IL: Illinois Supreme Court issues ruling on state’s new gun restrictions

The Illinois Supreme Court on Friday upheld the state’s sweeping gun ban, fending off the first major challenge to the landmark law which now awaits its fate before a federal appellate court.

The state high court’s 4-3 ruling is a victory for gun control advocates who pushed for the law following a mass shooting during last year’s Fourth of July parade in Highland Park that claimed the lives of seven people and left dozens injured.

Ed.: 2A claims are being handled in federal court. This case was about lawmaking procedures required by the IL Constitution. This anti-democratic ruling, as shown by the D judge's dissent, should enrage all Illinoisans.

A couple charged with attempted murder were acquitted Friday of a beating — in which a person suffered a ruptured spleen and fractured ribs — after a defense attorney proved the defendants acted in self-defense, according to the Kern County Public Defender's Office.

John and Janet Murray faced attempted murder and assault charges in a Aug. 10, 2021 attack. Prosecutors said John beat a person with a baseball bat while saying "I'll kill you," a new release from the public defender said.

Deputy Public Defender Benjamin Nkwonta, John's attorney, showed how the man struck Janet Murray first and had a history of violence, the news release added.

In what’s been reported as an act of self-defense, an 18-year-old allegedly shot and killed a 16-year-old who was trying to rob him and at least one other person at gunpoint near N 87th St & W Silver Spring Dr on Friday morning.

...

However, one of the victims — an 18-year-old — was also armed at the time. The two individuals allegedly exchanged gunfire, leaving the 16-year-old robbery suspect with a fatal wound that eventually claimed his life.

As school is back in session, a local organization is working to properly train teachers in firearm safety and de-escalation of dangerous situations.

"We're advocating for the proper training, and then for those [school] districts to decide how they want to implement this training, and we're there to support them 110%," said Timothy Brashier, founder and owner of Practical Preparedness.

New York’s gun rights activists are a diverse lot, ranging from rural hunters and Second Amendment supporters to Black pastors in urban churches who say they want to protect their flocks from armed white supremacists.

Now, the operators of an Orthodox Jewish summer camp have joined the gun rights debate, with a lawsuit seeking an injunction that, despite a contested state law, would let them continue to be armed for self-defense.

Eliyohu Mintz, CEO of TheZone summer camp, and camp Administrator Eric Schwartz cited numerous anti-Semitic threats as a reason they should be allowed to continue to carry concealed weapons despite a recent tightening of state gun control laws.

Hawaii’s ban of butterfly knives has been declared unconstitutional by a federal court.

In Hawaii, it is a misdemeanor knowingly to manufacture, sell, transfer, transport, or possess a butterfly knife — no exceptions.

The judges of the Ninth Circuit Court of Appeals held that “Hawaii has not demonstrated that its ban on butterfly knives is consistent with this Nation’s historical tradition of regulating arms,” Judge Carlos Bea wrote regarding the case of Teter v. Lopez.

Security camera videos showed the two groups exchanging words for a few minutes. Both sides walked away, though one stayed behind, recording on his phone. Sibley and two friends returned and confronted the youth, and Sibley followed him as he walked toward a sidewalk and out of the frame.

Video shows the two reappear as Sibley rushes toward the youth, who darts around him, and both again disappear from view. A moment later, Sibley walks backward into the frame, checking his side, then collapses to the sidewalk.

The Illinois Supreme Court on Friday upheld the state's ban of the type of semiautomatic weapons used in hundreds of mass killings nationally.

In a 4-3 decision Friday, the high court found that the Protect Our Communities Act does not violate the federal Constitution’s guarantee of equal protection of the law nor the state constitution’s bar on special legislation.

With an appeals court slated to hear arguments in October, a Florida lawsuit challenging a federal prohibition on medical-marijuana patients buying and possessing guns might have received support this week.

The lawsuit alleges that the prohibition violates Second Amendment rights. But U.S. District Judge Allen Winsor in November granted a request by the federal government to dismiss the case.

In a separate lawsuit, however, the 5th U.S. Circuit Court of Appeals this week ruled that the prohibition violated the Second Amendment rights of a Mississippi man who was prosecuted and barred from having guns after authorities found marijuana in his car.

But in their decision last Friday, a three-judge appeals panel rejected that claim.

They also cited Bruen to defend their decision. Bruen centers the Second Amendment in determining who can have guns and under what conditions, requiring lawmakers to look back in history and follow the historical traditions that existed when the U.S. Constitution was written.

The appeals panel cited a March ruling in a similar appeal, in which Judge Richard J. Geiger wrote that lawmakers historically have disqualified people from possessing firearms not only for a “propensity for violence,” but also for the “perceived threat they posed to an orderly society and compliance with legal norms.”

Should individuals subject to domestic violence restraining orders be allowed to own guns? If you think the answer is a screaming, obvious “No,” you haven’t been paying much attention to the Supreme Court’s radical reinterpretations of the Second Amendment over the past 15 years. The Prairie State’s ban on selling AR-15s and similar firearms is back in effect.

In a four-to-three vote handed down Friday, the Illinois Supreme Court reversed a lower court ruling that struck down the Protect Illinois Communities Act (PICA). It found the lower court was wrong to block the law on equal protection grounds. However, it also refused to consider whether the ban on the popular firearms violated the Second Amendment.

“The record demonstrates plaintiffs omitted a stand-alone second amendment claim from the complaint and expressly disclaimed it in the circuit court, resulting in waiver,” Justice Elizabeth Rochford (D.) wrote for the majority in Caulkins v. Pritzker.

U.S. Vice President Kamala Harris jumped into another divisive American issue ahead of the 2024 re-election campaign on Friday, vowing support for activists trying to end gun violence and accusing gun law opponents of "hypocrisy."

Harris, who has embraced a more combative role as President Joe Biden's re-election campaign kicks into gear, took a swipe at Republicans who have blocked Democrats' proposed gun safety laws, saying such changes are no threat to Americans' constitutional gun rights.

"There are some people who are just trying to sell a false choice ... that you're either in favor of the Second Amendment, or you want to take everyone's guns away," she said.

By the time a hearing was held Friday, however, prosecutors had abandoned the talk of any order affecting who aren’t part of the case. That turned out to be a good choice, as the judge quickly said there was no basis for the order that had been suggested.

Dave Workman with the Second Amendment Foundation says the term ghost gun is used to demonize a common activity.

“Building firearms at home is a tradition that dates back to the colonial days,” Workman said.

He argues letting the gun kits be untraceable isn’t a serious concern.

President Joe Biden’s campaign is preparing to make gun safety a central issue of his reelection campaign, and that will start with the official approval soon and big rollout of a new executive action to massively expand background checks for gun purchases, multiple aides involved tell CNN.

Long sought by gun safety advocates, the executive action, which Biden set in motion in March, would expand the definition of which gun sellers are required to comply with federal licensing and background check requirements.

Lee’s proposal includes a law to address safety in the instance of an active shooter and restrictions on mentally ill people from having easy access to firearms. Republicans in the Assembly have been unwilling to restrict gun access for fear of infringing on Second Amendment rights, and they criticized Lee’s proposal as a red flag law.

Democrats in Tennessee are saying that Lee’s proposal does not do nearly enough; House Democratic Caucus Chair John Ray Clemmons said Lee “wilted in the face of the legislative supermajority.” Meanwhile, Republicans reiterated their dedication to not “infringing on the rights of law-abiding Tennesseans.”
