MI: Detroit City Council moves ahead with proposing gun-free zones, if state agrees

Detroit City Councilmember Mary Waters has a message for state lawmakers: Change existing gun laws to allow cities to establish gun-free zones.

As a result of increased violence in and around downtown Detroit, Waters proposed the establishment of gun-free zones by calling on state lawmakers to expeditiously approve changes to current gun laws, which council members approved on Tuesday.

Waters' proposed resolution was the first of two meant to stem gun violence that council voted on Tuesday. The Michigan Firearm and Ammunition Act 319 of 1990 prohibits cities from establishing gun-free zones in public spaces and council members are urging state legislators to repeal the law.

A federal judge on Tuesday blocked part of New Jersey’s new handgun carry law that barred weapons from being carried in so-called sensitive places and halted a new insurance mandate the law sought to institute.

The Supreme Court of the United States announced Wednesday it has chosen not to intervene against the Naperville “assault weapons” ban, but instead will let the judicial process run its normal course.

SCOTUS’s decision not to issue a stay at this stage is standard operating procedure.

Legislation to end a permitting requirement for concealed carry is on the move in Louisiana and would make the state the 28th to adopt constitutional carry as the law of the land. Constitutional carry passed the Louisiana legislature two years ago and Breitbart News reported that Gov. John Bel Edwards (D) vetoed it June 4, 2021.

Two rulings on gun rights this month show how a year-old Supreme Court ruling is forcing the lower federal courts to reckon with some of the more uncomfortable aspects of early American history. In one case, a federal judge in West Virginia ruled that gun-ownership bans for people with mental illnesses are constitutional. In the other, a federal judge in Virginia struck down a law that barred under-21-year-olds from buying handguns.

The Illinois Supreme Court is now deciding whether the state’s recently enacted assault weapons ban violates certain provisions of the Illinois Constitution. In March, a circuit court judge in Macon County sided with a group of plaintiffs led by state Rep. Dan Caulkins, R-Decatur, and declared the law unconstitutional. The state appealed directly to the Supreme Court, which put a hold on the Macon County decision and put the case on an expedited schedule.

So far this year, mass shootings are on the rise. So are laws expanding gun rights. This year, President Biden has worked to expand background checks and asked Congress to ban assault weapons and high-capacity magazines. Louisiana advanced a bill late Tuesday night that would expand gun rights in the state with a bill from a lawmaker whose 6-year-old granddaughter is "quite proficient" with an AR-15 assault rifle. Republican Oil City state Rep. Danny McCormick's House Bill 131 would allow Louisiana adults 18 and older to carry handguns without permits or training as is currently required.

Former President Barack Obama slammed America’s lack of gun control in a recent interview with CBS, claiming that the U.S. should respond to mass shootings by implementing gun laws like Australia, where there is no legal right to own a firearm. When asked why America can’t emulate Australian gun control, Obama made no mention of the Second Amendment to the U.S. Constitution guaranteeing the right to bear arms, he merely claimed that gun rights have become an "ideological" and "partisan issue."
