Debbie Dingell, D-Mich., said it falls short of protecting women from potentially dangerous dating partners or stalkers because it does not close the so-called “boyfriend loophole.” Spouses convicted of domestic abuse cannot own a gun, but boyfriends can. Republicans, led by Ernst, fought to keep a provision that would change that out of the final bill, saying it violates the Second Amendment. |

Republican lawmakers pushed through the bill for repealing the handgun carry permit requirement, leaving Holcomb the dilemma of whether to support what is a major conservative cause or agree with the objections of his state police superintendent.
The bill would allow anyone age 18 or older to carry a handgun in public except for reasons such as having a felony conviction or having a dangerous mental illness. Supporters argue the permit requirement undermines Second Amendment protections by forcing law-abiding citizens to undergo police fingerprinting and background checks. |

Senate Bill 388 strengthens the right to self-defense by creating a presumption that it is reasonable to believe physical force is necessary to defend oneself, or another person, from someone who has unlawfully entered one’s dwelling, place of work or motor vehicle. Victims of violent crime who respond with defensive force while protecting themselves or their loved ones should not have to face the additional threat of criminal or civil prosecution.
House Bill 5412 strengthens the right to self-defense by removing the duty to retreat for a person in a house of religious worship, before using deadly physical force to defend themselves or a third person. |

Rep. Dan Laursen, R-Powell, said he felt local law enforcement wouldn’t face the penalties outlined in the bill, even if they should. Laursen and other critics of the legislation are unhappy it would be up to local prosecuting attorneys to enforce the bill in court, saying they have little confidence in one governmental office holding another governmental office accountable, especially at the local level where the two agencies often have an ongoing working relationship.
“In this bill, your local attorney is the only one who can press charges against the law enforcement, and they are not going to press charges or bring a suit against the people they work with every day,” Laursen said. |

This year, anti-gun Washington Legislators placed law-abiding gun owners in their sights and made it their priority to pull no punches infringing on our Second Amendment rights. While this session saw the passage of numerous anti-gun measures, it was not without its victories as well. Thanks to the calls and emails from NRA Members and Second Amendment supporters, a number of equally bad measures were thankfully defeated. The law, which goes into effect on January 1, essentially allows people to have a gun in their jacket, purse or car without having a permit. The state does not currently require a permit to openly carry a weapon nor background checks for gun purchase.
The legislation was opposed by the Alabama Sheriff's Association, which had rallied against it earlier this month at the state Capitol, arguing that permit-less conceal carry laws would make it easier for people to obtain guns and not register them. |

State Attorney Jack Campbell says the case is closed and charges will not be filed in the deadly shooting after a road rage incident in Bradfordville on Jan. 6.
Investigators reviewed multiple surveillance videos of the shooting between two drivers outside the Circle K on the corner of Thomasville Road and Bannerman Road, according to Campbell.
The state attorney says the videos showed 53-year-old John Kuczwanski fired first at the other driver, before that driver returned fire, killing Kuczwanski. Campbell calls it a “clear case of self-defense.” |

A not-guilty verdict in the trial of Jasperin Melendez came late Thursday evening for the Waukegan man who was 19 when he shot Fabian Cortez-Milan, 30, of Zion, to death four years ago.
The murder trial, which had been delayed due to the pandemic, began Tuesday with a witness describing how the fatal shooting outside a Grayslake-area Halloween party on Oct. 21, 2017 was sparked by a previous incident at another social gathering.
After the verdict, Steve Spagnolo, chief of governmental relations and external affairs for the Lake County state’s attorney’s office, said while the office respects the jury’s verdict, it disagrees that this was a case of self-defense. |

Today, the House voted 94-57 to pass House Bill 1358, constitutional carry. It will now go to the Senate for further consideration. The Senate has already passed their own constitutional carry bill, Senate Bill 319. Governor Brian Kemp has stated his support for constitutional carry, so the General Assembly just has to send a bill to his desk. Please contact your state senator and ask them to SUPPORT HB 1358. |

A Fort Wayne man was found not guilty as he was on trial for a summer 2019 murder. It took a jury a little more than an hour to decide Demetre Payton was not guilty of murder or other charges in the death of Jamarkus Kindred. The incident happened back on July 27th, 2019. According to the Journal Gazette, the jury went into deliberations early Thursday afternoon in the trial, which began Wednesday morning.
The surveillance video and witnesses all supported the defense’s contentions that Kindred started problems, pulled a gun first and pointed it at Payton’s cousin. Payton has also maintained the shooting was self-defense since the beginning which four out of five witnesses testified to the same feeling. |

Sen. Lee’s letter reads, “We write to express our grave concern over the Bureau of Alcohol, Tobacco, Firearms & Explosives’ continued pattern of enforcing secret guidance. This secret guidance was brought to our attention by those who have received recent threatening letters where the ATF makes blanket threats based on the recipient allegedly purchasing and possessing various firearms accessories, none of which are illegal based on any statute or regulation.”
“We find the ATF’s attempt to conceal its interpretations of the law disturbing. In a free society, ‘Every citizen is presumed to know the law.’ Thus, as the Supreme Court has said, ‘it needs no argument to show that all should have free access’ to (the law’s) contents.” |

The Logan Township supervisors this week adopted a Second Amendment sanctuary agreement, one that all Blair County municipalities are considering, in order to comply with a countywide referendum passed by voters in November.
The agreement is in keeping with state law, in contrast to a proposed alternate agreement being pushed by the group that initially proposed the referendum, according to Logan solicitor Dan Stants. |

It was a tense morning on the floor of the Nebraska Legislature.
Emotions ran high as lawmakers end a filibuster and advance a bill on carrying concealed weapons.
LB 773 is sponsored by State Sen. Tom Brewer.
It would allow anyone who can legally own a gun to carry it without getting a permit to carry a concealed weapon. The bill would continue to allow schools to prohibit concealed weapons on their property.
Brewer said the bill is designed to protect those who carry a weapon not to be considered a criminal if they happen to cover the weapon with their coat.
The State Senator from Gordon challenged those leading the opposition, accusing them of opposing the constitutional protections to keep and bear arms. |

Both chambers of the General Assembly moved forward Friday toward banning “ghost guns,” those unregistered and untraceable firearms that can be bought online without a background check.
The Senate gave preliminary approval to its version with no debate.
The House of Delegates gave final approval to its version, but not without uniform Republican opposition.
Del. Haven Shoemaker, of Carroll County, argued lawmakers were criminalizing hobbyists and collectors by requiring all guns to have serial numbers. |
