Ninth Circuit Remands Young v. Hawaii Back to District Court

On August 19, 2022, the Ninth Circuit Court of Appeals summarily remanded the Young v. Hawaii case back to the District Court for a re-hearing after the Supreme Court granted cert, vacated the previous Ninth Circuit decision, and remanded the case back to the Ninth Circuit for a rehearing. In 2011, George Young applied twice to obtain a permit to carry a firearm for self-defense outside his home in Hawaii, either openly or concealed. Both his applications were denied by the Chief of Police, Harry Kubojiri, who cited Hawaii law.

A Lexington judge is calling for stricter gun measures. Chief Fayette Circut Court Judge Kimberly Bunnell said too many guns are on the streets and thinks some people guilty of gun violence are not serving enough time behind bars. “We have way too many shootings in Lexington right now,” Judge Bunnell said.

This story has been a long time in the making. More than 20 years ago, my best friend walked into a local gun shop looking for a Big Bore 94 XTR chambered in .375 Winchester. I’ll spare you the details about why he was looking for that specific rifle, but he was surprised to find they still had one back on the shelf – still new in its original box. Perhaps more importantly, it still had the original price tag on it as well.

There is nothing really new about necking cartridge cases down to accept smaller bullets and thus increase muzzle velocity. Winchester’s first center-fire cartridge, the .44 WCF or .44-40 of 1873, was soon necked down to take a .40 caliber bullet over the same 40 grains of black powder. This new bullet weighed 180 grains instead of the 200- to 205-grain weight of the parent .44-40. For some reason, this new cartridge instead of being called the .40 WCF became the .38 WCF. Perhaps they did not want it to be known as the .40-40 so .38-40 it was and is.

A Second Amendment advocacy group on Tuesday asked a federal judge to block a New York state law that bans the carry of firearms in certain “sensitive locations” such as stadiums, hospitals and Manhattan’s Times Square. The request was part of a lawsuit brought by the Gun Owners of America against a New York law enacted this summer in the wake of a landmark Supreme Court decision expanding the Second Amendment.

Attorneys representing the Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms have filed a supplemental opening brief in their challenge of Maryland’s ban on so-called “assault weapons” based on the Supreme Court’s remand of the case back to the Fourth U.S. Circuit Court of Appeals following the landmark ruling in New York State Rifle & Pistol Association v. Officials in Lexington say the shooting death of a Colorado man during an August 16th home invasion is ruled as self-defense. The 11th Circuit Solicitor's Office say the shooting death of Matthew Stanfield, 33, was justified after Stanfield broke into a home in the Mallard Lakes neighborhood.

The August archery-only deer hunting season is almost here, and the Tennessee Wildlife Resources Agency is drumming up excitement by hosting a statewide Free Hunting Day on Saturday during the opening day of summer squirrel hunting season. A controversial new rule that addressed "ghost gun" scaremongering went into effect on Wednesday even though federal regulators made last-minute tweaks to the rule two days prior. Initially debuted with much fanfare by the Biden administration in May 2021, almost 300,000 public comments were logged by August 2021 on the published rulemaking in the Federal Register for the Bureau of Alcohol, Tobacco, Firearms and Explosives to change the definition of “Frame or Receiver."
