The reason so-called "red flag laws" are controversial is that they circumvent due process of law by using ex parte hearings, i.e. hearings where the respondent is neither notified nor offered the ability to face his accusers, cross-examine witnesses, present exculpatory witnesses and evidence on his behalf, BEFORE his rights are suspended and his property confiscated.
And that is UNCONSTITUTIONAL.
It cannot be permitted to happen, and the SCOTUS needs to hear one of these cases pronto. |
