In opening statements Monday, lawyers for two people suing over Oregon’s new gun laws said Ballot Measure 114′s provisions are the “most significant threat to [the right to bear arms] Oregonians have faced in nearly 165 years.” “This case is not about public health, public safety or public concern,” plaintiffs’ attorney Tony Aiello told Judge Robert Rascio. “This is about individual rights. This is about the individual right to self defense and the right to bear arms to secure that right.”

ABC’s The View featured of a live performance of a gun control song that urged viewers stand against gun violence by saying “enough.”

The song, “Your Child, My Child,” was performed by Natasha Bedingfield and MILCK, and began by focusing on how a high profile shooting often results in the focus being on something other guns.

Below is my comment on new rules proposed by the Montana Department of Fish, Wildlife, and Parks, banning discharge of firearms in a wide array of places labeled as “public use sites.” This proposed rule set is now before the FWP Commission for consideration and adoption.

The Second Amendment Foundation and founder Alan Gottlieb have moved their civil rights lawsuit against Washington Attorney General Bob Ferguson from federal court to Washington State court in a move the plaintiffs hope will bring a speedier resolution to their case. “We believe we will do better in the state courts, considering Ferguson’s loss before the state Supreme Court earlier this year in the long running Value Village case,” said SAF founder and Executive Vice President Alan M. Gottlieb. “The state high court ruled unanimously that Ferguson’s office ‘improperly used Washington Consumer Protection and Charitable Solicitations Acts to suppress constitutionally protected speech with which he disagreed.’

 

California passes 11% gun, ammo excise tax critics say is unconstitutional

The California legislature passed a new excise tax specifically on firearms, firearm precursor parts and ammunition. The 11% levy, paid in addition to sales taxes, would take effect on July 1, 2024. The state has a base statewide sales tax of 7.25% with most cities and counties imposing additional sales taxes, meaning buyers of guns, parts and ammunition would pay taxes of at least 18.25% on their purchases in California. Critics of the measure say it exceeds legislative authority by taxing a constitutional right.

Attorneys representing the Second Amendment Foundation and its partners in a challenge of Delaware’s ban on so-called “assault weapons” and “large capacity magazines” have filed a reply brief with the U.S. Third District Court of Appeals in a consolidation of cases. SAF is involved in two of the three cases, known as Graham v. Jennings and Gray v. Jennings. SAF is joined by the Firearms Policy Coalition, DJJAMS LLC and individual citizens Owen Stevens and Christopher Graham, William Taylor, and Gabriel Gray. They are represented by attorneys Bradley P. Lehman at Gellert Scali Busenkell & Brown in Wilmington, Del., and David H. Thompson, Peter A. Patterson and William Bergstrom at Cooper & Kirk in Washington, D.C.

North Dakota District Judge Daniel L. Hovland sided with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) over the regulation of firearms equipped with pistol-stabilizing devices. The Firearms Regulatory Accountability Coalition, Inc. v. Garland was a lawsuit filed by the Firearms Regulatory Accountability Coalition (FRAC) and 24 state attorney generals challenging the ATF’s final rule against pistol-stabilizing devices. The case made similar arguments as presented in three Texas cases involving the Firearms Policy Coalition (FPC), Gun Owners of America (GOA), and the Second Amendment Foundation (SAF).

Wish they may, wish they might – gun control Democrats in Congress are still holding out hope President Joe Biden will deliver their biggest wish. What they shouldn’t hold is their breath. More than 60 antigun Democrats from the U.S. House and U.S. Senate sent a scathing letter to the president imploring him to “leverage the full power of the executive branch” and implement more gun control.
