"But here is the rub. SB 24 at one time contained a prohibition on a statewide database of gun owners (thanks to Sen. Doug Lamborn), but the provision was removed by the full Senate *with the help of Sen. Chlouber, the Republican bill sponsor*. The bill now contains no prohibition on a statewide database, and because many sheriffs are already entering CC permit information into the state's criminal justice database, meaning permit holders show up along with criminals in the search every time law enforcement stops someone on the street, the lack of a prohibition on this activity amounts to an endorsement of the activity. Indeed, why else would the database prohibition be specifically removed by the full Senate?"

"The shrinking of Congress' range of action has been startling. For six decades beginning in the 1930s, the Court had held that the Constitution's grant of authority to Congress to regulate "commerce ... among the several states" provided the basis for a wide variety of economic and social legislation. But in 1995, in United States v. Lopez, the Rehnquist Court began to turn that around. Lopez invalidated the Gun-Free School Zones Act of 1990, which had made it a federal crime to possess a firearm within a certain distance of a school. To reach this decision, the five-justice majority asserted the traditional primacy of the states with respect to law enforcement and education -- although the Constitution neither assigns these issues to the states nor places them beyond the scope of national power. The Court majority also claimed that there was no demonstrated connection between guns in schools and economic activity (commerce)."

The family was brutally attacked in their home.

"After about 10 minutes, Shaw was able to get into the bedroom in which he kept a .22-caliber rifle, Pauley said."

"There were 16 bullets were in the rifle when Shaw burst out of the bedroom, intent on getting the intruders away from his family, away from his house."
