Terror in the Skies, Again?

"On June 29, 2004, at 12:28 p.m., I flew on Northwest Airlines flight #327 from Detroit to Los Angeles with my husband and our young son. Also on our flight were 14 Middle Eastern men between the ages of approximately 20 and 50 years old. What I experienced during that flight has caused me to question whether the United States of America can realistically uphold the civil liberties of every individual, even non-citizens, and protect its citizens from terrorist threats."

"One screener asked to manually inspect one of my bags, knowing that I had nothing in it that was prohibited based on the TSA's own site I allowed the search. This inspector found a lighter that I was given by my step daughter for our first Father's Day together. It was a cigar lighter that did not run on Liquid Fuel, but gas. (Unabsorbed Liquid fueled lighters are prohibited based on the above PDF). He looked at it and exclaimed, 'Wow I have always wanted one like this'. Then proceeded to tell me that he had to confiscate my lighter." ...

"...do not carry anything in your carry on luggage that a TSA screener may want for him or herself as they can apparently steal any personal items they personally wish to own."

" 'Excellent!' said GOA Director of Communications Erich Pratt. 'We're so glad to hear that you want to talk with us and help unite this nation. How about working with us to defend the Second Amendment to the Bill of Rights?' "

"Gun Owners of America notes that Sen. Kerry has not shown up for most of his Senate votes this year. However, Pratt said, 'He did fly into town this March -- specifically to ban several scores of semi-automatic firearms.' "

"GOA says Kerry's voting record on gun rights issues has been "consistently poor," and the group said it "looks forward to discussing these issues with his campaign. Gun Owners of America said it has contacted the Kerry campaign to take the candidate up on his offer."

Analyzing The 2nd Amendment

"Does the Second Amendment guarantee a right to states rather than an individual right to choose to own firearms? One clue to the answer is looking at who supports each position. The few law-review articles supporting the states'-right view all come from advocates, most of them employed by or associated with anti-gun groups." ...

"In fact, throughout the Bill of Rights and the Constitution the word 'right' is always used to refer to something individuals have and never used to refer to powers possessed by government. Such powers are always called 'power' or 'authority.' "

"Anyone who thinks that the Second Amendment is all about being a hunter ignores the crystal clear teachings of the Founders. ..." ...

"The Founders, who had rebelled against the yoke of a tyrannical government, bequeathed to their descendants a political philosophy distrustful of disarmament. Firearms in the hands of the civilian population were an integral part of their system of checks and balances, not a grudging concession to hunters. ..." ...

"It is obvious that John F. Kerry does not share the Founders' distrust of government power and does not comprehend ...why the American people would possibly want to possess any firearm that was more suitable for shooting people than for shooting game animals. ..."

"Ian Spiers had just hours to finish an assignment for his photography class. He was taking shots of a railroad bridge near the Ballard Locks when an officer with a German shepherd approached him, asked him what he was doing and requested some ID." ...

"It was the second time in less than two months that Spiers had been questioned about taking pictures of a landmark that attracts hundreds of tourists a day, many of whom snap photos of the ships passing between Lake Union and Elliott Bay."

"A growing number of photographers around the country have been similarly rousted in recent years as they've tried to take pictures of federal buildings and other major public works, said Donald Winslow, editor of the National Press Photographers Association's magazine."

"We've seen the constant erosion of our civil liberties amid this cry for homeland security by doing things that have an appearance of making us safe, but in reality it's a sham... No one showed up at the World Trade Center and took photographs from nine different angles before they flew planes into it."

"If you lived in an average American city and wanted to shoot a few baskets, you'd probably have to do little more than grab a ball and walk to the nearest park. You might not even have to leave your own yard."

"If you wanted to shoot a rifle, common sense, public safety and law dictate a much more regulated experience."

"But for many in 21st century America, a safe, supervised shooting experience goes beyond regulated - it is simply unattainable."

"Whether it's because of urban sprawl or the lack of a mentor or a sedentary, computer-centered lifestyle, the chance to shoot even a .22 rifle is becoming rarer and rarer for our youth."

"American Bar Association President Dennis W. Archer today said that, unless President Bush urges Congress to reauthorize the 1994 federal assault weapons ban, 'our communities will once again see an increase in senseless violence. We must ensure that the ban remains in effect for the sake of all law-abiding citizens.' " ...

"Archer said these weapons have no place on our streets. 'Since enactment of the ban,' he said, 'there has been a dramatic reduction in crimes committed with these prohibited firearms.' "

-------
The above statement is patently false, as the number of crimes committed with said weapons was miniscule BEFORE the ban and rose slightly after the ban.

"After quoting Bush's statement from the campaign trail - that 'assault weapons have no place around our society' -- Horowitz said, 'We've seen the hard-right conservatism, we're still waiting for the passion.' "

Ramsey County Attorney Susan Gaertner said the investigation into the April 20 incident is continuing.

Investigators say they don't know who fired Cha's police handgun at the home of Xang Vang, a translator to Hmong leader General Vang Pao. But the charges allege the officer gave a cousin his gun on two occasions.

"It may be legal, but it is insane. Is it really wise for people to tote a firearm around? ..."

"This law obviates the need for a permit as long as one straps the weapon on and wears it openly. If a person works in a convenience store late at night in a dangerous area, perhaps the sight of a holstered weapon might deter malefactors."

"In them thar hillbilly hills and suburban highways, law-abiding Virginians can carry a six-shooter openly in a hip holster or conceal a weapon in a designer purse, but they better not be caught toting a concealed machete."

"...Well, the Virginia legislature obviously thinks that a machete is more dangerous than a firearm or an assault weapon. Why else would they have made it illegal, as of July 1, to carry a concealed machete, but barred local jurisdictions from enacting any legislation or ordinances limiting laws concerning concealed weapons or 'open carry' options."

"A tidal wave of assault weapons will soon legally flood the country unless Congress acts quickly to renew expiring federal legislation."

KABA Note: Considering that even mislabeled "assault" weapons are historically used in less than two percent of all crimes, the above claim is hysterical and paranoid at best.

"Just what we don’t need -- more opportunities for deadlier weapons to fall into the hands of criminals ..."

KABA Note: Studies have proven that criminals prefer easily concealable weapons, not military-style rifles. And since when do laws deter criminals?

"Letting this law elapse would be a tragic mistake."

KABA Note: Why? Because paranoid hanky wringers say so?

 QUOTES TO REMEMBER
The prohibition is general. No clause in the Constitution could by any rule of construction be conceived to give to Congress a power to disarm the people. Such a flagitious attempt could only be made under some general pretense by a state legislature. But if in any blind pursuit of inordinate power, either should attempt it, this amendment may be appealed to as a restraint on both. — William Rawle, A View of the Constitution 125-6 (2nd ed. 1829)
