Institutions and Pensions Committee introduced House Bill 2722 (HB2722) on Feb. 6. The legislation warns that “the creation or maintenance of records of purchase of firearms or ammunition or the tracking of sales made by a retailer of firearms or ammunition by a nongovernmental entity, including a financial institution, without a substantial and historical business need or requirement imposed by law, may frustrate the right to keep and bear arms and violate the reasonable privacy rights of lawful purchasers of firearms or ammunition.” |

A bill filed in the Arizona House would prohibit financial institutions from tracking or disclosing firearm-related transactions through credit card codes, undermining efforts by the feds to collect data on gun owners.
Rep. Quang Nguyen introduced House Bill 2727 (HB2727) on Feb. 1. The bill would prohibit any merchant retailer or sporting goods retailer in the state from using a firearms or ammunition merchant category credit card code. Any individual would be allowed to file a complaint with the State Attorney General in response to an alleged violation; they could also file a complaint in court. |

A Colorado bill would ban firearms from 19 locations defined as “sensitive” spaces.
Senate Bill 24-131, introduced on Wednesday, would prohibit firearms, either concealed or not, in such places as public parks, community recreation centers, hospitals, sporting venues, bars, libraries, universities, voting centers and government buildings. It would also prohibit people from carrying guns at events like protests and rallies.
“This is just common sense. We really need to have a designation of where it’s OK to have a firearm and where it’s not,” bill sponsor Sen. Sonya Jaquez Lewis, a Longmont Democrat, said. |

Attorney General Bob Ferguson announced Feb. 6 that Federal Way Discount Guns and its owner, Mohammed Baghai, will pay $3 million for violating Washington’s prohibition on selling high-capacity magazines with the capacity to hold more than 10 rounds of ammunition.
King County Superior Court Judge Wyman Yip already ruled in April that Federal Way Discount Guns and Baghai violated Washington’s Consumer Protection Act by selling high-capacity magazines after a state law went into effect prohibiting their sale. Today’s consent decree, filed in King County Superior Court, resolves the remainder of the case.

Two Louisville state senators are coming together to try and keep guns used in homicides from ending up in the hands of other criminals.
Since being elected to the Kentucky Senate in 2020, Democrat Karen Berg has been filing legislation that would change the way Kentucky handles guns confiscated by law enforcement.
"I have filed it every year since then. It's never gotten a hearing," Berg said.
Under current Kentucky law, guns confiscated by law enforcement are resold at a public auction.
