Larry Pratt: Why The Instant Background Check Is A Bad Idea (BFA)

"Congress has legislation before it to expand the Instant Background Check, aka the Brady Law."

"Rather than expand the program, it should be abolished."

"Since the background check is mostly defended on its value in supposedly 'keeping guns out of the wrong hands,' let's consider that idea."

"If we were to do away with the Instant Background Check, the question is frequently asked, how would we keep guns out of the wrong hands. The answer is, we would be as successful without the check as with it. How do we know?"

"The Centers for Disease Control, an anti-gun federal agency, has examined several studies that focused on guns and crime. Their conclusion? They found that there is no impact from gun control laws, including the Brady Law, on crime." ...

Banning the guns (or the iPods) can't replace common sense (BFA)

"In this latest example of the nanny state mentality comes a ridiculous story. New York State Senator Carl Kruger has proposed banning iPods and the use of other electronics at crosswalks. The reasoning behind this feel-good legislation is the claim that pedestrians are increasingly distracted by iPods, cell phones and Blackberries, allegedly resulting in a rise in traffic accidents. Although Kruger did not produce any statistics, he cited a recent death of a 23 year-old Brooklyn man who, while listening to an iPod walked into the path of a bus." ...

"If we agree that stupidity cannot be cured by legislation, then we must ask ourselves what might be the real reason behind this kind of law?" ...

... "... But I do know this for sure: this country and all her people, including the hoplophobic nitwit housewives of Littleton, Colorado, owe their freedom from before the Founding up through today to brave men with scary guns like Petty Officer 2nd Class Danny Dietz Jr."

"And I'll tell you something else I know for sure. In the practical, common sense corner of the universe that I inhabit, and in my own modest opinion, regardless of where such loonies get their fear of firearms and whether it's treatable or not, I know this with absolute certainty: THESE PEOPLE ARE NUTS!"

"Contrary to public claims by the gun industry and the gun lobby, firearms ownership has declined dramatically over the past 35 years according to new survey data from the General Social Survey (GSS) ... Except for the U.S. Census, the GSS is the most frequently analyzed source of information in the social sciences and is the only survey that has tracked the opinions of Americans over an extended period of time. The NORC data comes out the same week that the National Rifle Association (NRA) begins its annual convention this Thursday in St. Louis, MO."

"The NORC data shows that during the period 1972 to 2006, the percentage of American households that reported having any guns in the home has dropped nearly 20 percentage points: from a high of 54 percent in 1977 to 34.5 percent in 2006. ..." ...

"Washington, D.C. Mayor Adrian M. Fenty is upset with a federal appellate court's 2-1 decision declaring his city's handgun ban unconstitutional as a violation of the individual Second Amendment civil right of law-abiding citizens to keep and bear arms."

"In announcing the District of Columbia’s request this week that the full appellate court rehear the case, Fenty dismissed Senior Judge Laurence H. Silberman's reasoned 58-page decision with the flip comment that 'more guns simply lead to more violence.'"

FULL TEXT BELOW:

The District of Columbia is asking a U.S. appeals court to strike down a lower court ruling that its ban on handguns is unconstitutional.

District Mayor Adrian Fenty, a Democrat, the district's attorney general and police chief appeared in court Monday to petition the ruling, The Washington Post reported.

Last month, in a 2-1 ruling, judges said the ban contravenes the Second Amendment, which says: a "well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

For decades, the District of Columbia has prohibited private citizens from owning handguns and limited ownership and use of rifles and shotguns.

"Say this much for Albany Mayor Jerry Jennings and his concern about gun crime. He's as well-intentioned as he is understandably frustrated, even if the gun registry he was proposing last week was ill-conceived and poorly researched to the point of being superfluous."

"And, by week's end, Mr. Jennings was in full and not ungracious retreat, hardly the most common of sights coming out of City Hall. The kind of law he was suggesting is going nowhere.  QUOTES TO REMEMBER
In the end, more than freedom, they wanted security. They wanted a comfortable life, and they lost it all — security, comfort, and freedom. When the Athenians finally wanted not to give to society but for society to give to them, when the freedom they wished for most was freedom from responsibility then Athens ceased to be free and was never free again. — EDWARD GIBBON [On ancient Athens]
