FL: Florida bill sparks debate over right to self defense during unlawful arrest

But other changes the bill proposes has raised concerns among defense attorneys and state Democrats.

“For whatever reason, they don’t want somebody to resist an excessive unlawful arrest. Well, shame on you,” said State Representative Mike Gottlieb (D-Davie) during the bill’s last committee stop in the House Thursday.

The legislation deletes language in state law that prohibits law enforcement officers from using force when they know an arrest they’re carrying out is illegal and language that allows a person to defend themselves if they’re unlawfully being arrested or detained.

Instead, it would permit a person to defend themselves only when excessive force is used by an officer.

There are many scenarios that can justify the use of deadly force, for instance, a home invasion or a person carrying a machete while aggressively approaching you on your property. Both could be arguments for the castle doctrine law on Guam, but as Attorney General Douglas Moylan stressed, the facts must support that an imminent threat of death or serious injury was present.

On Saturday, the Francisco C. Chargualaf Gymnasium filled with residents of Malesso' and the surrounding southern villages. All wanted to learn more about the laws in place that allow them to protect themselves and others through deadly force on their property and curtilage.

A measure before the California State Assembly that would have imposed a duty to retreat upon citizens before using lethal force to protect themselves from threats has been pulled from consideration by the bill’s author.

The measure had been introduced by Democratic Caucus Chair Rick Chavez Zbur, who touted the measure in a recently released statement as a way to close a dangerous legal loophole “that could allow armed aggressors to initiate confrontations in public, kill their victims, and then exploit self-defense laws to escape accountability.”

A court says there is no constitutional right to possess brass knuckles in Michigan - a weapon banned in nearly two dozen states.

The Michigan Court of Appeals, in an 18-page opinion, declined to interfere with a 1931 law that carries a five-year prison term for simply having brass knuckles, also known as metallic knuckles.

A “ban on the possession of metallic knuckles falls within the historical tradition of prohibiting the concealed carry of metallic knuckles as a dangerous and unusual weapon,” Judge Christopher Murray wrote in a 3-0 opinion Tuesday.

The 9th U.S. Circuit Court of Appeals ruled Thursday that California’s ban on magazines capable of holding more than 10 rounds is constitutional, overturning a previous ruling by a San Diego federal judge who found the state law violated the Second Amendment.

In a 7-4 decision authored by senior circuit Judge Susan Graber, an appointee of former President Bill Clinton, the majority wrote that “a large-capacity magazine has little function in armed self-defense, but its use by mass shooters has exacerbated the harm of those horrific events.”

A bystander with a firearm intervened during a violent altercation involving a knife at a McDonald’s in Nashua, New Hampshire.

On Tuesday night, a fight broke out between two groups who police believe knew each other, and it quickly escalated when 22-year-old Jose Vasquez repeatedly stabbed a 32-year-old man multiple times in the face and abdomen.

Felix Marengo, a bystander eating in his car, witnessed the attack and intervened. He told WMUR reporter Maria Wilson, “A guy started getting stabbed. I got out of my car and took my handgun out. As soon as they saw that, the stabber started running behind Wendy.”

A president’s cabinet includes the vice president and 15 federal executives, such as the attorney general, the secretary of state and the secretary of the interior. These nominees must be confirmed by a majority of U.S. senators. As each new administration comes in, there is a rush from the administration to get its cabinet confirmed so the officials can then hire their staffs and begin to fulfill the new president’s campaign promises.

During the video, Judge Lawrence VanDyke of the U.S. Court of Appeals for the 9th Circuit said his colleagues have a "basic misunderstanding of how firearms work."

Throughout the 18-minute video, VanDyke said large-capacity magazines should be covered under the Second Amendment. He argued that the magazines can allow the gun to function better, and should be considered functional parts, not accessories. He said he had planned to voice his arguments in his dissent but found it "obviously much more effective to simply show you." He stated that the guns featured in the video were inoperable for safety reasons.

Wyoming Gov. Mark Gordon signed a letter this week vetoing Senate File 196 – Second Amendment Protection Act – amendments – a bill that was sponsored by Wyoming Sen. Tim Salazar, R-Riverton.

The legislation would have amended Wyoming’s current SAPA law, which prohibits the state and its political subdivisions from using state funds “to enforce, administer or cooperate with any unconstitutional act, law, treaty, executive order, rule, or regulation of the United States government that infringes on or impedes the free exercise of individual rights guaranteed under the Second Amendment.”

In today’s sneak peek, Bobbie (McEntire) and Emmett (Linn) go head-to-head in a discussion about whether they need an alarm system. The debate is prompted by Isabella (Belissa Escobedo), who thinks the bar would be a safer place should they vote “yes.” Putting Bobbie and Emmett at odds, the discussion heats up after the former says she’s certain she can protect her inherited bar without help from the hulking cook — or any newfangled alarm. As they go back and forth, Bobbie reminds Emmett that she has pursued her Second Amendment rights and is ready to blast away anyone who has ill intent. Finally, the pair settle on a good old-fashioned shoot-out, each one ready to head to the firing range to see who has the best shot.

Only three days after disgraced Biden holdover and acting U.S. Attorney Michael Simpson argued in front of the 5th Circuit Court of Appeals that suppressors are not arms protected by the Second Amendment and that the defense’s request for an en banc hearing in United States v. George Peterson be denied, the Department of Justice has sent Simpson back with his tail between his legs to request a 30-day delay in the court’s ruling so the government may “further consider its position.”

The unusual video dissent has already drawn significant attention and criticism. Six of the seven judges in the majority issued a concurring opinion written by Judge Marsha Berzon that called Van Dyke’s video “wildly improper.” As Judge Berzon explained, Van Dyke had “in essence appointed himself as an expert witness” in the case, “providing a factual presentation with the express purpose of convincing” people of “his view of the facts without complying with any of the procedural safeguards that usually apply” to expert testimony “while simultaneously serving on the panel deciding the case.”

Under Pam Bondi’s leadership, the Department of Justice (“DOJ”) was supposed to take a hard look at cases that might have affected an American’s Second Amendment rights. Now, in a recent case out of Texas, the DOJ argued that the Second Amendment does not protect suppressors.

The United States v. George Peterson case caused an uproar in the Second Amendment community when a three-judge panel from the United States Court of Appeals for the Fifth Circuit declared that silencers are not protected arms.

The Florida House is set to vote Wednesday on a contentious bill (HB 759) that would lower the minimum age for purchasing rifles and other long guns from 21 to 18, reigniting the state’s fierce debate over gun control.

The bill, sponsored by Rep. Michelle Salzman, R-Pensacola, and Majority Leader Tyler Sirois, R-Merritt Island, aims to overturn a law enacted after the 2018 mass shooting at Marjory Stoneman Douglas High School in Parkland, where 17 people were killed.

Ultimately, Albritton’s powerful emotions will play a critical role in one of the highest-profile decisions of this legislative session: whether to change the allowable age for buying long guns from 21 back to 18 as it was before Parkland. As Senate president, Albritton can decide whether his chamber takes up a bill rapidly moving through the House. Though he has not clarified his intentions, three similar bills by senators have not moved since they were first introduced.

Robert Leider, Associate Professor at Antonin Scalia Law School, George Mason University, has taken over as the ATF’s Assistant Director and Chief Counsel.

This comes less than a month after the Trump administration issued walking papers to Pamela Hicks and showed her the door. The timing of the move couldn’t be better, as gun owners are losing patience with the process while watching other issues precede the Second Amendment and holdover idiots like U.S. Attorney Michael Simpson stating that suppressors fall outside the constitutional right to bear arms.

The North Carolina Senate passed a bill Thursday that would eliminate concealed handgun permits, making it easier to carry hidden guns in cars and public places.

The Republican legislation also would drop the minimum age for carrying a concealed firearm from 21 to 18.

The bill's sponsor, Robeson County state Sen. Danny Britt, said people sometimes wait six months to receive their permits from local sheriff's offices.
