Government seeks easier Internet wiretaps

"The US Justice Department has filed a petition this week to the Federal Communications Commission which requests that Internet Service Providers (ISPs) grant easier access to the FBI and other government agencies for monitoring Internet activity."

"The petition seeks that wiretaps (or snooping as it's known) and other surveillance methods effectively be paid for by the consumer."

"The petition comes as government agencies grow more concerned over the anonymity of the Internet and its possible uses for terrorist and criminal communications."

"However the petition aims to cover all forms of communication across the Internet, such as web site monitoring, instant messaging, e-mail and voice over IP (Internet digital telephone calls)."

MA: The Massachusetts Internet tax mystery

"A mystery is brewing in Massachusetts over how state tax collectors learned the identities of residents who bought cigarettes over the Internet." ...

"...The two possible culprits: DirtCheap and the United Parcel Service, which the company uses to ship cigarettes. DirtCheap's lawyer told the Boston Globe that his client did not turn over the customer lists but said the state had obtained UPS spreadsheets that have delivery information. ..." ...

" 'The company's privacy policy is somewhat ambiguous, saying 'we do provide personal data to government agencies as required by law or regulation.' Rosenberg said that means 'a subpoena or part of the discovery process in a formal manner to comply with the law--it's definitely more than a mere request.' " ...

"Massachusetts may have the law on its side in tracking down its taxpayers, but it doesn't mean that the law is right or that the taxes are wise. Attempts to collect revenue should be weighed against the privacy of taxpayers. Turning UPS or other shipping companies into government informants that report on Internet shoppers is not an acceptable price to pay."

"The editorial insinuated that this bill provides "wholesale exemptions from civil lawsuits" to the gun industry. That is completely untrue. The bill only seeks to protect manufacturers from frivolous and politically motivated lawsuits where harm has been done by third parties." ...

"If a firearm functions as intended and is sold legally, should a gun manufacturer be sued if a criminal misuses the gun? That is the kind of politically motivated lawsuit that this bill addresses." ...

"The gun control lobby has been increasingly unsuccessful in seeking to ban all firearms from America. Therefore, it is trying to turn away from lawmaking to trying to force its agenda through the court system by twisting the interpretation of current law." ...

"The Star Tribune writes: 'There is simply no legitimate need for those types of rapid-fire weapons.' "

"That's not how rights work. Is there really a legitimate need for most peaceful demonstrations? And who should determine which demonstrations are legitimate? Applying the antigun logic to the other amendments clearly shows how flawed the antigun, politically motivated thinking is."

Senators seek to limit Internet tax moratorium

"Four U.S. senators will introduce a bill to extend a now-expired Internet tax moratorium by two years, instead of a permanent ban on Internet-only taxes that passed through the U.S. House of Representatives in September."

"Senators opposed to the permanent ban in the House-passed Internet Tax Non-discrimination Act said the definition of Internet access in the bill could result in a ban on taxing many telecommunications services as carriers of traditional telephone service move more of their traffic to the Internet. Sens. Thomas Carper (D-Del.) and Lamar Alexander (R-Tenn.) said their two-year extension of a five-year moratorium would continue the ban but define Internet access as not including telecommunications services." ...

"Sens. George Allen (R-Va.) and Ron Wyden (D-Ore.), co-sponsors of the permanent Internet Tax Non-discrimination Act in the Senate, have backed a permanent ban as good for growth of the Internet. ..."

"Putting your personal opinion of Stewart aside for a moment, the case prompts larger questions about the laws and regulations that govern our land: If jurors can’t understand a law well enough to determine if someone broke it, just how do lawmakers expect citizens to understand it enough to obey it? Do we really want to live in a country where good-intentioned people are required to pay high-priced attorneys to tell them whether or not they’re breaking the law?"

"We had a paralegal who did bad research."

"The paralegal apparently fell victim to one of the many official looking Web sites that have been put up by pranksters to describe dihydrogen monoxide as 'an odorless, tasteless chemical' that can be deadly if accidentally inhaled."

"As a result, the City Council of this Orange County suburb had been scheduled to vote next week on a proposed law that would have banned the use of foam containers at city-sponsored events. Among the reasons given for the ban were that they were made with a substance that could 'threaten human health and safety.' "

"Victor Schwartz, a leading expert on tort law ...thinks a greater danger to the industry is that at some point state attorneys general will start filing lawsuits demanding compensation for Medicaid expenses, as they did with tobacco."

"...The agreement that settled the state tobacco lawsuits in effect imposed a nationwide tax and nationwide regulations, including advertising restrictions that would have been unconstitutional if imposed by statute, without approval from Congress or any state legislature."

A 3311, which would prohibit the sale of any pistol or revolver not containing a 'child-proofing' device; and A 4615C, which legislates how gun owners must store their firearms and creates new crimes and penalties. "With the federal ban on assault rifles due to expire in six months, two state lawmakers plan to introduce a measure this week that could lead to a Maine law banning the weapons. During a news conference Sunday, state Sen. Ethan Strimling, a Democrat from Portland, said he does not believe the 10-year-old federal ban will be reauthorized, even though the president has said he would sign a reauthorization."

"Unless the state Legislature acts now, Strimling said, it will be a year before a state ban could be put into effect. 'If that's not an emergency, I don't know what is,' he said."

-------
An emergency? These weapons are used in about 2 percent of all crimes, and were used even less frequently before the federal ban. The paranoia is unwarranted.

"In case you hadn't heard, last week the residents of Killington voted overwhelmingly to secede from Vermont and join their neighbor to the east. That's pretty darn remarkable, especially when you consider that Killington is smack dab in the middle of Vermont, and not on the New Hampshire border."

"Why would the good people of Killington want to do such a thing? Taxes, pure and simple. Somebody up there figured out that Killington sends about $10 million in tax revenues up to Montpelier, and only gets back about $1 million. They looked east, saw lower taxes and smaller government, and decided they would rather be there."

"The American Civil Liberties Union of Nevada (ACLU) today applauded passage of a resolution by the Elko City Council enforcing the protection of individual liberties for all residents in the face of intrusive federal actions taken since 9/11. The pro-civil liberties resolution makes Elko one of the strongest critics of the federal government's controversial USA PATRIOT Act and initiates policies prohibiting enforcement of the law at the city level. Adopted by a unanimous vote, the city of Elko's resolution is the second in the state of Nevada, following Elko County, and the 264th of its kind to pass in a city, county or state jurisdiction around the country. "Under the plan approved by the Council, non-EU sellers would register in one of the 15 member states of the European Union, but would collect tax based on the actual locations of customers. Sellers of digital products would be included in the new rules (software, video, music, books, and entertainment), collecting VAT on sales to European non-business customers, once their sales reach a certain threshold."

It happened at about 9 p.m. in the 2300 block of Barnor Drive, Indianapolis television station RTV6 reported.

Police said the couple's 13-year-old son called 911 and said his father was attacking his mother before she delivered the fatal blow. The man was declared dead at the scene.

Investigators were questioning the woman and more information was expected to be released about the incident Monday.

Prosecutors will review the case and decide whether it was justifiable homicide or whether charges should be filed, police said.

"...I'm wondering why certain Republicans are choosing to hand the Kerry campaign a controversial issue on a 'nickel-plated' platter. That issue being the ban on assault weapons."

"Politics aside, for national security reasons, a number of Republicans, independents and even Democrats believe it's imperative to re-elect President Bush. As potential 'single issue' voters, these Americans strongly believe that post-Sept. 11, Bush has and will continue to take the fight to the terrorists. So again, I ask some of my fellow Republicans, if you believe this to be true, why endanger his re-election by supporting these obscene weapons of death?"

"...The opponents of concealed carry, however, do have one irrefutable statistical and argumentative advantage. So remember these two questions and one number, and make it the core of opposing concealed carry:"

"Q. Do guns that are available for self-defense make people safer?"

A. No."

"Q. How much less safe?"

"A. 22 times less safe."

"A gun in the home - thus available for self-defense - is 22 times more likely to be used in an assault or homicide, an accidental shooting or a suicide or attempted suicide."

"The study was published in The Journal of Trauma, Injury, Infection and Critical Care, in August 1998, by Dr. Arthur Kellerman of Emory University in Atlanta and four other authors."

-------
It's difficult to believe any "journalist" with integrity would insult our intelligence by citing one of the most discredited studies in existence today. Even the study's author Arthur Kellerman admits that his study did "not include cases in which burglars or intruders are
wounded or frightened away by the use or display of a firearm." He also admitted his study did not look at situations in which intruders "purposely avoided a home known to be armed."

In other words, this “study” was tailored to achieve a desired result.

In his critique of this “study”, criminologist Gary Kleck notes that the estimation of gun ownership rates were 'inaccurate," and that the total population came from a non-random selection of only two cities.

The only people who still give any credence at all to this biased piece of work are gun banners with an obvious agenda.

"WHAT do you give someone who’s been proved innocent after spending the best part of their life behind bars, wrongfully convicted of a crime they didn’t commit?"

"An apology, maybe? Counselling? Champagne? Compensation? Well, if you’re David Blunkett, the Labour Home Secretary, the choice is simple: you give them a big, fat bill for the cost of board and lodgings for the time they spent freeloading at Her Majesty’s Pleasure in British prisons."

"On Tuesday, Blunkett will fight in the Royal Courts of Justice in London for the right to charge victims of miscarriages of justice more than £3000 for every year they spent in jail while wrongly convicted. The logic is that the innocent man shouldn’t have been in prison eating free porridge and sleeping for nothing under regulation grey blankets."

 QUOTES TO REMEMBER
I know of no safe depository of the ultimate powers of the society but the people themselves; and if we think them not enlightened enough to exercise their control with a wholesome discretion, the remedy is not to take it from them but to inform their discretion. —THOMAS JEFFERSON
