Kerry Still Thinks Second Amendment Is About Hunting

. . . "Kerry acknowledged in the interview that he must overcome a cultural disconnection in Arkansas, a potential battleground state. That’s because of his ranking by the National Journal magazine in Washington as the most liberal member of the Senate last year and a recent grade of 'F' from the National Rifle Association."

"'That grade is so phony,' Kerry said. 'I own and use guns. I’m a hunter, a fisherman. I’ve shot deer, woodchucks, just about everything you can hunt. And I’ve done it all my life. But I don’t use an assault weapon when I hunt. And no hunter that I know has lost his gun because of the Brady Bill. I support the 2nd Amendment. And I support law enforcement. The NRA — those guys called federal agents 'jack-booted thugs.'" . . .

Maybe Clarke and Rice Are Both Right

. . . "A centralized government agency can't be the main body entrusted to protect us. Because it must sift through too much data, almost all of which will turn to be benign, it moves too slowly. That was Dr. Rice's insight even if she didn't dare state it quite so bluntly. The government failed to protect us-that was Mr. Clarke's insight stated bluntly. So let's protect ourselves."

"Let's allow airlines to decide whether to let their pilots carry guns, as they were free to do before 1987. Pilots are now allowed to carry guns, but only if they give the government intimate details about their personal lives. If airlines want to man their flights with armed, retired FBI agents, as one major airline wanted to do until the FAA nixed it, they should be free to do so. And the government should allow other precautions that are too numerous to list in this short space. The lesson of September 11 is not that government should plan better and not that a Republican president plans better or worse than a Democrat president. The lesson of 9/11 is that central planning doesn't work and that government should not get in the way of our planning."

A Duty to Disobey: The Forgotten Lessons of My Lai

. . . "What will happen at upcoming courts-martial when the military defendants attempt to defend themselves by asserting they received encouragement from military intelligence operatives to 'soften up' Iraqi prisoners in the appalling manner that photos show they did -- encouragement that the soldiers interpreted as orders?"

"The answer to that question has not changed since My Lai, or since the Nuremberg trials of 1945, for that matter: Unless the individual soldier who has executed the unlawful order in Iraq had a gun placed to his head or been subjected to an equivalent form of duress, he will have no legal defense to the charge." . . .

What is the forgotten lesson for the rank-and-file soldier of the My Lai massacre case and others like it? Simply this: If you obey an order that violates the laws of war, you are the first one who will be hung out to dry.
-------

This lesson also applies to solders when they come to disarm us all.... but the government doesn't want thinkers they want drones to follow without question. That is the training in our schools and in the army.

"The prosecution demanded on Thursday a jail term of 1.5 years be handed down on a disabled 71-year-old man who shot and killed a robber at his business in Leidschendam last year."

"But the prosecution also told a court in The Hague that the man’s time spent in remand detention should be subtracted from his jail term, newspaper De Telegraaf reported on Friday."

"Cees Gardien — who is sick and spends most of his time in a wheelchair — reacted with disappointment. 'I am not a murderer and I did not want to kill the man. I have never done something wrong and yet I am treated like this.'” . . .

"[D]espite the fact that a knife was found underneath the body of Yuruyucu, the prosecution denies Gardien had the right to shoot him. The prosecution said the four robbers were not planning to kill him."

So now victims must be mind-readers.

"A Southwestern Oregon Community College student suspected of robbing an area bank had a Sharpie pen that was misidentified as a knife when he was shot and killed Wednesday by a Coos Bay Police officer, according to officials investigating the incident."

"Coos County Chief Deputy District Attorney R. Paul Frasier said he believed Detective Hugo Hatzel had no way of knowing that 34-year-old Steven Lile Garner was carrying a large pen and not a knife when he fired four rounds after ordering the man to get on the ground."

"A final determination on whether to pursue a case against the officer has yet to be made, but Frasier said he has seen no evidence indicating Hatzel acted improperly and added he believed the shooting is justifiable."

"'Based upon what I'm seeing so far, I don't see that he had a choice,' Frasier said during a press conference Thursday afternoon in Coos Bay City Hall." . . .

"The International Brotherhood of Police Officers (IBPO) is the only major national police organization to have endorsed the winner of the last three presidential elections. Today, IBPO endorses John Kerry because of his strong anti-crime record and because of President Bush's consistent failure to support law enforcement in the battle against crime and the war against terror. Joining the International Union of Police Associations (IUPA) in support of John Kerry, IBPO sends another message that John Kerry stands for a strong and safe America."

"Campbell, 66, said he was sitting in his car in front of a Kroger store last year when Woodlawn police officer George Wells approached. He was parked in the fire lane while he waited for his wife to come out of the store."

"'And a guy comes up to me and says, 'You're going to have to move. You're in the fire lane,' Campbell said. 'And I says 'OK.' I was reading a book and I started to put it down, and he says, 'I mean right now,' and I said 'OK.'"

Campbell drove his car to the entrance of an adjacent park, Jones reported.

"'I'm sitting in my car,' Campbell said. 'A guy swings my door open and jumps in my lap and maces me in the face. And I thought, 'What in the world did I do?' Next thing I know, they grabbed me. They had me on the cement. A guy has his hand on the back of my head. My lips are bloodied up. Two guys jumped on my back to handcuff me, and two guys started beating my legs.'" . . .

"The Government has rejected calls for a wholesale ban on imitation firearms. It claims it could not be enforced - but victims and police have urged the Home Office to think again, warning that gun criminals will run amok unless something is done." . . .

"The gunshots rang out across an eerily silent Mansfield Road. Armed police marksmen trained their guns on Jamie Clark as he waved a gun around on the balcony of his Sherwood flat and fired 21 rounds."

"For six hours he terrified the neighbourhood. When he finally gave himself up, detectives realised the gun was a fake - and the rounds had been blank." . . .

Isn't this the same rhetoric they used with every previous ban?

"Ministers were last night accused of imposing 'illogical, pointless restrictions' on thousands of Westcountry farmers and shooting enthusiasts, in order to distract attention from the Government's failure to tackle inner city gun crime."

"New Home Office proposals would place a series of 'onerous' restrictions on the Westcountry's 31,000 shotgun licence holders - and could see under-18s banned from using shotguns altogether."

"Home Secretary David Blunkett said the restrictions could help prevent firearms falling into the hands of criminals."

"But his comments were undermined by a new report from Her Majesty's Inspectorate of Constabulary, which suggested that criminals succeeded in stealing 'relatively few' licensed weapons." . . .

Gun control is an addiction, requiring ever increasing "fixes" to sate the cravings.

"The incident occurred Tuesday as police were investigating a gang-related machete attack on a 16-year-old that occurred early Monday. Although the victim is not a student at Annandale High School, police were questioning five teenagers outside the school."

"'I took six pictures of police and the students,' said Kyle Smeallie, 17, news editor of the A-Blast, Annandale's school newspaper, recalling the initial pass he and editor Paul Gleason made in a car within 500 feet of the school's entrance."

"By the time an officer stopped their car and confiscated the camera, Smeallie had snapped six more photographs."

"When the camera was returned by a second officer, the young men discovered that the photos had been erased."

"'He claimed he deleted them by accident,' Smeallie said. That would have involved multiple steps requiring deliberate actions. The officer allegedly threatened to have the principal remove them from the newspaper staff." . . .

"Janis Printz, 52, of suburban Powell, will be charged with attempting to take a weapon onto an airplane, said Thomas Rice, airport federal security director."

"Printz was released Thursday evening after being questioned, said Scott Lorenzo, a manager with the Transportation Security Administration."

"The maximum sentence upon conviction of the federal charge is 10 years in prison, and Printz could also face a fine of up to $7,500, Lorenzo said." . . .

"Rice said he believed Printz had a permit for the gun."

"'That doesn't matter. If you do have a permit to carry in Ohio, you can't carry it into the airport and attempt to take it on the plane in your carry-on luggage,' he said." . . .

“Riley's office reported Thursday afternoon the governor has not yet signed the bill, as he has been swamped by the nearly 100 bills passed by the Legislature in the last days of the session, which ends Monday. The governor is expected to sign the bill Monday, though, they said.” . . .

“Opposition to the bill came from Gun Owners of America, a gun rights group based in Springfield, Va.”

“Despite the opposition of Gun Owners of America, the legislation has gained the support of more mainstream gun groups such as the NRA.” . . .

"'Does what they did, when they pursued them, fall within the bounds of the law? That's one of the things we're going to be looking at,' said Houston Police Department homicide Lt. Ron Walker, whose squad is investigating the case."

"However, Allan Cease, the lawyer for the two brothers, said Manuel Sandoval, 22, and Daniel Sandoval, 20, were legally justified when they returned fire."

"'I absolutely believe that both of these young men acted in self-defense. They were in danger of losing their lives -- they were fired upon first,' Cease said." . . .

"Question: When we moved into our house two years ago, I was horrified to learn that the loud noise I first thought was from a neighbor's nail gun was from a local gun range. My neighbors say the gun club has been there forever, and there's nothing we can do about it. The Town Council told me the gun-club noise is 'grandfathered,' so there is nothing we can do. The surrounding area is residential. Most of the people at the gun club are from out of the area. Can we do anything?"

"ANSWER: The situation you describe is a public nuisance because it affects many people. Ideally, it should be abated by the city or county attorney.

However, if that official refuses to act, there are provisions for citizens to bring legal actions, such as by filing Small Claims Court damage lawsuits against the gun club.

Just because a public nuisance has existed many years does not make it legal. The loud noise, which can be abated or compensated, is an invasion of your private property." . . .

 QUOTES TO REMEMBER
Besides the advantage of being armed, which the Americans possess over the people of almost every other nation, the existence of subordinate governments, to which the people are attached, and by which the militia officers are appointed, forms a barrier against the enterprises of ambition, more insurmountable than any which a simple government of any form can admit of. Notwithstanding the military establishments in the several kingdoms of Europe, which are carried as far as the public resources will bear, the governments are afraid to trust the people with arms. — James Madison, The Federalist Papers, No. 46
