"Samuel Alan Yates, 43, appeared in Justice Court on Friday on a charge of attempted murder and is being held in the Missoula County jail on $100,000 bail."

"Yates told police he heard noises outside his house at about midnight Thursday, and looked out the window to see the young man in his vehicle, court documents said. Yates confronted the young man -- who apparently turned to run away -- then fired once with a .357 Magnum revolver, hitting him in the back of the head from a distance of about three feet."

FULL STORY BELOW:

An off-duty Houston police officer shot a man who he says pulled a gun on him overnight.

The deputy was working security at the time in a strip center on Antoine near West Tidwell. A woman who had just been robbed ran up to him and asked for help.

The deputy says when he caught up to the suspect, the man pulled out a gun. The deputy fired his weapon twice, hitting the suspect once.

The suspected robber was taken to Memorial Hermann Hospital, where he was in fair condition.
