"A National Wildlife Federation poll of Wisconsin's hunters and fishermen shows the solid majority are Republicans who voted for George Bush in the last election."

"Results of the nationwide poll conducted by Bellwether Research & Consulting that were released Wednesday show while sportsmen are opposed to some of Bush's conservation policies, 68 percent voted for Bush in 2000 and 66 percent identified themselves as conservatives this time around."

"In Wisconsin, 72 percent of the sportsmen surveyed said there are 'very' or 'somewhat' conservative, while only 19 percent said they're liberal."

"That may come as bad news to Massachusetts Sen. John Kerry, a liberal Democrat, and his running mate, John Edwards."

"Smith & Wesson Holding Corp. reported profits of $1.4 million, or 4 cents per diluted share for the fiscal year that ended April 30, compared to profits of $15.7 million, or 44 cents per diluted share, in fiscal 2003. However, the company said its 2003 profit was buoyed by a one-time tax benefit of $12.4 million."

"The Brady Campaign believes that as long as civilians don’t own guns, it is an acceptable price to have more people raped, robbed, and assaulted. ...Enter Sarah Brady, member of the Washington elite by virtue of her husband, who was press secretary to President Reagan." ...

"So I ask you: Does the Brady Campaign represent American ideals? Does it support our Constitutional and civil rights? Does it offer us the whole truth and trust us, as reasoning individuals, to make decisions that are best for our families?"

A Glorious Sunset

"So, a pointless ban, and a wedge in on banning certain weapons for completely arbitrary reasons, is marked for death—thanks to the wonders of sunsetting. It's a potentially marvelous procedural weapon, one that is theoretically neutral in effect but holds forth an increased possibility of keeping momentary panics of a political season gone by from burdening the Republic for time immemorial. As Friedrich A. Hayek (and, uh, me, in this June 1996 Reason editorial) recognized, sometimes seemingly neutral and on-their-face contentless changes in rules can be powerfully effective in creating a more efficient and proper order of government—in this case, holding out hope for more curbs on power, and lessening the grip of the dead, and often hysterical, hand of the past on the present."

"Washington, DC - With only two months left, the Children's Defense Fund (CDF) today (July 12th) urged the Bush Administration and Congress not to let the 10-year-old federal Assault Weapons Ban expire on September 13, 2004. In spite of broad and bipartisan support for its extension, a leadership vacuum has brought our country to the brink of allowing assault weapons again to be sold and used throughout America."

Sentencing Guidelines Struck Down by 6th Circuit (Blog)

"Huge news out of the 6th Circuit Court. The 6th has ruled that Federal sentencing guidelines are un-Constitutional. Very interesting ruling that I agree with ..." ...

"All of this stems from last month's Supreme Court ruling in Blakely v. Washington. ..."

"Something that I found interesting about this entire case was the fact that this puts the Federal Sentencing Commission in peril. Why? ..."

"Traditionally, defining crimes and deciding on sentencing ranges has been within Congress's sole purview. But the Sentencing Guidelines changed all that. They were created not by Congress, but by the U.S. Sentencing Commission (although Congress reserves the right to veto any actions of the Commission)."

"In constitutional law, the non-delegation doctrine holds that Congress cannot give too much of its power away. Some thought that with the Sentencing Commission, it had done just that. But in Mistretta v. United States, the Supreme Court, by a vote of 8-1, held otherwise, and allowed the U.S. Sentencing Commission to stand."

"The lone dissenter in Mistretta was Justice Scalia - who accused the Commission of being "a sort of junior-varsity Congress." Now, ironically, by writing the Blakely opinion, Scalia may have dealt the Commission its final blow, wiping out this j.v. team."

"Because every sentencing factor now identified by the Commission has become an element of an aggravated offense, the Guidelines spell out actual elements of crimes, something only Congress has the authority to do." ...

"On another note, the 6th's ruling should help out Mark Lancaster as the government is attempting to appeal the judge's decision to downward depart from the sentencing guidelines giving him less time."

She slammed the DPP for what she called, 'going to the bitter end in the prosecution of some matters' when the evidence suggested they do otherwise. ... Weekes said, 'There seems to be a trend in the court these days that the State will go to the bitter end in the prosecution of some matters. Perhaps, if more careful study is given to the State’s briefs, that might not be so. This court is loath to think that the State, is engaged in a 'passing the buck' exercise so that the court will dispose of matters.'" ...

"Todd Rozof wants to add a paintball park to his golf training center."

"But city ordinances, which lump paintball guns in with their more lethal cousins, could stand in his way."

"Rozof went before the City Council Tuesday trying to work out a compromise, saying he doesn't want to invest the $25,000 to $30,000 it would take to develop the paintball park if city officials could then close him down for violating firearms restrictions."

"Paintball guns use pressurized carbon dioxide to fire small balls of brightly colored gelatin, which splatter harmlessly when they hit the target. Players stage mock battles where these splatters mark a 'kill' if they hit someone."

Pittsburgh is among the 15 cities nationwide chosen for the Violent Crime Impact Team Initiative, a new nationwide effort to curb gun crimes, and has begun working with federal agents and prosecutors to target three areas plagued with drugs and guns, the Associated Press reported July 12.

Officials with the Pittsburgh Bureau of Police said efforts would be concentrated in the Hill District, Homewood, and the North Side. Police data shows that the areas have high rates of gun crimes connected to drug trafficking.

The Pittsburgh effort will target individuals who are already on probation or parole and have been involved in gun violence.

Not that it has caused any trouble; to the contrary, all data shows - if anything - it has enhanced the safety of Minnesota citizens... Oh I know, they point to the legislature and say they connected this to another law, but so was the abortion law attached, in a similar manner, and they are not chasing that duck (so it all has nothing to do with the legislature).
