Congress Told of More ATF Abuses, Reforms Suggested

"Tucson Police Lt. Michael Lara was among a panel of witnesses who told the House Judiciary Subcommittee on Crime, Terrorism and Homeland Security that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is in need of serious reform." ...

"Lara purchased a handgun from a federally licensed firearms dealer (FFL) in 2003, planning to give it to a friend who was licensed by the Arizona State Police to carry a concealed weapon. One of the forms he completed as part of the purchase asked if he was the 'actual buyer' of the firearm. The 28-year law enforcement veteran read the definition of 'actual buyer' on the form and answered the question 'yes.'" ...

"'It just makes no sense to me why ATF would try to prosecute someone who had dedicated themselves to serving our community and who clearly did nothing wrong,' Lara concluded. 'It was obvious that there was no intent of wrongdoing.'"

Mayor Bloomberg testifies before the House Judiciary Subcommittee on Crime, Terrorism and Homeland Security (Yet another report)

"To protect all New Yorkers, we must not only root out and punish those who possess, use, and sell illegal weapons - and we are doing that more effectively than ever - we must also do everything in our power to keep guns out of the hands of those criminals in the first place. This requires us to look beyond our borders, because 82% of the guns used in crimes in New York City were purchased outside of New York State."

"HR 5005 would make it immeasurably harder to stop the flow of illegal guns across our borders and into the hands of criminals by offering extraordinary protections to gun dealers who knowingly sell guns to criminals, and depriving local governments and their law enforcement agencies of the tools they need to hold dealers accountable."

-------
Translation: to protect New Yorkers, who are disarmed by their tyrannical government, we must relieve everyone else of their Constitutional rights as well.

"The firearms industry dismissed New York City Mayor Michael Bloomberg's comments at a House Judiciary Subcommittee hearing today, saying there are good reasons why Congress does not allow the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to make available to the public sensitive information about sales records of guns used in crimes."

"The firearms industry supports HR 5005, a bill introduced by Rep. Lamar Smith (R-Texas) that would make permanent a prohibition against sharing traced gun data except for legitimate law enforcement purposes. Although Bloomberg criticized the legislation, a Congressional appropriations committee in 2005 said that releasing the information to the public would only jeopardize ongoing criminal investigations and could endanger law enforcement officers, informants and witnesses."

New York Mayor Michael Bloomberg blasted Congress on Tuesday for considering what he called a "God-awful piece of legislation" on guns. A congressman charged he was just trying to spur more lawsuits against the gun industry. Bloomberg went to Washington to speak out against a bill offered by Rep. Lamar Smith, R-Texas, which would make permanent a bar on federal authorities' sharing gun trace data with local governments; the governments had used such information to launch lawsuits against gun manufacturers and dealers.

"By fueling paranoia, the NRA has convinced even non-members that ANY gun law is really a step toward having federal agents busting down doors to confiscate people's guns."

"The NRA has blocked efforts to end what's called 'straw sales': Buying handguns in bulk so they can then be turned around and sold to people who wouldn't otherwise be able to pass a background check."

"The NRA has stymied attempts to shut down the ability for anyone attending some gun shows to walk out with any weapon their money can buy without so much as having to show a drivers license."

KABA Note: Ken says the big, bad NRA boogie monster is responsible for all of America's ills, but they're the ones fueling paranoia? Pot. Kettle. Black.

"A better example might be that if this measure had been on the books back in 2002, authorities in Maryland would not have been able to trace the gun used by the D.C. sniper back to a gun store here in Washington State."

"New Yorkers Against Gun Violence (NYAGV), New York's leading state-wide grassroots gun violence prevention organization calls on Congress to reject efforts by the gun lobby to limit law enforcement access to ballistic trace information. HR 5005, introduced by Mr. Smith of Texas would prohibit law enforcement from receiving complete ballistic trace data from the Bureau of Alcohol, Tobacco and Firearms (ATF)."

"HR 5005 mimics language included in recent years in the ATF appropriations bill that restricts law enforcement access to crime
scene ballistic trace information. The bill allows for access to the information only as it relates to a specific criminal case. Police Officers attempting to solve gun trafficking crimes need access to all trace information to be able to put together gun trafficking patterns."

"Big business outgunned the National Rifle Association in a long-running skirmish Tuesday over a bill allowing employees to keep weapons locked in their cars while at work." ...

"Since Florida has issued concealed weapons licenses to law-abiding citizens for nearly 20 years, the NRA contended that banning guns from locked cars was an infringement on the Second Amendment. But the business lobby said forcing employers to allow workers bring their guns to work - even in the parking lots - was an intrusion on private property rights and the employer-employee relationship."
