"By 1988, gun banners had finally figured out that Americans were not going surrender their firearms willingly. The only way they were going to achieve their goal of total disarmament was through mass dissemination of misinformation and by infiltrating both the legislature and mainstream media."

"By 1994, the disarmament crowd had succeeded in banning the sale and manufacture of many commonplace semi-automatic rifles. They called it the 'Assault Weapons Act of 1994' and they achieved it by frightening the general public into submission."

The federal government’s ever-expanding criminal code: an affront to justice and the Constitution

"These are just three of the many cases that illustrate how federal criminal law has overstepped its proper bounds, prescribing draconian punishments for offenses that should be handled at the state level or that should not be considered crimes at all. During the last century, especially in the last three decades and in the aftermath of the September 11 attacks, Congress has made federal crimes out of an astonishing array of behavior, much of which is already prohibited by state law, could be better addressed with civil penalties, or is considered wrongful not because it violates anyone’s rights but only because Congress says so."

"The MILLER decision is to be LIBERALLY APPLIED to the lawful possession of firearms, not to be a conditional limitation on the possession of firearms. What good would the right against self-incrimination and the right to a jury trial, if MIRANDA was narrowly applied like MILLER?"

"What good was the Civil Rights Act of 1866, securing the protection of rights of all Americans, when in Democrat controlled southern States, Blacks were treated like second-class Americans? Court interpretations are to be an expression of the protection of rights, not statutes enacted by the Legislature. Only laws that are constitutional in the protection of rights have any standing. So the default is: All laws must protect unalienable rights."

"In 1911 the U.S. military adopted a new sidearm: John Browning’s venerable .45 caliber automatic pistol. That pistol served with distinction as our armed forces’ standard sidearm into the 1980s, when it was officially replaced by the Beretta M9 9mm automatic pistol. In recent years, however, the 1911 Model .45, in a more modern guise, has been enjoying a renaissance of sorts."

"In a judicial version of the terrorist attacks on the World Trade Center, the U.S. Fifth Circuit Court of Appeals has blasted a huge hole in the Fourth Amendment. If the Supreme Court fails to repair it, the Bill of Rights will topple as surely as did the Twin Towers 2 1/2 years ago." ...

"While the impact of the public release of the court's opinion was largely lost in the brouhaha surrounding the publication of Richard Clarke's parting shot at his former boss, its impact is likely to be much more profound over the long term. "If citizens of this country ever again enjoy the blessings of liberty and true freedom, it will not be the result of a majority of its citizens having risen up in righteous indignation at governmental abuse of themselves and their culture. If a restoration of the Constitution of our forebearers occurs - with all that this implies - it will probably not be because a plurality of citizens fought for it, supported it, or cared one way or another. If lawful government is reestablished it will come about because a revolutionary majority makes it happen."

"Virginia's regional jails are the only home left for about 500 immigrants waiting to be banished from the lives they had built here to countries they might not even remember. The Department of Homeland Security is detaining more than 23,000 people across the United States. Their crimes may be as minor as shoplifting or as grave as robbery or murder, but the U.S. immigration system no longer tries to tell the difference."

"Since 1996, people with misdemeanor convictions and nonviolent felonies, such as Mi-Choong O'Brien, have been branded as 'aggravated felons.' The law does not allow immigration judges to weigh the good against the bad in deciding whether to deport people living legally in this country, sometimes since infancy."

"Longtime residents can be jailed and deported for crimes they committed long ago, even decades before Congress passed the Illegal Immigration Reform and Immigrant Responsibility Act in 1996 and changed the rules."

"Misdemeanors under the laws of Virginia can be aggravated felonies under the law of immigration. A person sentenced to a year in jail is considered a felon - even if the time is suspended, even if the sentence ultimately is dismissed after its terms are met."

"Under contentious questioning, national security adviser Condoleezza Rice testified Thursday 'there was no silver bullet that could have prevented' the deadly terror attacks of Sept. 11, 2001."

KABA Note: HORSEFEATHERS! Allowing passengers to carry their personal firearms (and providing frangible ammunition if needed) would have certainly helped prevent the 9-11 terrorist attacks. So would a population that had not been indoctrinated to "go along" with bad guys and await rescue by government agents.

KABA Note: If he understands the threat, why hasn't he followed the Israelis' example and opened up the armories? Why has his administration been dragging its feet in arming pilots?

"Area law enforcement officials are split on what to expect from Ohio's new law. Some feel it won't make much of a difference, while others think the increase in carried weapons could make a lot of people -- citizens and law enforcement officials alike -- nervous."

" 'I think there's going to be an impact overall, everywhere,' said Oak Harbor Police Chief Weirich. 'Society is not used to seeing guns, and I'm not sure if society is quite ready for it.' "

"I'm not against gun rights -- but I think now with the average citizen having an even bigger right to have a gun on them, there might be some jittery officers out there on the street. I've been dreading this day coming, I don't know why. Maybe I shouldn't be so nervous about it."

Sounds like it's the officers' problem that should be addressed with additional training. Why should it be the citizens' problem, when all they are doing is exercising their constitutional rights?

"The state's new concealed weapons law takes effect today but Jefferson County residents will have to wait until Monday."

"Jefferson County Sheriff Fred Abdalla says the department had to purchase a special machine to take the pictures for the permit first."

"He says the county's official day starts Monday morning."

"Concealed-carry permits are open to Ohio residents age 21 and older who have lived in the state for at least 45 days. Applicants must undergo a background check, be fingerprinted and have completed at least 12 hours of safety training, including two hours of shooting practice, in the past three years."

"If a concealed handgun permit holder gets out of the car or takes a step off the sidewalk, there's a chance the gun will have to be put down and locked away."

"The list of so-called 'forbidden carry zones' in the new concealed-carry law that goes into effect today could conceivably include every place a person may travel on a particular day."

"Public buildings are out, as are schools, churches, day care centers and universities. That basically leaves privately owned buildings and businesses, but each of them can post signs banning guns if they choose."

-------
Our next step must be to remove these prohibitions, especially on carry in public buildings, which are, after all, "owned" by the taxpayers.

"The federal government is stalling the process to arm airline pilots, according to lawmakers pushing new legislation to jump-start the program created in 2002."

"Sens. Jim Bunning, Kentucky Republican, and Barbara Boxer, California Democrat, introduced the bill before the Easter recess to force the Transportation Security Administration (TSA) to implement the Federal Flight Deck Officer program the way Congress intended."

" 'The TSA has been dragging its feet in arming our nation's commercial airline pilots. It has been over 2½ years since the attacks of September 11th,' Mr. Bunning said in announcing the legislation last week."

"A last-minute change in the way the local sheriff's department will process applications for Ohio's new concealed-carry law will start by accommodating just six people a week."

"The sheriff's department had planned to take applications Tuesdays from 9 a.m. until noon from residents seeking the permit and then expand the program to meet demand."

"Richland County Sheriff's Lt. Bob Brown said Wednesday applications would be taken during that weekly three-hour window by appointment only, with appointments slated for 30 minutes."

-------
But this is the same Sheriff who will prosecute you for carrying without a permit, because the new law has removed all affirmative defenses for carrying without a permit.

"Two gunmen entered a residence in a gang-plagued public housing project in Watts and shot four people at close range, killing two." ...

"Officers have carried out 67 'parole and probation searches' that have resulted in 20 arrests and recovery of 20 guns, including 11 assault rifles..."

-------
Yet California denies law-abiding citizens to have comparable firepower with its "assault" weapons ban, as these criminals, who already use illegal guns terrorize them.

"A House committee yesterday voted in favor of requiring people subject to a restraining order to surrender any guns in their possession, sending two related bills to the House floor for a first-of-its-kind debate."

"McNamara and McManus both questioned why an exemption was made in the bill for police officers and not for other people required to have guns for work. The lawmakers also said they remembered a magistrate testifying that state judges already had the power to take away a person's guns if a victim raised it as an issue."

"People lined up before sunrise Thursday to be among the first Ohioans to apply for a permit to carry a concealed weapon."

"Geauga County officials estimated they processed an application every 15 minutes Thursday."

"In Lorain County, the line of applicants poured out the door into the rain. In Cuyahoga County, applicants won't be able to get a permit before the end of next month because of office renovations."

"James Irvine, who is a member and spokesman for OfCC, filed a lawsuit asking the State Supreme Court to force Sheriff McFaul to accept and process the applications with the other counties. Irvine filed the suit Thursday within two hours of the county's refusal to accept Irvine's concealed carry application."

-------
Interesting how some sheriffs' departments will go to any lengths to delay issuing these permits. What's next, literacy tests for those wanting to carry concealed?

"The Ohio FOP teamed up with a marketing firm to develop a kit for businesses and individuals who don't want guns brought onto their property."

"Under the concealed carry law that went into effect Thursday, signs must be posted in order for people to exercise their right to not allow permit holders to carry concealed weapons on their property."

"So the Ohio FOP joined up with Ohio firm JMS Marketing and developed the 'No Guns Allowed' kit."

"The kit includes a laminated sign, stickers, instructions on how to display them, and a 'frequently-asked-questions' on the new law."

-------
Submitter's note: As far as I know (and IANAL) open carry is still allowed in these locations. So when you enter, just remove your covering garment.

"Businessman Yoon Ho Song says he saw two men stealing his car from his driveway in the middle of the night and one flash what looked like a gun, so he fired a shot into the darkness."

"Now Song faces a trial on murder charges that could send him to prison for life in a case that has legal experts asking how far a man can go to protect life and property."

" 'When you think someone is going to pull a gun and shoot you, you have to shoot first,' Song's lawyer, Frank Rorie, told Reuters in an interview on Thursday."

-------
So the next time LAPD guns down an unarmed individual, we can expect to see all the officers involved charged with first degree murder, right?

"A study debunking the notion that guns are used in self-defense started out as a question in the mind of a 12-year-old boy from Tempe."

"After reading a 1998 Tribune article about a woman facing prosecution for a shooting she claimed was in self-defense, John Denton wanted to know how many people actually used guns in self-defense."

"With the help of his father, William Fabricius, a psychology professor at Arizona State University, Denton collected articles in the Tribune from April through June 1998 and tracked the cases through the courts to get an answer."

"His conclusion?"

" 'Almost nobody uses their guns in self-defense,' said Denton, now a 17-year-old senior at Mountain Pointe High School."

-------
Just because the story doesn't appear in a newspaper doesn't mean it didn't happen. Many times the gun is never fired, and the thug is merely scared away. Ergo, no story. Using nothing but a podunk newspaper to determine how many times people use guns in self defense is less than scientific and quite misleading.

"ALMOST nine years to the date, a police constable who shot and killed a Matelot villager is expected to know his fate today."

"Greene is charged with murdering Neil Sutherland on April 14, 1995."

"Two villagers, Ricky Sutherland, the brother of the dead man, and Carl Abraham, testified that Greene shot Neil as he was running away."

"But according to the version given by Greene and another defence witness, Neil had attacked two police officers with a cutlass."

"The accused said he fired a shot from his self-loading rifle, the bullet hit Neil under his right buttock and exited though the right front thigh.

How does someone threatening you with a cutlass get shot in the ass?

"When Harriet Sergeant and her neighbours discovered a shared sense of powerlessness at the level of crime in their street, they set about organising the policing of it themselves. But why should they have to? And why, when some US police forces have regained the trust of communities, can their example not be followed in Britain?" ...

"The Home Office says that crime is 'low' and that the 'real' problem is not crime itself but the public's irrational fear of crime. But when I asked 20 households in my immediate neighbourhood what crime they had experienced in the last three years, the tally suggested otherwise: 17 muggings and assaults, three houses burgled, two cars stolen and numerous incidents of petty theft and criminal damage."

-------
And why is the fear of crime irrational? When the public is disarmed by its own government and the government's agents are unable to protect them, that fear is very justified.

"The member representing Itu/Ibiono Ibom federal constituency in the Federal House of Representatives, Hon Barrister Ita Enang has called for the legalisation of arms in the nation as a panacea to the security problems currently being witnessed in the polity."

"He reiterated that the just concluded local government elections showed that the civilian armed class was more sophisticated and better trained than the military or police community."

"He added that Nigeria has found itself in a security crisis and should allow a measure of self defence and self protection by relaxing the rules of carrying arms."

"State Attorney John Tanner has paid a $2,500 fine for trying to board a flight at Daytona Beach International Airport with firearms and ammunition, just days before the second anniversary of the Sept. 11, 2001, attacks, federal officials said Wednesday."

"Tanner and his wife, Marsha, were detained briefly Sept. 9, 2003, when inspectors discovered firearms in the couple's checked baggage and knives and ammunition in Marsha Tanner's carry-on bag." ...

"Lauren Stover, spokeswoman for the southeastern division of the Miami-based Transportation Security Administration, said ...the fine -- the stiffest in the southeast region since the TSA took over responsibility for airport screeners under the Homeland Security Act after the terrorist attacks -- shows how serious the federal government is about safety at the nation's airports."

-------
Sounds like they're more serious about extorting revenue from people who made an honest mistake and keeping travelers disarmed and vulnerable.
